All that certain tract,piecey or parcel of
land lying and being situated in.Jefferson
County,. Texas, a part of the David Brown. Survey,
and described.by metes and bounds, as .follows,

River, where the W. boundary line of an easement

Beginning at a point where the east boundary
line'of Carroll Avenue intersects the north

Railroad spur track; thence southeasterly with

EEREA;S, said property was.purchased upon the recom-
mendation of the Port Commission of the City of Beaumont,
recognized in'resolution of` the City Commission.of the City of
Beaumont, dated September 14, 1936, duly recorded in the minutes
of the City Clerk, and said property was purchased with- the pro-
ceeds of municipal tax:.:, bonds issued pursuant to a vote of the
qualified voters of the City of Beaumont, conducted flay 4, 1929:
authorizing the issuance of said bonds for -the -purpose of acquir-
ing additional necessary sites for wharves and docks,for. the
City of Beaumont, and improving and eauipping.the same;..and,
IIERIAS, the. above described tract has never been used
as a. site for wharves and docks for the City of'Beaumont and has
never been improved, or . equipped for. such use; . and,
vMREASj the Port bommis.sion of the.City of Beaumont
by',,formal resolution adopted at its meeting the -4th day of "
October, 1946, has recommended to the City Commission of the
City of Beaumont that said property be abandoned as a: site for
future construction of wharves or docks or use for wharf and
'dock purposes, and has -'declared that such property is not suit-
able for wharves or docks ; and;
MPMAS, the City 'Commission': of the City of Beaumont
is of the opinion and finds.that said tract is.'not suitable as
a site for wharves and docks and will not be improved or equipped
for such use, and further is of the opinion and .s.o finds. that the
City of Beaumont'is now the owner of other properties which are
suitable `for'such purposes and are ample for all future expansion
of :wharves and docks of the 'City: of Beaumont; and,
1-I` REAS, the City-Commission of the City of Beaumont
is of the opinion that it is to the best interest of-the City
of Beaumont that the above described property be abandoned..as a
site for wharves and docks for the City of Beaumont and be
abandoned as-,a site for improvements or equipment for such pur
pose;.
NO'rt,-THEREFORE, . BE IT ORDAINED by the City Commission
of the-City of Beaumont that the above described"tract be, and
it-is.hereby abandoned as a site for wharves and docks for the
City of Beaumont and as a site for improvements or equipment
-connected with such use.
