WHEREAS, a petition signed by all of the property owners of the lots in Block Twenty-nine (29) of the Ogden addition to the City of Beaumont has been presented to the City Commission of the City of Beaumont rearresting that the purported alley running through said Block Twenty-nine (29) of said Ogden Addition to the City of Beaumont be vacated and abandoned; and W EREAS, said purported alley has never been used as an alley and has at all times been used by the owners of the property in said Block Twenty-nine (29) as belonging to the lots located in said Block; m d, b7HEREAS, said petition has been referred to the City Planning Commission for examination and approval and the same has been approved by the said Commission; and, WHEREAS, said petition has been duly canvassed and examined by the City Commission of the City of Beaumont and has been found to have been sign,6d by all of the property owners in said Block, and it appearing to the City Commission that the request of said property owners should be granted and that an ordinance should be enacted vacating and abandoning said purport- ed alley; NOW, THEREFIORE, BE IT ORDAINED BY THE CITY COMMISSION �\ OF TIE CITY OF BEAUNONT That the purported alley running through Block Twenty- nine (29) of the Ogden Addition to the City of Beaumont, Texas, be and the same is hereby authorized to be vacated and abandoned, -M and that the title to such alley shall revert to and become the property of the owners of land in said Block bordering on said alley as provided by law. "Mr. Schaumburg presented for approval a petition from the property owners of Block 29 of the Ogden Addition to close the alley in this block. The alley has never been used and there are no utilities in the alley. Since VTeingarten's from Houston is planning to build a store that will cover most of the block the.City is requested to close the alley without reserving the usual utility easement. Everything being in order it was moved by Florence McCluskey, seconded by S. Perry Brown and unanimously carried that the Planning and Zoning Commission recommend to the City Commission -that the alley in Block 29 of the Ogden Addition be closed." hairman I.
