ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE.BOUNDARIES OF THE ZONING
DISTRICTS AS INDICATED UPON THE ZONING MAP OF
THE CITY OF BEAUMONT, TEXAS, BY CHANGING A
3.194 ACRE TRACT OF LAND OUT OF THE H. WILLIAMS
SURVEY IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS, AS HEREINAFTER DESCRIBED PRE-
SENTLY ZONED "R-2" TO "LR -1"; PROVIDING FOR
SEVERABILITY AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:

THAT Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in
particular the boundaries of the zoning districts as indicated upon the
Zoning Map of the City of Beaumont, referred to in Section 42-9 thereof,
is hereby amended by changing the zoning classification of the following
described tract of land, presently zoned "R-2", Two Family and Multiple
Dwelling, to "1R--1", Local Retail District, to wit:
BEING a 3.194 acre tract of land out of a.
17.414 acre tract located in the H. Williams
Survey, Abstract 56, Beaumont, Jefferson
County, Texas;
BEGINNING at an iron rod at the point of
intersection of the south right of way
line of Gladys Avenue and the east right
of way line of Major Drive, being the
northwest corner of the herein described
3.194 acre tract and being the northwest.
corner of the 17.414 acre tract and also
being the northwest corner of a 20..4 acre
tract formerly known as the Viola V. Stagg
tract as recorded in Volume 903, Page 477
of the Deed Records of Jefferson County,
Texas;
THENCE North 89°.57' 05" East along the
south right of way line of Gladys Avenue
and along the north line of the 17.414 acre
tract and along the north line of the 20.4
acre tract a distance of 345.0 feet to a
point for corner located in the centerline
of a 60.0 foot wide drainage right.of way;
THENCE South 381 26' 17" East along the
northeasterly line of the said 17.414 acre
tract and being the northeasterly line of
the 3.194 acre tract herein described, being
along the centerline of a 60.0 foot wide
drainage right of way as recorded in Volume
1650, Page 88 of the Deed Records of Jefferson
County, Texas, for a distance of 382.75 feet
to a point;

Section 1.

County, Texas, for a distance of 382.75 feet
to a point;

THENCE South.89° 57' 05" West along the south
line of the herein described 3.194 acre tract
a distance of 582.68 feet to a..point for the
southwest -corner of said 3.194 acre .tract, said
corner being located.in the east right of way
line of Major Drive, also being located in the
west line of the 17.414 acre tract;
THENCE North 000 02' 58" West along the west
line of the 17:414 acre tract and along the
east right of way line of Major Drive a distance
of 300.00 feet to the place of beginning, con-
taining in area 3.194 acres of land, more or
less.
SAID 3.194 acre tract being subject to a street
right of way dedication of 0.920 acres of land,
a 20.0 foot wide water line easement recorded
in Volume 1823, Page 483 of the Deed Records, a
60.0 foot wide Drainage District #6 right of.way
recorded in Volume 1650, Page 88 of the Deed
Records and to a Gulf States Utilities Company
guy anchor easement recorded in Volume 1789, Page
183 of the Deed Records of Jefferson County, Texas.
and the official Zoning Map of the City of Beaumont is hereby amended. to
reflect such changes.
Ser_tion 2.
That in all other respects the use of the property hereinabove
described shall be subject to all of the applicable regulations contained
in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted
August 19, 1958, as amended.
SPr_tson 3.
That the terms and provisions of this ordinance shall be deemed
to be severable, and that if the validity of the zoning affecting any
portion of the property described hereinafter shall be declared to be
invalid, the same shall not affect the validity of the zoning of the.
balance of the property described herein.
'Section 4.
That if any person or corporation violating any of the terms
and provisions of this ordinance shall. be subject to the same penalties
provided for in said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the
day of 1978.
