ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,
AND IN PARTICULAR THE BOUNDARIES OF THE
ZONING DISTRICTS AS INDICATED UPON THE ZONING
MAP OF THE CITY OF BEAUMONT, TEXAS, BY
CHANGING A 23.94 ACRE TRACT OF LAND OUT OF
THE W. B. DYCHES SURVEY, BEA3NY3NT, JEFFERSON
COUN'T'Y, TEXAS, AS HEREINAFTER DESCRIBED,
PRESENTLY ZONED "R-1" TO "C-2"; PROVIDING
FOR SEVERABILITY AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in
particular the boundaries of the zoning districts as indicated upon
the Zoning Map of the City of Beaumont, referred to in Section 42-9
thereof, is hereby amended by changing the zoning classification of
the following described tract of land, presently zoned "R-1", Single
Family Dwelling, to "C-2", Central Commercial, to wit:
BEING a 23.94 acre tract of land out
of the W. B. Dyches Survey, Abstract
17, Beaumont, Jefferson County, Texas,
described by metes and bounds as
follows:
BEGINNING at an iron rod which marks
the northeast corner of a tract of
land heretofore conveyed to the
Beaumont Theatres, Inc. recorded in
Volume 1527, Page 370, Deed Records,
Jefferson County, Texas, the said
beginning corner being in the east
line of that certain 108.75 acre tract
of land known as Tract No..2 and which
has a zoning classification of I-1
light industrial as described in File
No. 299-Z records of the City Planning
and Zoning Department of the City of
Beaumont, said beginning corner being
in the south right-of-way line of the
Gulf States Utility Canpany transmission
line right of way and in the north line
of the H. G. Nichols tract of land;
THENCE South 81°56'20" East along the
north line of the said Nichols tract and
the north line of the tract herein des-
cribed and the south line of the Gulf
States Utilities Company right of.way a
distance of 631.23' to a point for corner
in the center line of a drain ditch as
described in Case No. 591794, Deed Records,
Jefferson County, Texas;
THENCE South 05°18'57" East along the
center line of said drain ditch a
distance of 721.56' to an angle point;
THENCE continuing along the center
line of the said drain ditch South
O1011122" East a distance of 1383.66'
to an iron pin for corner in the
north line of -Suburban Acres, Unit 2,
plat of which is recorded in Volume 7,
Page 193, Map Records, Jefferson County,
Texas;
THENCE South 35°37'24" West along the
north line of said Suburban Acres, Unit
2, a distance of 380.71' to a point. for
corner at the southeast corner of the
aforementioned.Tract No. 2 which is the
108.75 acre tract rezoned I-1 in File
No. 299-Z;
THENCE North 11017105" East along the
east line.of the existing I-1 zoned
tract and along the east line of the
aforementioned Beaumont Theatres, Inc.,
Tract a distance of 2549.08' to the
place of beginning,
and the official Zoning Map of the City of Beaumont is hereby amended
to reflect such changes.
Section 2.
That in all other respects the use of the property herein-
above described shall be subject to all of the applicable regulations
contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas,
adopted August 19, 1958, as amended.
Section 3_
That the terns and provisions of this ordinance shall be
deemed to be severable, and that if the validity of the zoning affecting
any portion of the property described hereinafter.shall be declared to
be invalid, the same shall not affect the validity of the zoning of
the balance of the property described herein.
Section 4_
That if any person or corporation violating any of the terms
and provisions of this ordinance shall be subject to the same penalties
provided for in said Chapter 42 of the Code of Ordinances of Beaumont,
Texas.
