ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICT'S AS INDICATED UPON THE ZONING MP. -OF
THE CITY OF BEAUNDNT, TEXAS, BY CHANGING A
3.27 ACRE TRACT OF LAND OUT OF THE A. WILLIAMS
SURVEY, FRENCH HEIGHTS ADDITION, BEAUMONT,
JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DES-
CRIBED, PRESENTLY ZONED "R-2" TO "LR -1"; PRO-
VIDIDNG FOR SEVERABILITY AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEA-UM)NT:
Section 1.
THAT Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in
particular the boundaries of the zoning districts as indicated upon the
Zoning Map of the City of Beaumont, referred to in Section 42-9 thereof,
is hereby amended by changing the zoning classification of the following
described tract of land, presently zoned "R-21', Two Family and Multiple
Dwelling, to "LR -1", Local Retail District, to wit:
Tract 1
A part of the A. Williams Survey ]mown and
designated as a part of the South half of
Tract No. Forty (40) of the French Heights
Addition to the City of Beaumont, Jefferson
County, Texas, described by metes and bounds
as follows:
BEGINNING at an iron stake on the South
boundary line of the Hobby Highway, where
it intersects the east line of Haden Avenue,
in French Heights Subdivision, said stake
being the northwest corner of Tract No. Thirty -
Three (33) of said French Heights;
THENCE South 38 deg. 45 min. west 573.7 feet
to an"iron stake in the east boundary line of
said Tract No. 33 French Heights;
THENCE South 0 deg. 45 min. west 58.5 feet to
an iron stake said.stake being the southwest
corner of Tract No. 33 French Heights, and the
northwest corner of Tract No. 40, French
Heights;
THENCE continuing along the east boundary line
of Haden Avenue South 0 deg. 45 min. west a
distance of 235.7 feet to a stake for the Point
of Beginning of the land herein conveyed.
THENCE continuing South 0 deg. 45 min. west
along the east boundary line of Haden Avenue
a distance of 89.7 feet to an iron stake for
corner;
THENCE North 88 deg. 0 min. East a distance of
217.7 feet to stake for corner, said stake
being in the Southeast boundary line of said
Tract No. 40;
THENCE North 38 deg. 45 min. East, a distance
of 107.4 feet to stake for corner, said stake
being the northeast corner of said Tract No.
40;
THENCE North 89 deg. 45 min. West a distance
of 286 feet to the Place of Beginning con-
taining one-half acre, more or less.
Tract 2
BEING a part of the Absalam Williams Survey,
and being all of Lot No. 35' of the French
Heights Addition to the City of Beaumont
Jefferson County, Texas, as shown on the map
or plat of said addition of record in Volume
6, page 61, of the Map Records of Jefferson
County, Texas, and being the same land conveyed
to P. A. Winkler and wife, Minnie Lee Winkler,
by J. S. Edwards, et al, by deed dated April
1, 1926, and recorded in Vol. 289, Page 129, of
the Deed Records of Jefferson County, Texas,
which property is described by metes and bounds
in said deed as follows:
BEGINNING at an iron stake in the Southwest
line of the. Beaumont Voth Highway, 1402 ft.
South 51 deg. 15 min. East of its intersection
with the West line of the A. Williams Survey,
said beginning corner being the Northwest
corner of Lot No. 35 and the Northeast corner
of Lot No..34 French Heights;
THENCE South 39 deg. 45 min. West 610.7 feet to
an iron stake for corner, said corner being the
Northeast corner of Lot No. 40, and the South-
west corner of Lot No. 35, French Heights;
THENCE South 51 deg. East 200 feet to an iron
stake for corner said corner being the South-
east corner of Lot No. 35, and the Southwest
corner of Lot No. 36;
THENCE North 38 deg. 45 min. East 598.2 feet
to aniron stake in the South line of the
Beaumont-Voth Road, said iron stake being the
Northeast corner of Lot 35, and the Northwest
corner of Lot 36;
THENCE North 47 deg. 35 min. West 200 feet to
the place of beginning, containing 2.77 acres
of land more or less.
and the official Zoning Map of the City of Beaumont is hereby amended
to reflect such changes.

That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 42 of the Code of Ordinances
of Beaumont, Texas adopted August 19, 1958, as amended.
That the terms and provisions of this ordinance shall
be deemed to be severable, and that if the validity of the zoning
affecting any portion of the property described hereinafter shall
be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the property described herein.
Section .4.
That if any person or corporation violating any of the
terms and provisions of this ordinance shall be subject to the same
penalties provided for in said Chapter 42 of the Code of Ordinances
of Beaumont, Texas.
