AN ORDI11"ANCE Entitled .an Ordinance fixing and establishing 'the�.. limits and extent of the Harbor or Port of B Texas, pLoescxibing rules and.regulations fo j7 .government of. the harbor, inunicip,al wharves docks and She'ds-'prascribing raids and charges for wharfage, 'dockage and till "other. services and.facili- ties - furnished in said Port or at said municipal docks, wharves and .sheds;. 'xescribing a penalty for the violation of any - of, said -rules, and regu- lations, and declaring an emergency. - BE IT ORDAINED 'BY THE CITY COUNCIL OF THE CITY OF BEAUMO17T: Section:..l.. That the harbor of'_ the City of Beaumont, Texas shall cover all of the waters of the -Neches River from.bank to' bank on both sides -from -the month of the old river at the up _') e 'T and of Smith's Island up .,to_the Reliance Canal or, ditch including Br Ake" s Bayou of a distance of miles- Section 2. - That the term Municipal dock or wharf as used herein embraces every Stfuctur6 owned by' the City of Beaumont to wtrich-'v essels, make'f ast or on Al ch merchandise is discharg- ed or from which -it Is loaded. Section 3. 3.-, That no',piles shall be driveA nor shall Lny plat— form be, erected nor shall any 'filling in, .or construction repairs, alteratibns,,removals, dredging or demolition of any kind be made on any part of the water front of the city, without a written permit' therefor being first had.. obtained from -the Wharf and Dock Commissioners. Section 4. Section 16. LITAITATION AS TO FIRE. It shall be unlawful for any person to smoke, carry, or have, lighted, matches, pipe, cigar or cigarette, or carry or use any portable open light in or upon any munici- pal dock. Section 17. The City of Rpalueont is not liable for dariages to; - or loss of mexchanc?ise in transit while on a municipal dock or wharf but the commission will employ watchmen and exercise dine diligence in the protection of sucli merchandise, when requested to do so, tat actual cost, 'n;itil such time as the charges are fixed by printncl tarritf. Section 18. EXPLOSIVES. No gun powder or other explosive shall be discharged on or loaded from any municipal dock or wharf of the City of Beaumont,on or from any vessel in the Port of Beaumont except by permission of the Wharf and Dock Commission, and when permitted must be immediately removed. a Seotion 19.
