BE IT ORDAINED. BY THE CITY- C 0UNCIL-.:,OF THE CITY OF BEAUMONT I
J2PPERSON COUNTY, TEXAS,:
Section 1. That. -the Texarkana & Fort Smith Railway Com-
pany is"_hereby granted. the .right and privilege to lay, maintain and
operate a `certain standard -,gauge railroad track to break out" of the
Texarkana & F.ort Smith Railway Cbmpany's.-main track in Washington
'Street ; in Beaumont , Teaws , ata`'point Fifty-five (55) f eet . more or
less northeasterly from the -northwesterly line of the ,Original Town
- of Beaumont.-. and ext ending thence. in a .southwesterly .direction over
andaleng said -Washington. Street to a point in the southeasterly line
of the southwest half of. ,Block four (4) in said Old Town of Beaumont
thence s otzthwesterly across the e outheas terly side . of said ' Blook
four (4) and across Main Street at a point Five (5) feet more or
less northwesterly from . the northwesterly line of . Washington Street
as said track is*, indicated by broken red line on the attached blue
-print 'marked Exhibit .-"A"..
Section 2. Said- track shall be placed: at grade with the
streets upon which it is constructed and shall be, constructed and
maintained in such a manner'' as riot ' t o interfere with the free use of
said streets by "the" public:
Section 3. The space between the- rails of said track and
for a distance of - eighteen (18) inches on either side of said track
shall be filled with gravel, cinders, sand or planks, as may. be
required by the city engineer of Beaumont, so as to bring said track
to a level with said streets.

An ordinance as introduced in the City Council of
Beaumont, granting "to us permission to construct a track to
serve Heisig & Norvell and Mr. Broussard's building at that
point, was changed before its passage and an ordinance sub-
stituted which we could not follow, owing to the layout of the
ground. The ordinance as finally passed had the track parallel
with the property line of the City property at corner of Hain
& 7Tashington Streets, which it ryas impossible to follow, owing
to the fact that the track would encroach upon property
"immediately north of the City property.
We have had new ordinance and blueprint prepared,
which I enclose, showing a track which we could construct, and
which practically parallels the entire east frontage of the
City property, and which, for all practical purposes, will
answer.
I would be glad to have you introduce this ordinance
for passage at the earliest date possible.
