ORDINANCE NO.
ENTITLED AN ORDINANCE VACATING AND ABANDONING
A PORTION OF DOWLEN ROAD BETWEEN FOLSOM ROAD
AND THE PROPOSED DOWLEN ROAD CUT-OFF IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS
DESCRIBED HEREIN; PROVIDING THAT SAID ABANDON-
MENT SHALL BE EFFECTIVE UPON THE COMPLETION OF
NEW DOWLEN ROAD TO BE SUBSTITUTED THEREFORE;
AND SUSPENDING SUBSECTION 42-5(7), TO THE EX-
TENT IT MAY BE IN CONFLICT HEREWITH, UNTIL TBE
PASSAGE OF THIS ORDINANCE BEM ES EFFECTIVE.

WHEREAS, Amoco Production Company, being the -only abutting property owner
of the portion of Dowlen Road between Folsom Road and the proposed Dowlen Road
cut-off, as more particularly described herein, has requested that said portion
of Dowlen Road be vacated and abandoned; and,
WHEREAS, Amoco Production Company has donated to The City of Beaumont con-
siderable land for the construction of the new Dowlen Road, as well as drainage
easements therefore, said land donated by Amoco Production Company being in excess
of that portion of Dowlen Road herein vacated and abandoned; and,
Ute, it appears to the City Council, and the City Council so finds,
that upon completion of the proposed Dowlen Road in accordance with the plans and
specifications approved by the City Council, there will no longer be any public
necessity for that portion of Dowlen Road herein vacated and abandoned to be kept
open; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF BEAUMONT:,
Section 1.
THAT the following -described portion of Dowleri Road in The City of Beau
mont, Texas, be vacated and abandoned upon completion of the proposed Dowlen Road
cut-off in accordance with plans and specifications heretofore approved, and that
upon such completion of the proposed Dowlen Road cut-off, title to said'portion of
the hereinafter -described street shall revert to and become the property of the,
person entitled thereto, as provided by law, said portion of said Dowlen Read be-
ing described as follows:
BEING 2.68 acres of land out of the A. Duwe Survey,
Abstract No. 459 in. Jefferson County, Texas, and be-
ing out of that certain 364.7 -acre tract of land de-
scribed as the First Tract in the Deed dated February
13; 1933, from Treadaway Land Company, et al to Yount -
Lee Oil Company recorded in Volume 374, Page 113 of

the Deed Records of Jefferson County, Texas; the
said 2.68 acres being a portion of the existing
Dowlen Road in the City of Beaumont, Texas, ex-
tending from Folsum Road to the proposed Dowlen
Road cut-off and is more particularly described
as follows:
BEGINNING at a 1" bronze rod at the occupied
.Southwest corner of the above-described 364.7
acre First.Tract, at the Southwest corner of the
said A. Duwe Survey and at the Southeast corner
of the W. B. Dyches Survey, Abstract No. 17;
said rod being at the intersection of a Westerly
projection of the South line of Folsum Road -with
the West line of Dowlen Road;
THENCE North 3° 02' 15" West with.the West line of
the existing Dowlen Road for a distance of 2376.59
feet to the'point of tangency of a curve in the
Southwest line of the proposed Dowlen Road cut-off;,.
said curve having a central angle of 57° 541 13",
and a radius of 778.52 feet;
THENCE Southeasterly with said curve in said pro-
posed right-of-way for a distance of 30.7.35 feet
to its intersection with the East right-of-way line
of Dowlen Road C6Q feet wide);
THENCE South 3' 02:::`15" East with the East right-
of-way line of,Dowlen Road for a distance of 1448.98
feet to an intersection with a curve in the West
right-of-way line of a proposed relocation of Dowlen
Road; said curve having a central angle of 321 37'
11" and a radius of 2096.72 feet;
THENCE Southwesterly with.said curve a distance of
354.74 feet to its point of curvature;
THENCE South 30 331 39'" East with'the West line of
the proposed relocation of Dowlen Road a distance
of 275.19 feet to its intersection with the South
line of the above-described 364.7 acre -First Tract
and with a Westerly extension of the South line of
Folsu-n Road;
THENCE South 87° 26° 43" West with said line a dis-
tance.of 35.78 feet to the PLACE OF BEGINNING, and
containing 2.68 acres of land.
All bearings and distances are grid bearings and
distances based on the Texas Plane Coordinate System
for the South Central Zone.
It is the intent of the City Council that the hereinbefore -described por-
tion of Dowlen Road shall be vacated and abandoned upon completion of the proposed
Dowlen Road cut-off, but not sooner.

THAT to the extent Subsection 42-5071 of the Code of Ordinances of The City
of Beaumont may be.in conflict with the passage of this ordinance without a recan-

mandation from the Planning ,and. Zoning C mmssion, said Subsection 42-5(7) is
suspended until the passage of this ordinance becomes effective, under law.
