ENTITLED AN ORDINANCE A , ING CHAP'T'ER 42 OF THE CODE OF ORDINANCES OF BEAU ONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAi11ONT,-TEXAS, BY CHANGING A 12.1368 ACRE TRACT OF LAND OUT OF' THE A. HUSTON LEAGUE, ABSTRACT 33, JEFFERSON COUNTY, TEXAS, AS HEREINATER DESC.RIBED,.PRE- SE=Y ZONED "R--1", TO "R-2"; PROVIDING FOR SEVERABILITY; AND PROVIDING A 'PFNAALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42-9 thereof, is hereby amen- ded by changing the zoning classification of the following, described tract of land, presently zoned "R-1", Single -Family Dwelling District,,to "R-2", Two - Family and Multiple -Dwelling District, to wit: BEING a 12.1368 acre tract of land out of the A. Huston League, Abstract 33, Jefferson County, Texas. ALL THAT.CERTAIN tract or parcel of land being out'of Tract One of that certain 40Q_acre tract, mre or less, described in deed from Hugh Long, and wife, Alice Long, to M. F. Yount dated April 5, 1929, and recorded in Volume 321; Page 460 -of the Deed Records of Jefferson County, Texas, said 30.783 acre tract or parcel of land being more fully bounded and described as follows: BEGINNING at the point of intersection of the north line of Manion Drive with the west line of Major Drive for the.southeast corner of the here- in described tract or parcel of land, said begin- ning corner being located Northzero degrees two minutes fifty-eight seconds West .(N 0-0° 02' 58" W), a distance of one thousand two hundred eleven and fourteen hundredths feet (1211.14') from a 1-1/2" iron pipe which marks -the most southeast corner of said 400acre tract; THENCE with the south line of the herein described. tract and the north line of Manion Drive-, South ei- ghty-nine degres fifty-nine minutes zero seconds West (S 890 5911-60" W) for a distance of four hun- dred and zero hundredths feet (400.00.') to a point for the southwest corner of the herein described tract; THENCE North zero degrees two minutes fifty-eight seconds West (N 00° 02' 58" W) for'.a distance of /�)_ '74 _/ 3, //- J3 - 76 .9-7 one thousand three hundred eighty-six and sixty- six hundredths feet (1',386.661) to a point for corner in the centerof.a drainage ditch; THENCE with the center of said. drainage ditch the follaeing.courses: South':87 degrees 33 minutes.38 seconds East 96.856 .feet. ..South 64 degrees 06 minutes 38 seconds East-237.90 feet South 44.degrees 04 minutes.38.seconds East 128.49 _feet to a point in the west line of Major Drive.for the north- east corner of the herein described tract; THENCE with the east line of the herein described tract and the west.line of Dlajor Drive, said line- being"_parallel to and .four hundred and zero hun- dredths feet (400.00') distant.from the west line of the herein described. tract, South zero degrees two minutes fifty-eight seconds East (S-001 02' 58" E)-for a distance of:one thousand one hundred eighty-six and.twenty-three hundredths feet (1186.231) to the PLACE OF BEGINNING; C NTAINING IN "AREA 12.1368 acres of land, irore. or - less", and the official Zoning Map of_"The City of Beaumont is hereby amended to re- flect such changes.'. " Section 2. That in all other respects the,use of the property hereinabove described shall be subject to all of the.applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted'August 19,"1958, as amended. Section 3. That the terms-and provisions'of".this ordinance shall be deemed to be severable, and that.if the validity of-.the zoning affecting any portion of the pror-erty.described hereinabove'shall be.declared to be invalid, the same shall not affect the validity of the zoning,of the balance of the"property described herein. Section 4.. 'That any person or corporation violating any of.the terms and provisions of this ordinance shall be subject to the same penalties provided for in said.
