ENTITLED AN ORDINANCE CORRECTING ORDINANCE NO. 0-76-8,
VACATING AND ABANDONING A 60' X 350' PORTION OF 17TH
STREET, IN THE VAN WORMER 2ND ADDITION IN BEAUMONT,
JEFFERSCN COUNTY, TEXAS, AS DESCRIBED HEREIN, PROVID-
ING THAT SUCH PORTION OF THE STREET RIGHT OF WAY BE
RETAINED AS A GENERAL UTILITY EASEMENT.
WHEREAS, by 'Ordinance No. 0-76-8, passed by the City Council on the
20th day of January, 1976, The City of Beaumont abandoned a 60' X 350' right
of way incorrectly described in said ordinance as an "alley easement"; and,
WHEREAS, said "alley easement", as described in Ordinance No. 0-76-8,
should have been identified as a "street right of way"; and,
WHEREAS, in order to correct said error of Ordinance No. Q--76-8,
BE IT ORDA.I•NED BY THE CITY OF BEAUMONT :
THAT that certain 60' X 350' right of way described as follows:
BEING a sixty foot (60') by three hundred fifty
foot (350') wide right of way on 17th Street south
of Cedar Street, said portion of 17th Street lying
between Blocks 18 & 19 of the Van Wormer 2nd Addi-
tion to The City of Beaumont, Jefferson County,
Texas,.as per map or plat of said Addition filed
of Record in the Deed Records of Jefferson County,
Texas;
be, and the same is hereby vacated and abandoned, and that title to such pro-
perty shall revert,to and become the property of the persons entitled thereto,
as provided by law; providing, however, that the hereinabove described tract
of land is expressly retained by The City of, Beaumont for general utility pur-
poses only, it being the intent of this ordinance to -abandon said tract of land
as an alley but to retain the said tract for general utility purposes only;
title to such property, other than the rights retained by The City of Beaumont
herein, shall revert to and become the property of the persons entitled thereto,
as provided by law.
