ENTITLID AN ORDINANCE AMENDING CHAPTER 15 AMENDING THE DEFINITION OF TRASH; CHANGING THE RULES AND REGULATIONS CONCERNING THE COLLECTION DISPOSAL OF GARBAGE AND TRASH; SETTING RATES FOR COLLECTION AND DISPOSAL.OF GARBAGE AND TRASH; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING FOR PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: That Chapter 15, Section 15-1(b) of the Code of Ordinances of the City of Beaumont, be, and the same is hereby amended to read as follows: Sec. 15-1. Definitions. (b) Trash. The term "trash" shall mean rubbish, such as feathers, tin cans, paper, rags, boxes, glass, grass, yard cleanings, grass clippings, leaves, and tree trinm ngs. ^--_- ___ That Chapter 15, Section 15-4 of the Code of Ordinances of the City of Beaumont, be, and the same is hereby amended to add a new paragraph 15-4.(c) to read as follows: Sec. 15-4. Garbage containers required; specifications (c) Such containers shall not weigh over twenty (20) pounds or have a gross weight in excess of.eighty (80) pounds when full. Section 3. That Chapter 15, Section 15-5 of the Code of Ordinances of the City of Beaumont, be, and the same is hereby amended by adding two new paragraphs, 15-5(e) and (f) to read as follows: Sec. 15-5. Requirements for trash placement; container specifications (e) All tree trunks and limbs shall be stacked parallel to each other. (f) Every nursery man, tree surgeon and every other person who cuts or trims trees, shrubs, or grass as an inde- pendent contractor, shall remove or e - 76 _11s" /e) 76 6s, -76--li;S" cause to be removed all trash from premises services by him. Such removal will require a hauling permit as described in Section 15-25. Section 4. That Chapter 15, Section 15-9(b) of the Code of Ordinances of the City of Beaumont be, and the same is hereby amended to read as follows: Sec. 15-9. City Landfill - Entrance to (b) Vehicles operated by persons hauling from within the city limits and presenting a city inspection permit as described in section 15-25 and who pays the fees set forth in that section. Such permit shall be issued by the Sanitation Department. Garbage, brush, waste, refuse or any other material from outside the city limits shall not be accepted unless approved by the sanitation superintendent. The rates for this material will be set by the superintendent of the Sanitation Department. That Chapter 15, Section 15-11 of the Code of Ordinances of the City of Beaumont, be, and the same is hereby amended by adding new:: subsections 15-11(f), (g), (h) and (i) to read as follows: Sec. 15-11. Same - Material not accepted. (f) Stumps with trunks over 6" in diameter. (g) Logs over 4 feet in length. (h) Industrial chemicals or industrial solid waste. (i) Waste oil or grease. -2- That Chapter 15 of the Code of Ordinances of the City of Beaumont, be, and the same is hereby amended by adding a new Section 15-12 to read as follows: Sec. -15-12. Hauling of garbage, trash, waste or refuse on city streets. It shall be unlawful for any citizen, commercial establishment or private hauler to haul garbage, trash, waste or refuse on city streets without proper equipment for this purpose. No vehicle will be used for transporting this type of material unless it is equipped with: (a) Adequate side board and tail gate as described in Section 15-27. (b) Completely covered with a tarp if side boards cannot be constructed. That Chapter 15, Section 15-16(2) of the Cade of Ordinances of the City of Beaumont, be, and the same is hereby: -amended to read as follows: Sec. 15-16. Collection and removal by the Sanitation Department - Charges for residential premises. (2) No rate adjustments will be made for temporary non-use of service unless the water meter is disconnected. Non- payment of the garbage collection fee shall be sufficient grounds for discontinuance of city water service. The rate for collection outside the city limits shall be the rates set forth in this section plus 25% of the rate in this section. No type of service will be offered residences that are residences described in paragraph (1) above or for vacant lots. Fair and reasonable charges for such residential service shall be, and are shown in terms of dollars and cents for a calendar month as follows: (a) Single family residence, $4.50 (b) Duplex apartment building, $4.50 (c) Garage apartment.unit, $4.50 -3- (d) Two (2) family units on one meter, $900- (e) Group housing (three or more houses, mobile homes, or goverrnnental housing units, on the same water meter, or condominium or multiple family apartment buildings with three (3) or more units): (e-1) Where all containers -:are placed in the same location the charge for each house, mobile home, unit or apartment shall be $4.25. (e-2) Where all containers are not centrally located the charge for each house, mobile home, unit, or apartment shall be $4.50. 'That Chapter 15, Section 15-17(2)(a), (b), (c) & (d) are hereby amended to read as follows: Sec. 15-17.. Same - Charges for public,business and commercial premises (2) The rates set out in the followingg schedule are monthly charges for sanitation service: (a) Group A. Auto supply stores, -bakeries, beer tavern; bottling -plants; cafeterias; candy stores; cigar stores; clinics; creameries; drive-in cafes; drugstores and pharmacies; drygoods and department stares; grocery stores; hospitals; hotels; ice cream parlors; meat and fish markets; motels; news- stands; novelty stores; poultry houses; printing firms; restaurants; rooming houses; slaughter and meat packing houses; sporting goods stores; variety stores; veterinary hospitals; colleges; multi -story office buildings; drive-in grocery stores; manu- facturers of all types; and any like or similar business not specifically listed in this group, or Group B, -C, and D: -4- Square feet of business 3 or less pickups 4 or more pickups, activity per week per week 0- 1,000. $ 10.00 $ 15.00 1,001- 2,500 15.00 20.00 2,501- 5,000 20.00 30.00 5,001-10,000 30.00 65.00 over 10,000 65.00 100.00 (b) Group B. Same - Charges for public, business and commercial premises (3) No rate adjustments will be made for temporary non-use of service unless the water meter is disconnected. Nonpayment of the garbage fee will be sufficient grounds for discontinuance of City water and sewer serving the location. Service outside the city limits shall be the rates set forth in this section plus 250. (4) The twice and/or four time/week collection for commercial establishments is the only service provided other than covered below in Section 15-18. The monthly trash schedule offered residential customers does not apply to commercial customers. ME ll�id �6-iis la 5,�97G (5) It shall be unlawful for._any person other than a hauler holding a valid permit under section 15-29 of this chapter to transport commercial garbage from one location to another or to a residence. Section 10. That Chapter 15, Section 15-18 be, and the same is hereby amended to read as follows: Sec. 15-18. Charges when accumulation exceeds eight yards per day. Where the garbage and trash which accumulates on the premises of an establishment, listed in the schedule above, generally exceeds eight yards per day, the monthly rate charged such establishment shall be the applicable rate listed in the schedule plus $70.00 for each additional bobtail load per day required to remove the garbage and trash from such establishment. Special collections can be requested at the rate of $70.00 per bobtail load when the sanitation department has the available equipment. cam.+-; r,,, I i That Chapter 15, Section 15-20(a), (b).& (c), be, and the same is hereby amended to read as follows: (a) Public, business and commercial institutions will receive sanitation container system service for the removal of trash and garbage under the rates and rules hereinafter set forth, as routes for such service are established by the City. All institutions on hand service will be re- quired.to change to container service when they are of sufficient size, have a proper location, and containers are available by the sanitation department. If the institution is not agreeable they have the option of: (1) having a private hauler with a valid permit; (2) taking out a hauling permit and hauling their own garbage. Under the sanitation container system service, the City of Beaumont will furnish a container or containers to be used in the collection and removal of trash and garbage. The rate for additional containers will not apply to containers close together but serving different public business or commercial institutions. (c) When the container smallest in size will adequately and completely serve several adjacent business institutions, then they may be required to use the same container and pay a pro rata part of the charge, Bete mined according to the approximate quantity of space used. The minimum charge for each customer when a container is shared is eight ($8.00) dollars, but in no case shall total charge be less than same container serving one customer. The container service will be the complete service for all trash and garbage on the premises. ^--1--__ , � That Chapter 15, Section 15-22 of the Code of Ordinances of the City of Beaumont.be, and the same is hereby amended to read as follows: Sec. 15-22. Owner's duty to remove - Material not collected by Sanitation Department Collection of items such as brick, broken concrete, lumber, dirt, plaster, sand, gravel, automobile parts, scrap metal, wire, remodeling material, old appliances, ashes, -old furniture, dead animals, construction material, stems, tree trunks, and other bulky or heavy materials shall not be included in the regular collection service furnished by the sanitation department. No material or containers weighing over 50 pounds will be collected. The owner shall have such debris removed at his own expense. That Chapter 15, Section 15-28 of the Code of Ordinances of the City of Beaumont, be, and the same is hereby amended to read as follows: Sec. 15-28. (g) If applicant has more than one truck, but only one truck will be used in a twenty-four (24) hour period for hauling to the City landfill then only one permit is necessary. Method of payment shall be: (1) Up to $500 will be annual payment; (2) $500 to $3000 may be annual or semi-annual; (3) over $3000 may be annual or monthly. Out-of-town contractors and local businesses who need to dump material on a one-time basis and only during one calendar month shall be allowed a one month permit at the rate of 1/12 the annual fee for the class his vehicle comes under. Regular commercial customers will be required to have a dumping permit for all waste dumped at the city landfill in excess of 8 cubic yards per month. All permits other than the above exceptions shall be issued for annual periods only, expiring on the thirty-first (31st) day of December of each year, providing that permits may be issued for fractional parts of any year during which application is filed. All persons or businesses hauling into the city landfill shall deposit such material only in the place designated by the landfill foreman. Such dumping shall only be during the hours of operation as set forth by the solid waste superintendent. All haulers who haul on city streets but use a disposal site other than the City of Beaumont's will be required to have his vehicle inspected annually for com- pliance with all sections of this ordinance. An inspection fee of $10.00 per truck will be charged and the application as set forth in Section 15-24 will be required. This ordinance shall be effective for billings commencing October 6., 1976. e,...+.; -- i r - That if any section, subsection, sentence, clause or phrase of this ordinance,. or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, .such invalidity shall in no wise affect. the remaining ng portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. All ordinances or parts of ordinances in conflict herewith are hereby repealed. -12- -74 r Section 17.
