ENTITLED AN ORDINANCE FOR THE ISSUANCE OF
A SPECIFIC USE PERMIT FOR CLUSTER HOUSING
DEVELOPMENT FOR A 7.59 ACRE TRACT HEREIN
DESCRIBED IN ACCORDANCE WITH A PLAN FOR
DEVELOPMENT; PROVIDING FOR THE FILING OF
A DECLARATION COVERING THE 7.59 ACRE TRACT.
WHEREAS, on May 17, 1976, the Planning & Zoning Commis-
sion of The City of Beaumont recommended the issuance of a spe-
cific use permit for cluster housing development to George Dish -
man, Jr., and his heirs, representatives, successors, and assigns
for that certain 7.59 acre tract of land hereinafter described;
and,
WHEREAS, the City Council is of the opinion that the is-
suance of such specific use permit is in the best interest of The
City of Beaumont and its citizenry, subject to the hereinafter de-
scribed conditions; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF=BEAUMONT:
Section 1.
That a specific use permit for cluster housing development
in accordance with Section 42-20.1 and Section 42-20.4, as amended,
be granted to'George Dishman, Jr., and to his heirs, legal repre-
sentatives, successors,and assigns for that certain 7.59 acre tract
of land, more particularly described as follows:
THAT certain tract of land described as
being 7.59 acres, more or less, for the
proposed Summerwood Subdivision Section
II; Beaumont, Texas; said 7.59 acres be-
ing out of a 202.932 acre tract of land
described in a deed from J. B. and H. A.
Hooks to the Yount -Lee Oil Company, re-
corded in Volume 365, Page 406, Jefferson
County Deed Records; said 7.59 acres be-
ing within the Hezekiah Williams Survey,
Abstract No. 56, Beaumont, Jefferson Coun-
ty, Texas, and more particularly described
as follows: .
COY24ENCING at the Northwest corner of Lot
6, Block 1, of the Thomas Road Addition
to the City of Beaumont and on the South
line of Delaware Street, an eighty (801)
foot wide right-of-way;

THENCE South 860 51' 39" West along the
said South line of Delaware Street, a dis-
tance of 328.47 feet to the POINT OF BE-
GINNING and northeast corner for the 7.59
acres; said POINT also being the northwest
corner of the -proposed Summerwood Subdivi-
sion Section One;
THENCE South 30 0-8' 21" East along the pro-
posed west line of said Summerwood Section
One, a distance of 444.55 feet to a point
for the southeast corner of the 7.59 acres;
said point being the southwest corner of
the said proposed Summerwood Section One
and being on the north line of B1ock.Six of
the said Thomas Road -Addition;
THENCE South 860 50-' 41" West along the
said north line of Block Six of Thomas Road
Addition, a distance of 477.0.4 feet to a
point for corner;
THENCE South 30 18' 16" West along the said
north line of Block Six of Thomas Road Addi-
tion, a distance of 160.00 feet to a point
for corner;
THENCE South 861 53' 08" West along the said
north line of Block Six of Thomas Road Addi-
tion, a distance of 80.00 feet to a point
for corner;
THENCE North 30 06' 52" West, a distance of
150.00 feet to a point for corner;
THENCE North 450 00' 00" West, a distance
of 25.00 feet to a point for corner;
THENCE South 860 53' 08" West, a distance
of 120.00 feet to a point for corner; ,
THENCE North 30 48' 21" West, parallel to
the east line of the 7.59 acres, a distance
of 394.15 feet to a point for corner;
THENCE North 60 51' 39" East,,a distance of
21.Q0 feet to a point for corner;
THENCE North 760 51' 39" East, a distance of
55.QQ feet to a point for corner;
THENCE North 30 08' 21" West, a distance of
10.QQ feet to a point for corner on the said
south line of Delaware Street;
THENCE North 860 51' 39" East along the said
south line of Delaware Street a distance of
650.00 feet to the POINT OF BEGINNING, and
containing 7.59 acres, more or less.

That this specific use permit herein granted is expressly

issued for and in accordance with that certain plan of development
for Summerwood Addition, Section II, Beaumont, Texas, dated April
20, 1976, which plan of development is attached hereto as "Exhibit
A" and made a part hereof for all purposes® Also attached hereto
as "Exhibit B" is that certain "Declaration of Covenants, Condi-
tions and Restrictions', Summerwood Addition, Section II", which
"Exhibit B" is made a part of this specific use permit as fully
and completely as though copied verbatim herein.

As a condition to the issuance of this permit, permittee
shall file in the appropriate records of the County Clerk of Jef-
ferson County, Texas, a copy of said "Exhibit B" prior to the is-
suance of a Certificate of Occupancy by The City of Beaumont for
any residential unit within the 7.59 acre tract of land herein-
above described in Section 1. Further, this permit is expressly
issued subject to compliance with, all appropriate revisions of
the Code of Ordinances of The City of Beaumont.
