Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on March 5, 2019, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1-4/Consent Agenda * Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Torrey Doucette with New Birth Community Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Jordan, Getz, Sam, Pate and Samuel. Public Comment: Persons may speak on scheduled agenda items 1-4/Consent Agenda None Minutes — March 5, 2019 CONSENT AGENDA Approval of minutes — February 26, 2019 Confirmation of committee appointments — None A) Authorize the City Manager to accept maintenance and authorize a final payment to Jack Built, of Orange for the Painting of the Tyrrell Historical Library Ceiling — Resolution 19-047 B) Authorize the City Manager to execute a Joint Election Agreement between Jefferson County and the City of Beaumont for the General Election being held jointly with the Port of Beaumont and Beaumont Independent School District for the May 4, 2019 General Election — Resolution 19-048 C) Approve a resolution granting authority to certain employees to approve and initiate electronic funds (wires) or ACH transfers of any and all City funds on deposit at Wells Fargo Bank, NA — Resolution 19-049 D) Approve amending a resolution authorizing the granting of four Utility Crossing Agreements with ExxonMobil Oil Corporation — Resolution 19-050 Mayor Pro Tem Mouton moved to approve the Consent Agenda. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider amending Ordinance 19-005 to add and approve designating polling places, appointing election officials and appointments to the newly formed Signature Verification Committee for the May 4, 2019, City of Beaumont General Joint Election with the Beaumont Independent School District and the Port of Beaumont. Council approved Ordinance 19-005 on January 22, 2019, to call the May 4, 2019, City of Beaumont General Joint Election to order. The proposed amendment is to add and approve designated polling places, appoint election officials and appoint members to the newly formed Signature Verification Committee. The Jefferson County Clerk will be responsible for all other aspects of the election as the Early Voting Clerk. Approval of the Ordinance. Councilmember Samuel moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 19-005 FOR THE PURPOSE OF CHANGING CERTAIN RESPONSIBILITIES OF THE CITY CLERK IN THE CONDUCTING OF THE MAY 4, 2019, GENERAL ELECTION, DESIGNATING ELECTION DAY POLLING LOCATIONS; PROVIDING FOR THE APPOINTMENT OF THE SIGNATURE VERIFICATION Minutes — March 5, 2019 COMMITTEE MEMBERS; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. Consider authorizing the City Manager to execute a contract with PM Construction & Rehab, LLC, dba IPR South Central, of Pasadena, Texas for a Pipe Bursting Contract. The contract will be used to rehabilitate sewer lines by the pipe bursting method and to replace defective manholes. On February 21, 2019, three (3) bids were received for furnishing all labor, materials, equipment, and supplies for the project. A total of 365 calendar days are allocated for completion of the project Funds will come from the Capital Project Program. Approval of the resolution. Councilmember Samuel moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO PM CONSTRUCTION & REHAB, LLC, DBA IPR SOUTH CENTRAL, OF PASADENA, TEXAS, IN THE AMOUNT OF $1,812,920.00, FOR THE PIPE BURSTING WORK ORDER CONTRACT -PHASE II PROJECT. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE Minutes — March 5, 2019 MOTION PASSED Resolution 19-051 3.. Consider authorizing the City Manager to execute a contract with BCAC Underground, LLC, of Rosharon, Texas for the Long Street Lift Station Wet Well and influent/effluent Sewer Line Cleaning and Televising Contract. The Long Lift Station, located at 940 Long Street, is one of thirteen major lift stations within the City limits. Regular cleaning of lift station wet wells to remove accumulated debris is necessary to ensure proper flow of sewage and safe operation of the pumps. This project will call for the cleaning of the Long Lift Station wet well, along with cleaning and -televising the sewer lines upstream and downstream of the lift station. The work is eligible for FEMA Reimbursement. On February 21, 2019, two (2) bids were received for furnishing all labor, materials, equipment, and supplies for the project. Consider approving the purchase of a camera inspection system from Kinloch Equipment & Supply for use by the Streets and Drainage Division. The IBAK MainLite camera inspection system allows for the detailed examination of drainage pipes and structures that are inaccessible for physical inspection. It incorporates a remote- controlled crawler equipped with a high-resolution video camera capable of maneuvering through pipes as small as five inches in diameter at distances of up to one thousand feet. The system will enable staff to identify and locate drainage system deficiencies with pinpoint accuracy, minimize over excavation, and reduce restoration costs. The recorded video collected by the unit will help document the assessment of the storm sewer system condition and will serve as a useful resource to budget future improvements. Total pricing in the amount of $76,502.00 was obtained from Kinloch Equipment & Supply of Pasadena, Texas through the BuyBoard contract. BuyBoard is a cooperative purchasing association that complies with the State of Texas' procurement statutes. Funds will come from the General Fund. Approval of the resolution. Councilmember Jordan moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE PURCHASE OF A CAMERA INSPECTION SYSTEM FOR USE BY THE STREETS AND DRAINAGE DIVISION FROM KINLOCH EQUIPMENT & SUPPLY, OF PASADENA, TEXAS, IN THE AMOUNT OF $76,502.00 THROUGH THE BUYBOARD COOPERATIVE PURCHASING PROGRAM. Councilmember Sam seconded the motion. Melton YMCA, people ask why the kids are doing what they are doing, what are the kids doing between 6:00 p.m. to 10:00 p.m., some may be home alone with an older sibling because parents may have to work, asked that the gates to the Melton be open as well as the courts so that the kids can have a place to go, know that kids are missing things because they don't have anything to do, if they can't have the building please open the gate so that they can play on the grass Minutes — March 5, 2019 John R. Adolph 7665 Merion Dr. Beaumont TX Thanked the Council for allowing him to speak, thanked the City Manager for his synopsis on the Melton, stated that the Council is locked between a contract that isolates a community center, the Melton has always been a community center, from its onset, it's foundation until now, the- only problem now is that it's no longer a community center, it's his prayer that everyone can work together to forge a partnership, a relationship, unity and harmony, the tenant works with disabled children and no one wants to interfere with that, believes that Council can bring everyone together, the community center should be for everyone, frustrated because when people come to the black community votes are needed, when the black community needs help everybody goes silent, stated that if Council fights for them, then they will fight for Council, that's how this is going to work, everyone wants to stand together because they are better together than apart - Arthur Louis 1783 Rafes Way Beaumont TX Spoke, to Council regarding the Melton facility, the facility is very important to their community, stated that Dr. Farrell is doing a wonderful job, asked that the Council consider keeping the facility open after regular working hours when Dr. Farrell is finished with her regular work day, after hours the center can be used to facilitate programs that would benefit children and adults in the community that are in dire need of a positive place for our citizens to go, programs such as reading, tutoring, mentoring and sports like volleyball, football and basketball Albert Moore 4155 Rapha St. Beaumont TX Asked that Council help them with sidewalks on Sarah St., from the Catholic Church to Fannett Rd., also asked that staff take a look at the area across from Grace Lake Apartments and Theodore Johns Library, would like to have nice bus stops there like he sees in other areas of town, would like the support of Council for the Melton facility, asked that they try and get Dr. Farrell to allow them to use the facility for activities Treva Johnson 1770 Fairway St. Beaumont TX Spoke regarding the gang and domestic violence in the community, there are still people that are barging in people's homes and gunning them down, there are still men that are shooting women and women that are doing things to men, regardless of religion, where you live etc., it's time for everyone to come together collectively and try and make a difference, made mention of the Melton facility, if they can't get the facility then there needs to be another one built to take care of our kids and to teach them to be better Darryl St. Junius 3910 Treadway Beaumont TX Thanked the Beaumont Police Department for the great job they are doing, stated that the Police Department is the one that needs the help, stated that there is a solution, the City may need to put under surveillance, not the entire City but certain parts need to be, the South and North End as well as the Pear Orchard, thinks that this will solve all the problems that the City has been having with violence, murdering and stealing, asked that everyone think about that Minutes — March 5, 2019 Ricky Jason 1075 Magnolia St. Beaumont TX Stated that the he agrees with the previous speaker that surveillance cameras will help, also thinks that there should be a curfew on certain parts of the City, mainly in the drug zones in the South and North End as well as the Pear Orchard, if Wal-Mart can open at 7:00 a.m. and close at midnight then surely the City can have a curfew, spoke regarding the Gun Buyback Program, stated that he thinks it's a waste of time, the guns aren't the problem, it's the people with the guns, that's where the curfew comes in to affect, thinks the curfew will help the Police Officers, the City of Beaumont has the best Police Officers in Southeast Texas, made mention of black on black crime, stated that the kids aren't raised right, thanked Councilmember Pate for opening his eyes and helping him because he did do bad when he was a kid, asked that Council try the curfew for the kids and to enforce it Kirvis Fontenot 4185 Gaursen Beaumont TX Thanked the City Manager for giving insight on the Melton facility, stated that in between the contract and lease agreement there was a proposal, 99.9 percent of the people in the audience want the proposal executed, in the proposal Dr. Farrell said that she would provide opportunities and programs for the community after hours, all the citizens are asking is that Council present a proposal that Council will vote on and make Dr. Farrell accountable for the proposal, there are attorneys on the Council and they know that there is such a thing as discovery, if this goes further and a discovery comes out and it will come out, stated that people in their community knows that there are people on Council with a vested interest in the Melton and they know why, stated that the citizens want the proposal to be executed Deloris Davis 2275 Avalon St. Beaumont TX Spoke to Council regarding the homeless situation within the City, thanked the Police and Fire Department for coming out regarding the fire that occurred under the bridge, most of the homeless have been there for a long time, no one will check out their situation, the churches will feed them and make sure that they are kind of healthy, there were two groups of bikers that came out on Saturday to try and help clean up that area, mentioned that it was stated previously that the property belongs to TXDoT but the people belong to the City, it's everyone's responsibility to make sure that these people are seen about and taken care of and taken off the street, why can't the City be the first community in the world to not have any homeless citizens J.D. Beaumont TX Thanked the Mayor and those Councilmembers that attended the 13th Annual Reading and Love Matters Banquet, commented on the Melton facility, this has really caused a division, the division makes the citizens wonder if Council really cares, if no one reaches out and we don't move the fence or open the door then what do our kids have to look forward to, the community has spoken, agreed with Pastor Adolph, if Council watches their backs they will watch Council's, stated that the voters are in the audience and not where the. Beaumont TX Made comments to Council regarding his fraud case, what bothers him is that he's been denied answers to a direct letter by the Police Chief and the District Attorney, the bank has declared not to do anything regarding theft in Mexico, the theft started here in Beaumont, evidence is being withheld and without the evidence he can't make a case, stated that he will be back next week because his constitutional and civil rights have been violated Gwen Boyd 170 Myrna Loy Dr., Beaumont TX Made comments regarding the Melton facility, when the community got shut out of the facility, the kids were left out on the street to do nothing, they lost skills they had and can no longer go to school and be better, stated that she's having to have Basketball Camp at Lamar University and charge the kids a $100.00, she used to have the camp at the Melton for free, asked Council to help them to help their kids David Moore 5990 Longwood St. Beaumont TX Stated that it's not unusual that the Council has challenges, if everyone looks deep enough and look at the contract maybe they can make the issue work, he has passed the facility and glad that's it's open, this is a City that used to have four YMCA and now it has none, children do need safe havens and need a place to go, a City the size of Beaumont needs multiple complexes, everyone needs to come together and see what can be done to make this work Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER JORDAN - STATED THAT IT HAS BEEN A WONDERFUL EXPERIENCE LISTENING TO EVERYONE THAT SPOKE, INFORMED EVERYONE THAT COUNCIL IS WORKING VERY HARD TO SEE THAT THEY GET TO A POINT TO SERVE THE MOST PEOPLE AND DO THE MOST GOOD THAT'S IN THEIR HEART, IT'S NOT SOMETHING THAT COUNCIL TAKES LIGHTLY, APPRECIATES ALL THAT CAME TO SPEAK, COUNCIL DOES UNDERSTAND, COMMENTED ON THE GUN BUYBACK PROGRAM, THERE WAS A COMMENT THAT IT WAS A WASTE OF TIME, THE GUN BUYOUT TOOK OUT 153 GUNS FROM THE COMMUNITY, IN HER MIND IT DID A LOT OF GOOD, THEY KNEW THAT THE PEOPLE THAT WERE GOING TO COMMIT VIOLENT CRIMES WEREN'T GOING TO TURN OVER THEIR GUNS, FEELS THAT 153 GUNS WAS A GOOD START, REGARDING THE MELTON AND WHO OWNS WHAT AND THE FENCING, IT'S HER BELIEF THAT COUNTY LAND IS LEASED BY THE CURRENT LEASE HOLDER FOR A NOMINAL FEE, ASKED IF SHE COULD HAVE CLARIFICATION WHICH WAS GIVEN BY THE CITY ATTORNEY, THANKED THE PIONEERING WOMEN FOR DISTINGUISHING HER WITH THE HONOR THIS YEAR, PROUD TO BE A PART OF THE ILLUSTRIOUS GROUP Minutes — March 5, 2019 COUNCILMEMBER GETZ - ANNOUNCED THAT THE JEWISH COMMUNITY AT TEMPLE EMANUEL WILL BE HOSTING ITS ANNUAL DELI DAY ON THURSDAY, MARCH 7, 2019, INVITED EVERYONE TO COME OUT AND SUPPORT THE TEMPLE, ALL PROCEEDS WILL GO TO A GREAT CAUSE, ALLISON GETZ WILL BE THE HONOREE AND WILL BE THERE TO GREET EVERYONE COUNCILMEMBER SAM - THANKED EVERYONE FOR BEING AT THE MEETING, HE'S A SUPPORTER OF NEIGHBORHOOD ASSOCIATIONS WHERE CITIZENS CAN SPEND TIME TALKING ABOUT ISSUES THAT AFFECT THEIR COMMUNITY, STATED THAT HE WAS LISTENING, AND HE HEARS THEM COUNCILMEMBER PATE - APPRECIATED EVERYONE COMING AND SPEAKING ON TODAY, IT'S IMPORTANT THAT THOSE IN THE NEIGHBORHOODS STAY INVOLVED, EVERYONE NEEDS TO MAKE SURE THAT THE KIDS STAY ON THE RIGHT TRACK, STATED THAT IT'S NATIONAL BREAKFAST WEEK, SPENT SOME TIME AT REGINA HOWELL WITH THE KIDS FOR BREAKFAST, BELIEVES THAT KIDS CAN BELIEVE AND ACHIEVE, MENTIONED THAT LAST MONTH WAS BLACK HISTORY MONTH AND THIS MONTH IS WOMEN'S HISTORY MONTH COUNCILMEMBER SAMUEL - STATED THAT EVERYONE CAN'T KEEP DOING THE SAME THING OVER AND OVER AGAIN AND EXPECT TO GET A DIFFERENT RESULT, IT'S GOOD TO SEE EVERYONE HERE, IT SHOULDN'T BE ONCE A YEAR, IT SHOULD BE REGULAR, ALL CITIZENS SHOULD KNOW WHAT'S GOING ON IN CITY HALL, STATED THAT HE HEARD IT SAID THAT YOU DON'T HAVE TO GET READY IF YOU STAY READY, CAN'T CONTINUE TO WAIT UNTIL THE LAST MINUTE OR UNTIL SOMETHING HAPPENS FOR US TO COME TOGETHER AS A GROUP, OUR CITY WILL ONLY BE AS STRONG AS THE WEAKEST PART OF OUR CITY, OTHERWISE WE ARE JUST SOUNDING SYMBOLS IN THE WIND MAYOR PRO TEM MOUTON - THANKED EVERYONE FOR SHOWING UP ON TODAY, COMMENTED ON THE MELTON YMCA AS WELL AS SOME OF THE COMMENTS THAT WERE MADE BY THE CITIZENS, STATED THAT DR.
