ENTITLED AN ORDINANCE AMENDING CHAPTER 42
OF THE CODE OF ORDINANCES OF BEAUMONT, TE-
XAS, AND IN PARTICULAR THE BOUNDARIES OF
THE ZONING DISTRICTS AS'INDICATED UPON THE
ZONING MAP OF THE CODE OF. ORDINANCES OF
BEAUMONT, TEXAS, BY CHANGING A 11.19 ACRE
TRACT OF LAND OUT OF THE HEZEKIAH WILLIAMS
SURVEY, ABSTRACT 56, BEAUMONT,. JEFFERSON
COUNTY, TEXAS, AS HEREINAFTER DESCRIBED,
PRESENTLY ZONED "R-1", TO "LR -1"; PROVIDING
FOR SEVERABILITY; AND PROVIDING A'PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont, Texas,
and in particular the boundaries of the zoning districts as indicated
upon the Zoning Map of The City of Beaumont, referred to in Section
42-9 thereof, is hereby amended by changing the zoning classification
of the following described tract of land, presently zoned "R-1", Single -
Family Dwelling District, to "LR -1", Local Retail District, to wit:
Tract 1
BEING an 8.77 acre tract of.land out of
the Hezekiah Williams Survey, Abstract 56,
Beaumont, Jefferson County, Texas, described
as follows:
BEGINNING at an iron pin which marks the
northeast corner of a 4.299 acre tract of-.-.-
land heretofore conveyed to the City of Beau
mont as described in the judgment recorded in
Volume'=1785, Page 57, Deed Records, Jefferson
County, Texas;
THENCE North 880 09' 02" East along the com-
mon line of Lots 3 and 4 of the subdivision
of the West one-half of the.Hezekiah Williams
Survey as recorded in Volume D, Page 439 of
the District Court Minutes of Beaumont, Jef-
ferson County, Texas, a distance of 1,076.64
feet to a point for corner in the northwest
right-of-way line of the proposed 80' wide
Delaware Street Extension right-of-way;
THENCE in a westerly direction along the
northwest right-of-way line of the proposed
Delaware Street Extension along the arc of a
curve to the right, a distance of 1,090.05
feet to a point for corner at the end of said
curve, the said curve having the following
functions: Radios, 1,160.00'; Central Angle,
531 50' 27"; Tangent, 589.02' and a Chord dis-
tance of 1,050.381;

THENCE S 880 09' 02" [lest, continuing a-
long the north line of the proposed 80'
wide right-of-way, 155..48' to a point for
corner in the east line of the aforemen-
tioned City of Beaumont. 4.299 acre tract;
THENCE North 000 00' 21" East, along the
east line of the said 4.299 acre tract, a
distance of 475.82' to the PLACE OF BEGIN-
NING.
Tract 2
BEING a 2.42 acre tract of land out of the
Hezekiah Williams Survey, Abstract 56, Beau-
mont, Jefferson'County, Texas, described as
follows:
FOR LOCATIVE PURPOSES, begin at an iron pin
which marks the northeast corner of a 4.299
acre tract of land heretofore conveyed to
the City of Beaumont by judgment recorded
in Volume 1785, Page 57, Deed Records, Jef-
ferson County, Texas;
THENCE South 000 00' 21" West along the
east line of the said 4.299 acre tract a
distance of 485.82 feet to point for angle;
THENCE South 021 20' 38" -West, continuing
along the east line of the said 4.299 acre
tract a distance of 70.19 feet to the north-
west and BEGINNING'CORNER of the tract herein
described, said BEGINNING CORNER being in the
south right-of-way line of a proposed 80.00
foot wide road right-of-way for.the proposed
extension of Delaware Street;
THENCE North.881' 09' 02" East, along. the
south line of the proposed 80.00 foot wide
road right-of-way, a distance of 161.11 .feet
to a point for corner at the beginning of a
curve to the left;
THENCE in a northeasterly direction continu-
ing along the south right-of-way line of the
proposed 80.00 foot wide road right-of-way a-
long the arc of a curve a distance of 39.65
feet to a point for corner, the said curve
having the following functions: Radius,
1,240.00'; Central Angle, 16 49' 55"; Tangent,
19.83' and a Chord distance of 39.64';
THENCE South 020 20' 38" West, a distance of
526.48 feet to a point for corner at the
northeast corner of. Tract 3;
THENCE South 88°. 09'02" West along.the.north
line of Tract 3, a distance of 200.54, -feet to
point for corner in the east line of the afore-
mentioned City of Beaumont 4.299 acre tract;
THENCE North 020 20' 38" East, along the east
line of the 4.299 acre tract, a distance of
525.84 feet to the PLACE OF BEGINNING,

and the official Zoning leap of The City of Beaumont is hereby amended
to reflect such changes.
.Section 2.
That in all other respects the use of the property hereinabove
described shall be subject to all of the applicable regulations con-
tained in Chapter 42 of the Code of Ordinances of Beaumont, Texas,
adopted August 19, 1958, as amended.
Section 3.
That the terms and provisions of this ordinance shall be deemed
to be severable, and that if the validity of the zoning affecting any
portion of the property described hereinabove shall be declared to be
invalid, the same shall not affect the validity of the zoning of the
balance of the property described herein.
Section 4.
That any person or corporation violating any of the terms and
provisions of this ordinance shall be subject to the.same penalties
provided for in said Chapter 42 of the Code of Ordinances of Beaumont,
Texas.
