ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,
AND IN PARTICULAR THE BOUNDARIES OF THE ZON-
ING DISTRICTS AS INDICATED UPON THE ZONING
MAP OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, BY CHANGING THREE TRACTS CONTAINING A
TOTAL OF 2.87 ACRES AND DESCRIBED AS THE SOUTH
HALF OF LOT 80, BLOCK 9, FRENCH HEIGHTS ADDI-
TION, AND TWO TRACTS OUT OF LOT 79, BLOCK 9,
FRENCH HEIGHTS ADDITION, LOCATED AT THE NORTH-
WEST CORNER OF ANDERSON STREET AND THE 3200
BLOCK OF EASTEX FREEWAY (HIGHWAY 69) FRONTAGE
ROAD, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS
HEREINAFTER DESCRIBED, PRESENTLY ZONED "R-1",
TO "LR -1"; PROVIDING FOR SEVERABILITY; AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont, Texas,
and in particular the boundaries of the zoning districts as indicated
upon the Zoning Map of The City of Beaumont, referred to in Section
42-9 thereof, is hereby amended by changing the zoning classification
of the following described tract of land, presently zoned "R-1", Sin-
gle -Family Dwelling District., to."LR-1", Local Retail District, to wit:
Tract 1
Lot 79 and the South 1/2 of Lot 80 of the
French Heights Addition to The City of Beau-
mont, Jefferson County, Texas, as shown in
Volume 6 of the Map Records of Jefferson
County, Texas.
Tract 2
The herein described tract of land being 0.611
acres of land off of the south end of the Mil-
ton F. Rumery property in Lot 79 of FRENCH
HEIGHTS SUBDIVISION to the City of Beaumont,
Texas, as shown in Vol. 6, Page 61 of the Map
Records of Jefferson County, Texas, and being
all of the property conveyed on February 12,
1954, by Milton F. Rumery, et ux Wilma Rumery
by deed to Charles R. Hardy as recorded in Vol.
929, Page 574, save and except a 0.019 acre
parcel conveyed by the said Charles R. Hardy by
deed dated June 29, 1963, to the State of Texas
as right-of-way for the construction of U. S.'
Highway 69, said deed being recorded in Vol.
1347, Page 97 of the Deed Records of Jefferson
County, Texas, the 0.611 acres of property re-
maining to Charles R. Hardy being more fully
described as follows:

BEGINNING at a 1/2 inch iron pipe set in the
West right-of-way line of Anderson Street set
to mark the Northeast corner of the 0.630 acre
tract conveyed to the said Charles R. Hardy,
said corner being located S.00 - 33' E, 200
feet from the Northeast corner of Lot 79 of
French Heights Addition to The City of Beau-
mont, Texas, which is also the Northeast cor-
ner of the Milton F. Rumery property;
THENCE S. 00 33' E, 207.0 feet along the West
right-of-way of Anderson Street to a pipe set
in concrete in the North right-of-way line of
U. S. Highway 69;
THENCE S. 680 - 55' - 30" W. 34.57 feet to a
T.H.D. marker with pipe in center and being
the Southwest corner of the property being de-
scribed;
THENCE N. 410 - 00' W. 278.0 feet along the
East right-of-way line of U. S. Highway 69 to
a 3/4 inch iron rod set to mark the Northwest
corner of the.0.511 acre tract being described;
THENCE N. 890 - 27' E., 212.69 feet parallel
with the North line of Lot 79 of French Heights
to the POINT OF BEGINNING and containing 0.611
acres of land,

and the official Zoning Map of The City of Beaumont is hereby amended
to reflect such changes.
Section 2.
That in all other respects the use of the property hereinabove
described shall be subject to all of the applicable regulations con-
tained in Chapter 42 of the Code of Ordinances of Beaumont, Texas,
adopted August 19, 1958, as amended.
Section 3.
That the terms and provisions of this ordinance shall be deemed
to be severable, and that if the validity of the zoning affecting any
portion of the property described hereinabove shall be declared to be
invalid, the same shall not affect the validity of the zoning of the
balance of the property described herein.
Section 4.
That any person or corporation violating any of the terms and
provisions.of this ordinance shall be subject to the same penalties

provided for in said Chapter 42 of the Code of Ordinances of Beaumont,
Texas.
