ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,
AND IN'PARTICULAR THE BOUNDARIES OF THE ZON-
ING. DISTRIC'T'S AD INDICATED UPON THE ZONING
MAP OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, BY CHANGING A 4.98 ACRE TRACT OF LAND
OUT OF.THE HEZEKIAH WILLIAMS SURVEY, ABSTRACT
56, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS
HEREINAFTER DESCRIBED, PRESENTLY ZONED "R-1",
TO "R-2"; PROVIDING FOR SEVERABILITY; AND PRO-
VIDING A PENALTY.
BE IT ORDAINED BY THE CITY. OF BEAUMONT:
Section 1.
That Chapter 42 of the Code of Ordinances of Beaumont, Texas,
and in particular the boundaries of the zoning districts as indicated
upon the Zoning Map of The City of Beaumont, referred to in Section
42-9 thereof, is hereby amended by. changing the zoning classification
of the following described tract of land, presently zoned "R-1", Sin-
gle -Family Dwelling District, to "R-2", Two -Family and Multiple -Dwel=
ling District, to wit:
BEING a 4.'98 acre tract of land out of the
Hezekiah Williams Survey, Abstract 56,'Beau-
mont, Jefferson•County, Texas, described as
follows:
BEGINNING at an iron pin -which marks the
southeast corner of a-4.299 acre tract of
land heretofore conveyed.to The City of Beau-
mont by judgment as recorded in Volume 1785,
Page 57, Deed Records, Jefferson County, Texas,
said BEGINNING, CORNER being located in the
north right of way line of Gladys Street;
THENCE North 02° 20' 38" East a distance of
1048.00 feet to a point for corner at the
southwest corner of the aforementioned Tract
2;
THENCE North 88909' '01 -East along the south
line of Tract 2 a distance of 200.54 feet to a
point for corner at the southeast corner.of
said Tract 2;
THENCE South 020 20' 38" West.a.distance of
926.31 feet to a point fo,r corner on the north
bank of what is known as Keith ditch;
THENCE South 371 02' 13" East along the north
bank line of the said ditch a distance of 160.36
feet to a point for corner in the north right of
way line of Gladys Street;
THENCE South 890 59.: 27" West along the
north line of Gladys Street a distance of
302.00 feet to the place of beginning,
and the official Zoning Map of The City of Beaumont is hereby amended
to reflect such changes.
Section 2.
That in all other respects the use of the property herein-
above described shall be subject to all of the applicable regulations
contained in Chapter 42 of the Code -.of- Ordinances of Beaumont, Texas,
adopted August 19, 1958, as.amended.
Section 3.
That the terms and provisions of this ordinance shall be deemed
to be severable, and that if the validity of the zoning affecting any
portion of the property described hereinabove shall be declared to be
invalid, the same shall not affect the validity of the zoning of the
balance of the property described herein.
Section 4.
That any.person or corporation violating any of the terms and
provisions of this ordinance shall be subject to the same penalties
provided for in said .Chapter 42 of .the Code of Ordinances of Beaumont,
Texas.
