ENTITLED AN ORDINANCE AMENDING THE FIRE CODE
OF THE CITY OF BEAUMONT AS THE SAME AS FOUND
IN CHAPTER 3, SECTION 3-1 OF THE CODE OF ORDI-
NANCES OF THE CITY OF BEAUMONT BY AMENDING
SUBSECTION 13-1.124(L) BY ADDING TWO TRACTS
OF LAND AND AMENDING SUBSECTION 13-1.113(F)TO
PROVIDE A TEMPORARY PERMIT FOR RESIDENTIAL
ABOVE -GROUND STORAGE OF LP GAS, AND PROVIDE
INSTALLATION REQUIREMENTS FOR ABOVE -GROUND LP
GAS STORAGE FOR RETAIL PURPOSES; PROVIDING FOR
REPEAL; PROVIDING FOR SEVERABILITY; AND PROVID-
ING A_ -PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Subsection 13-1.124(L) of Chapter 3, Section 3-1 of the
Code of Ordinances of the City of Beaumont is hereby amended by add-
ing tracts VI and VII to the areas within the city limits of the City
of Beaumont in which.storage of flammable liquids and outside above-
ground tanks and new.bulk plants for flammable or combustible liquids
are allowed, said tracts described as follows:
Traci- XTT
Being a 1.7201 acre tract of land out of Lots
A, B and C,.Block 6 of the Heflebower and Scott
Subdivision and out of the J. W. Bullock'League,
Abst. No. 7 as recorded in Volume 1, Page 83, of
the Map Records of Jefferson County, Texas, the
1.7201 acre tract of land being more particularly
described by metes and bounds as follows, to wit:
BEGINNING at a point in the north boundary line
of the Heflebower and Scott Subdivision, which
point is in the center of a 27' wide street, and
which point is the Northwest corner of Lot A,
Block 6 of said subdivision, an iron pin for cor-
ner;
THENCE N. 890 03' 30" E. along a portion of the
north boundary line of. the Heflebower and Scott
Subdivision passing at 13.50''the easterly line
of the 27' wide street and at 190.19' an' iron pin
for corner;
THENCE S. 00 32 00" E. passing at 181.50' the
lot line common to Lots A and B, at 363.00' the -.-
lot line common to Lots B and C, Block 6 of said
subdivision, and at 449.50' a point in the Nor-
therly right of way line of Highway Loop No. 251,
Highway Concrete Monument Engr. Sta':39 + 50 for
corner;
THENCE N. 600 31' 57" W. along the northerly
right.of way line of -Highway Loop No.'251
passing the lot line common to" Lots B and
C and at 219.62' a point in the center of ".
a 27' wide street, which point is also in
the westerly line of Lot B, Block 6 of said
subdivision, a Highway Concrete Monument
Engr. Sta. 37 + 18.66' for corner;
THENCE N. Go 32` 00" W. along the center
line of the 27' wide street passing at
156.95,' the corner common to Lots B and A,
Block 6 of said subdivision and at 338.45'
the place of beginning.
Tract VII:
Being a 6.334 acre tract of land out of the
J. E. French Estate 124.390 acre tract.in
the W. B. Dyches League .in Jefferson County,
Texas, and being more particularly described
as follows:
BEGINNING at a steel rod in the West right of
way line of the T. & N. 0. R. R. and in the
South right of way line of Lawrence Drive; a
road running in a northeasterly direction
from the new right of way. for U. S. Highways
69, 96 and 287; said steel rod being also
South 47 deg. 22.5' West 100.02 feet from the
Westmost corner of Block No. Thirteen ('13),
Unit II of Suburban Acres Addition;
THENCE South 41 deg. 28.5' East with the West
right of way of the T & N. 0. R. R. 1649.9
feet to the PLACE OF BEGINNING of the herein
described tract of land;
THENCE South 41 deg. 28.5' East with said
right of way line 200.0 feet'to a point;
THENCE South 57 deg. 27.5' West 1136.52 feet
to a point in the East right of way line (a
curve) of said U. S. Highways 69, 96 and 287;
THENCE with a 1.024 deg. curve to the right,
being said right of way line, 300.0 feet to a
point;
THENCE North 62 deg. 48' East 1091.3 feet to
the PLACE OF BEGINNING, containing 6.334 acres
of land, together with all improvements there-
on.
Section 2.'
That Subsection -13-,1.113;. of Chapter 3, Section 3-1 of the
Code of Ordinances is hereby amended by:adding a new Section 13-1.113(F)
to read as follows:
13-1.113 (F) : ' Installation' of Above -Ground
S_tbrage Tanks for LP Gas.

1. Tanks for above -ground storage for LP gas
for retail or wholesale purposes must be in-
stalled in accordance with the requirements
and the Liquified Petroleum Docket No. 1 of the
Railroad Commission, LP Gas Division. The in-
stallation must be fenced by a fence designed
to be climb -proof, the gate of the fence shall
be lockable, and remain locked at all times when
the tank is not in use. The tank must be fitted
with a self-contained dispensing unit. The in-
stallation must have an overhead sprinkler
system of a diluge type with the number of
sprinkler heads for each installation to be
determined fy the Fire Chief. The installation
must have a remote -control valve which is cap-
able of manually controlling the flow of water.
The location of this remote -control valve is to
be determined by the Fire Chief. No installation
will be allowed in which the tank capacity is in
excess of 1,000 gallons.
2. Above -ground storage of LP gas for residential
purposes and tanks having a maximum capacity of
250 gallons shall be permitted so long as the in-
stallation is made in accordance with Liquified
Petroleum Gas Docket No. 1, Railroad Commission,
LP Gas Division.
3. Any person desiring to install a tank for
storage of LP gas above ground for residential
purposes in an area other than the areas desig-
nated in Subsection 13-1.125(L) must first obtain
a temporary permit for said installation from the
Fire Chief. The permit will only be issued in
areas of the City in which natural gas is not
available and will expire when natural gas be-
comes available. The term available as used
herein means when the cost of the property owner
to attach to natural gas does not exceed $200.00.
Section 3.
That all ordinances and parts of ordinances in conflict herewith
are hereby repealed..
Section 4.
That if any section, subsection, sentence, clause or phrase of this
ordinance or the application of same to a particular set of persons or cir-
cumstances should for any reason be held to be invalid, such invalidity shall
in no wise affect the remaining portions of this ordinance, and to such end
the various portions and provisions of this ordinance are declared to be severable.

That any person who violates any provision of this ordinance shall,
upon conviction, be punished as provided in Section 108 of the�Code of Ordinances
of Beaumont, Texas.
