ENTITLED AN ORDINANCE AMENDING SECTIONS 12-19
AND 12-20 OF THE CODE OF ORDINANCES OF BEAU-
MONT, TEXAS, BY SETTING THE RATES OF PAY AND
NUMBER OF POSITIONS IN ALL GRADES IN THE FIRE
AND POLICE DEPARTMENTS; REPEALING ALL CONFLICT-
ING ORDINANCES; AND PROVIDING FOR.SEVERABILITY.
WHEREAS, on June 24, 1975, the City Council approved an agree-
ment between the City of Beaumont and Local No. 491, International
Brotherhood of Police Officers, negotiated pursuant to the,,terms of
the Fire and Police Employee Relations Act; and,
WHEREAS,.the City of Beaumont attempted to negotiate an agree-
ment with Local No. 399, International Association of'Fire Fighters,
but the economic issues were submitted to arbitration; and,
WHEREAS, the City desires to place into effect the wage rates
established by the collective bargaining agreement for the Police Depart-
ment and by the arbitration panel for the Fire Department;
NOW, THEREFORE, BE IT ORDAINED BY
THE CITY OF BEAUMONT:
Section 1.
That Section 12-19 of the Code of Ordinances of Beaumont, Texas,
is hereby amended to read as follows:
12-19: Grades and Classifications in Police
Department.
All positions in the Police Department.of the
City of Beaumont, Texas, are hereby classified
into the following grades, each having duties
of substantially similar authority, importance
and responsibility:
(1) Grade I. There shall be one hundred fif-
teen (115 positions in Grade I, said positions
to include police officers. The base pay of
every officer who has been in this grade not
more than one (1) year shall be Eight Hundred
Sixty-Five.and No/100 ($865.00) Dollars per
month; the base pay of every officer in this
grade with more than one (1) year's service
but less than three (3) years' service shall
be Nine Hundred and No/100 ($900.00) Dollars
per month; the base pay of every officer in
this grade with more than three (3) years' ser-
vice, but less than five (5) years' service
shall be Nine Hundred Fifty and No/100 ($950.00)
Dollars per month; and the base pay of every offi-
cer in this grade with more than five (5) years'
service shall be Nine Hundred Seventv-Five and
No/100 ($975.00) Doll -ars per month.
(2) Grade II. There shyll be'fifty-four (54)
positions in Grade II, said positions to include
sergeants and detectives. The base pay of every
officer in this grade from start to five (5)
years shall be One Thousand Fifty and No/100
($1,050.00) Dollars per month; and the base pay
of every officer in this grade after five (5)
years shall be One Thousand Seventy -Five and
No/100 ($1,075.00) Dollars per month.
(3) Grade III. There shall be nine (9) posi-
tions in Grade III, said positions to include
police lieutenants. The base pay of Every offi-
cer in this grade from start to five'(5) years
shall be One Thousand One Hundred Fifty and
No/100 ($1,150.00) Dollars per month; and the
base pay of every officer in this position
after five (5) years of service shall be One
Thousand Two Hundred and No/100 ($1,200.00)
Dollars per month.
(4) Grade IV. There shall be eight (8) posi-
tions in Grade IV, said positions to include
police captains. The base pay of every officer
in this grade from start to five (5) years of
service shall be One Thousand Two Hundred
Seventy -Five and No/100 ($1,275.00) Dollars per
month; and the base pay of every officer in
this grade after five (5) years of service shall
be One Thousand Three Hundred Twenty -Five and
No/100 ($1,325.00) Dollars per month.
(5) Grade V. There shall be two (2) positions
in Grade V, said positions to include police
majors. The base pay of every officer in this'
grade from start to five (5) years of service
shall be One Thousand Four Hundred and No/100
($1,400.00) Dollars per month; and the base pay
of every officer in this grade after .five (5)
years of service shall be One Thousand Four Hun-
dred Fifty and No/100 ($1,450.00) Dollars per
month.
(6) Grade VI. There shall be one (1) position
in Grade VI, said position being assistant chief
of police. The base pay of the officer in this
grade shall be One Thousand Five Hundred Fifty
and No/100 ($1,550.00) Dollars per month.
Section 2.
That Section 12-20 of the Code of Ordinances of Beaumont, Texas,
is hereby -amended to read as follows:
All positions in the Fire Department of the City
of Beaumont, Texas., are hereby classified into
the following grades, each grade having duties
of substantially similar authority, importance,
and responsibility:
(1) Grade I. There shall be ninety-six (96)
positions in Grade I, said positions to include
firefighters. The base pay of every firefighter
with less than six (6) months' service shall be.
Eight Hundred Thirteen and No/100 ($813.00)

Dollars per month; the base pay of every
firefighter in this grade with more than
six (6) months' service but not more than
eighteen (18) months' service shall be
Eight Hundred Fifty -Five and No/100 ($855.00)
Dollars per month; and the base pay of every
firefighter in this grade with more than
eighteen (18) months' service shallb.e Eight
Hundred Ninety -Seven and No/100 ($897.00)
Dollars per month.
(2) Grade II. There shall be fifty-nine
(59) positions in Grade II, said positions
to include fire prevention investigator I
and fire engineers. The base pay of every
firefighter in this grade shall be Nine Hun-
dred Eighty -Nine and No/100 ($989.00) Dollars
per month.
(3) Grade III. There shall be .forty-two (42)
positions in Grade III, said positions to include
fire captains and fire prevention investigators
II. The base pay of every firefighter in this
grade shall be One Thousand.Ninety-One and No/100
($1,091.00) Dollars per month.
(4) Grade IV. There shall be twelve (12) posi-
tions in Gr e IV, said positions to include district
chiefs, fire dispatch supervisor, fire marshal, and
training officer. The base pay of every firefighter
in this grade shall be One Thousand Two Hundred
Three and'No/100 ($1,203.00) Dollars per month.
(5) Graae V. There shall be three (3) positions
in Grande V, said positions to include deputy
chiefs. The base pay of every firefighter in
this grade shall be One Thousand Three Hundred
Twenty -Seven and No/100 ($1,327.00) Dollars per
month.
(6) Grade VI. There shall be one (1) position
in Grade VI, said position being assistant fire
chief. The base pay of the firefighter in this
grade shall be One Thousand Five Hundred Thirty -
Four and No/100 ($1,534.00) Dollars per month.
Section 3 .
That all ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed to the extent of such
conflict.
Section 4.
That if any section, subsection, sentence, clause or phrase of
this ordinance or the application of same to a particular set of persons
or circumstances shall, for any reason, be found to be invalid, such in-
validity shall in no wise affect the remaining portions of this ordinance,

and to such end the various. portions and provisions of this. ordinance
are declared to be severable.
