ENTITLED AN ORDINANCE ESTABLISHING A PROGRAM AND
POLICY OF RESIDENTIAL STREET PAVING ASSESSMENT
BY THE CITY OF BEAUMONT, TEXAS; PROVIDING FOR
AVAILABILITY OF ASSESSMENT PAVING; PROVIDING FOR
APPLICATION BY THREE-FOURTHS OF THE PROPERTY OW-
NERS AND TWO-THIRDS OF TOTAL PROPERTY FRONTAGE
OR THREE-FOURTHS OF TOTAL PROPERTY FRONTAGE AND
TWO-THIRDS OF PROPERTY OWNERS; PROVIDING FOR AS-
SESSMENT RATES; PROVIDING FOR CITY PAYMENT FOR
ALL" -,COSTS OF STORM SEWERS AND APPURTENANCES;
PROVIDING FOR FINANCE OF STREET ASSESSMENT CER-
TIFICATES BY THE CITY AND MONTHLY PAYMENTS; PRO-
VIDING A POLICY WITH REFERENCE TO THE PAVING OF
EXISTING CONCRETE SLAB STREETS; PROVIDING FOR AN
EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR REPEAL OF ALL ORDINANCES AND PARTS
OF ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, the City Council of the City of Beaumont desires to
promulgate a residential street paving assessment program/policy in
order to implement a workable paving assessment program under which
citizens may obtain assistance from the City in the paving of residen-
tial streets;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That the following general program and policy of residential
street paving assessment is hereby adopted by the City Council:
A) The paving assessment procedure is available only for the
improvement of existing residential streets in existing residential
neighborhoods. This program is not designed to aid subdividors and
real estate developers in the construction of proposed new subdivisions;
and the City Council reserves the right to reject any applications for
street assessment paving participation by the City of Beaumont which
they feel do not meet this criteria. The City Council of the City of
Beaumont must pass upon each application or paving assessment assistance
by the City of Beaumont.
B) Street improvements under this street assessment policy will
be ordered for one of the following reasons:
1) Upon application executed by three-fourths (3/4) or
more of the property owners and two-thirds (2/3) or more of the total.

thirds (2/3) or more of the total property frontage of a proposed pro-
ject or application executed by three-fourths (3/4) or more of the pro-
perty frontage of a proposed project or application executed by three-
fourths (3/4) or more of the total property frontage and two-thirds
(2/3) or more of the property owners of any proposed project.
2) If a public need exists for such improvement.
3). If improvements are needed to eliminate excessive main-
tenance costs.

C) Assessment rates are hereby set on 26' wide paving only as
1) $8.00 per front foot if prepayment of t tal cost in one
lump sum is made and assessment proceedings are not necessary.
D) City will pay all costs of storm sewer and appurtenances.
E) Financing of street assessment certificates will be handled
by the City tax office and monthly installments in an amount equal to
not less than $10.00 for each fifty (501) feet of property frontage will
be accepted.
F) Assessment certificates shall bear interest at six (6%) per
cent per annum.
Section 2.
That the residential street paving assessment policy shall also
include the widening of existing concrete slab streets in existing resi-
dential neighborhoods to the adopted width of a residential street of
twenty-six (26� feet.
A) Street improvements under this assessment policy will be or-
dered for those streets which meet the criteria as set forth in Section
1, Paragraph B.

B) Assessment rates for widening existing concrete slab streets
to twenty-six (26') feet wide curbed street with underground drainage
shall be as follows:
1) Each abutting property owner who makes prepayment of the
total cost in one lump sum prior to the assessment proceedings shall pay
fifteen (15%) per cent of the total cost of the construction improvements,
not to exceed the front foot rate as established in Section 1, Paragraph
C, 1.
2) Financing of street assessment certificates will be han-
dled by the City tax office as set forth in Section 1, Paragraph E and F.
Section 3.
This ordinance will be effective from and after June 3, 1975.
Section 4.
That if any section, subsection, sentence, clause or phrase of
this ordinance or the application of same to a particular set of persons
or circumstances should for any reason be held to be invalid, such inva-
lidity shall in no wise affect the remaining portions of this ordinance,
and to such end the provisions of this ordinance are declared to be sever-
able.
Section 5:
All ordinances or parts of ordinances in conflict herewith are
repealed to the extent of the conflict if any.
