ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAPTER 42
OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, AND IN PARTICULAR THE BOUNDARIES OF
THE ZONING DISTRICTS AS INDICATED UPON
THE ZONING MAP OF THE'CODE OF ORDINANCES OF
BEAUMONT, TEXAS, BY.CHANGING A .35 ACRE
TRACT OF LAND OUT OF THE H. WILLIAMS SURVEY
TO THE CITY OF BEAUMONT, JEFFERSON COUNTY,
TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY
ZONED "R-2", TO "R-311; PROVIDING FOR SEVER-
ABILITY: AND PROVIDING A PENALTY.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
OF BEAUMONT:
Section 1.
That'Chapter 42 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts
as indicated upon the Zoning Map of The City of Beaumont, re-
ferred to in Section 42-9 thereof, is hereby amended by changing
the zoning classification of the following described tract of
land, presently zoned "R-2", Two Family and Multiple Dwelling,
to "R-3", Modified Two Family and Multiple Dwelling, to wit:
BEGINNING at a concrete monument which marks
the most Westerly corner of Lot 26 and the
most Northerly corner of Lot 25, Block 1,
Broadway Place Addition, plat of which is
recorded in Volume 7, Page 172, Map Records,
Jefferson County, Texas, said corner being
located at the most Westerly Northwest corner
of said Broadway Place Addition at the South-
west corner of the Nall Tract and in the East
line of the Polk Tract;
THENCE South 89°30' West for a distance of
144.26' to the West line of the Polk Tract;
THENCE North 4059'30" West for a distance of
63.48' to a pipe for corner in the west line
of the Polk Tract;
THENCE North 62°54'30" East for a distance of
92.92' to an iron rod at angle point;
THENCE North 61007' East for a distance of 80'
to an iron rod along the common line of the
Nall and Polk Tract;
THENCE South 1°12' West for a distance of
143.97' to the place of the beginning,
and the official zoning map of The City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That in all other respects the use of the property here-
inabove -described shall be subject to all of the applicable regu-
lations contained in Chapter 42 of the Code of Ordinances of
Beaumont, Texas, adopted August 19, 1958, as amended.
Section 3.
That the terms and provisions of this ordinance shall be
deemed to be severable, and that if the validity of the zoning
affecting any portion of the property described hereinabove shall
be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the property described herein.
Section 4.
That any person or corporation violating any of the terms
and provisions of this ordinance shall be subject to the same
penalties provided for in said Chapter 42 of the Code of Ordinances
of Beaumont, Texas.
