ENTITLED AN ORDINANCE AUTHORIZING THE VACATING
AND ABANDONMENT OF AN ALLEY LOCATED IN BLOCK
ONE (1) OF THE AMAIMO ADDITION IN THE CITY OF
BEAUMONT, TEXAS, RESERVING, HOWEVER, THE RIGHT
OF THE CITY OF BEAUMONT TO CONSTRUCT AND MAIN-
TAIN. IN SAID ALLEY SEWER. LINES, . WATER LINES,
AND OTHER UTILITIES, AND RESERVING THE RIGHT
OF THE CITY.OF'BEAUMONT TO GRANT FRANCHISE
RIGHTS TO OTHERS TO CONSTRUCT AND MAINTAIN THE
UTILITIES HEREINBEFORE MENTIONED THROUGH AND
ALONG SAID ALLEY, AND PROHIBITING THE OBSTRUCTION
OF SAME BY ANY BUILDING OR STRUCTURE.
WHEREAS, -a petition signed by all of -the property owners
of Block One (1) of the Amaimo Addition to The City of Beaumont has
been presented to the City Council of The City of Beaumont, request-
ing that the alley in said Block be vacated and abandoned.;, and,
TdHEREAS, said petition has been referred to the City,
Planning Commission for examination and approval, and the same
has been approved by said Commission; and,
WHEREAS, said petition has been duly canvassed and exam -
fined by the. City Council and has been found to have been signed
by all of the property owners in said Block, and it appearing
to the City Council that the request of said property owners
should be granted and that -an ordinance should be enacted vacat-
ing and abandoning said alley, reserving, however, to The City
of Beaumont the right to construct and maintain all necessary
public utilities in said alley, or to grant franchises for the
construction and maintenance of such utilities in said alley;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT,
TEXAS:
That the alley running through Block One (1) of the Amaimo Addition
to the City of Beaumont be, and the same is hereby, authorized
to be vacated and abandoned, and that the title to such
alley should revert to and become the property of the persons
entitled thereto, as prbvided*by law; provided, however, that
the: vacating and abandoning of said alley shall in no way affect
the right of The City of Beaumont to place and maintain therein
sewer, gas, and water lines, telephone, telegraph, and electric
wires, poles, and cables, or any other public utility service.
Neither shall the vacating and abandoning of said alley affect
the right of The City of Beaumont to grant franchises to any
person, firm, or corporation authorizing the placing and main-
taining in said alley of such sewer, gas, or water line, telephone,
telegraph, or electric lines, or other public utility service, all
of which rights are hereby expressly reserved. And the vacating
and abandoning of said alley shall not be construed as authorizing
or perrriitting any person, party, corporation, or legal entity what-
soever to erect, construct, build, move onto or place any building
or structure thereon, and the erection, construction, building,
moving onto or placing of any building or structure therein without
permission of the City Council to do so is hereby prohibited.

SPECIAL SESSION OF THE CITY PLANNING COMMISSION
HELD AUGUST 6, 1952
BE IT REMEMBERED that the City Planning Commission of the City of Beaumont, Texas,
met in special session on the 6th day of August, 1952, with the following present;
C. B. Holland, Chairman
Russell Phelps
Miss Florence McCluskey
Leonard Stone (Proxy)
Absent: C. E. holland
P. G. Matthews
Others Present;
J. D. Martin, City Engineer
George Schaumburg
Minutes of the previous meeting held July 2, 1952, were approved on motion made by
Russell Phelps and seconded by Leonard Stone.
Chairman Holland requested that Don Terry, Tax Assessor and Collector for the'Ci.ty
of Beaumont, be added to the mailing list.
Mr. Schaumburg appeared before the Commission and requested preliminary approval
of North Mary Howell, Unit 1'.
Ib tion was made by Miss McCluskey and seconded by Mr. Phelps, that preliminary
approval be given North Mary Howell, Unit 1.

Mir. Schaumburg requested approval of a replat of Caldwood Addition, Charles
Williams League, changing Lots 1, 2, 13, 14, 23, 24, Block 5, Lots 1, 4, 131 14,
Block 6..
City Engineer Martin stated that the Fire Department and Police Department did nod-..-

od=,like streets having the same name with a North, South, etc. before it because of
delays in reaching the addresses caused from similarity in addresses.
Mr. Schaumburg told the Commission he would have the street names changed to three
different names.
Motion was made by Miss McCluskey and seconded by Leonard Stone that the replat of
Caldwood Addition be approved with the understanding that North, South, and East
Bristol streets be changed to three separate names.

Chairman Holland stated that he had received a petition requesting that an alley
in Block 59, Jeff Chaison 2nd Addition be closed.
After a brief discussion, motion was made by Leonard Stone and seconded by Miss
McCluskey that the Planning Commission recommend to the City Council that the
alley in Block 59, Jeff Chaison 2nd Addition be closed with the understanding
that it meets with the approval of the City Engineer.
Chairman Holland stated that he had received a petition requesting that the.alley
in Block 1, Amaimo Addition be closed. Iux. Holland said this closing had already
been approved by the City Engineer.
hb tion was made by Mr. Phelps and seconded by Miss McCluskey that the Planning
Commission recommend to the City Council that the alley in Block 1, Amaimo
Addition be closed.
It was the consensus of the Commission that a special meeting should be called
and that the Mbyor and City Manager, Nay. Southwell, Mr. Holtkamp, the Fire Chief
and the.Police Chief be invited to see if something couldn't be worked out on
street naming.

There being no further business,' the meeting was adjourned by Chairman Holland.

Addition to the ,City of Beaumont, hereby respectfully petition that the

closed in the manner as permitted by the statutes of the State of Texas,
and that such alley become the absolute property of the owners of the land
in said block adjacent and abutting on such alley, it.being understood]
however, that the closing of this alley shall in no way affect the rights
of the City as to placing and maintaining therein of aW sewer or water
lines, or telephone, telegraph, or electric lines, wires, poles, or cables --
or any other service or utility of the City, or the right of the City to
grant franchises to persons or corporations to place and maintain therein
any such sewer or water line, or telephone, telegraph, or electric lines;
wires, poles., or cables, or arxy other service or utility of the City]
