ENTITLED AN ORDINANCE AUTHORIZING THE VACATING
AND ABANDONMENT OF AN ALLEY LOCATED IN BLOCK
TWENTY-ONE (21) OF THE JIROU ADDITION IN THE
CITY. OF BEAUMOhT, TEXAS, RESERVING, HOWEVER, THE
RIGHT OF THE CITY OF BEAUMONT TO CONSTRUCT AND
MAINTAIN IN SAID ALLEY SEWER LINES, WATER LINES,
AND OTHER UTILITIES, AND RESERVING THE RIGHT OF
THE CITY OF BEAUMONT TO.GRANT FRANCHISE RIGHTS
TO OTHERS TO_ CONSTRUCT AND MAINTAIN THE UTILITIES
HEREINBEFORE )!MENTIONED THROUGH AND ALONG SAID
ALLEY, AND PROHIBITING THE OBSTRUCTION OF SAME
BY ANY BUILDING OR STRUCTURE.
WHEREAS, a petition signed by all of the property own-
ers of Block Twenty-one (21) of the Jirou Addition to The City
of Beaumont has been presented to the City Council of The City
of Beaumont, requesting that the alley in said Block be vacated
and abandoned; and,
WHEREAS, said petition has been referred to the City
Planning Commission for examination and approval, and the same
has been approved by said Commission; and,
WHEREAS, said petition has been duly canvassed and
examined by the City Council and has been found to have been
signed by all of the property owners in said Block, and it ap-
pearing to the City Council that the request of said property
owners should be granted and that an ordinance should be enacted
vacating and abandoning said alley, reserving, however, to The
City of Beaumont the right to construct and maintain all neces-
sary public utilities in said alley, or to grant franchises for
the construction and maintenance of such utilities in said alley;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF
BEAUMONT, TEXAS:
That the alley running between Mariposa Street and Oakland
Street in Block Twenty-one (21) of the Jirou Addition to The
City of Beaumont be, and the same is hereby, authorized to be
vacated and abandoned, and that the title to such alley should
revert to and become the property of the persons entitled
thereto, as provided by law; provided, however, that the
vacating and abandoning of said alley shall in no way affect
the right of The City of Beaumont to place and maintain
therein sewer, gas, and water lines, telephone, telegraph, and
electric wires, poles, and cables, or any other public utility
service. Neither shall the vacating and 'abandoning of said
alley affect the right of The City of Beaumont to grant fran-
chises to any person, firm, or corporation authorizing the
placing and maintaining in said alley of such sewer, gas, or
water lines, telephone, telegraph, or electric lines, or other
public utility service, all of which rights are hereby express-
ly reserved. And the vacating and abandoning of said alley
shall not be construed as authorizing or permitting any person,
party, corporation, or legal entity whatsoever to erect, con-
struct, build, move onto or place any building or structure
thereon, and the erection, construction, building, moving onto
or placing of any building or structure therein without per-
mission of the City Council to do so is hereby prohibited.

SPECIAL SESSION OF THE CITY PLANNING COMMISSION ('��,�� �l1 y
HELD APRIL 2, 1952 �r al ?-,
BE IT REIiWERED that the City Planning Commission of the City of Beaumont, Texas,
met in special session on the 2nd day of April, 1952, with the following present;

Leonard Stone
Miss Florence McCluskey
Russell Phelps,

Absent; P. G. Matthews
Others Present;
J. D. Martin, City Engineer
Geo. Sohautoburg
Minutes of the previous meetings held February 27th and March 12th were approved
as written and received by members of the Planning Commission on motion made by
Russell Phelps and seconded by C. E. Holland. The motion carried unanimously.

A petition was presented requesting that the alley located in Block 21, Jirou
Addition be closed. City Engineer Martin told the Commission that this petition
had been signed by all property owners and a check with the Water Department
showed there were no water lines in the alley.
Motion was made by Florence McClusky and seconded by C. E. Holland that
recommendation be made to the City Council to close the alley in Block 21, Jirou
Addition. The motion carried unanimously.

Mr. Geo. Schaumburg appeared before the Council and asked for preliminary and
final approval of Lynwood Terrace Addition, Block 8.
Motion was made by Leonard Stone and seconded by Florence McCluskey that pre-
liminary and final approval be given Block 8, Lynwood Terrace Addition. The
motion carried unanimously.
Mr. Geo. Schaumburg requested that preliminary and final approval be given a part
of Block 14 of Cartwright -Roberts Subdivision A.
After a brief discussion, motion was made by Russell Phelps and seconded by C. E.
Holland that preliminary and final approval be given to Subdivision'plat of the
south half of Block 14, Cartwri*it Roberts Subdivision A. The motion carried
unanimously.
Miss McCluskey stated that Don Terry, City Tax Assessor and Collector had informed
her of a problem he had in connection with collecting taxes after a plat had been
approved for an addition by the Planning Commission.
After a brief discussion, Chairman Holland said he would discuss the matter with
Mr. Terry before the next meeting to find out ;just what his problem was.
There being no further business, the meeting was adjourned by Chairman Holland.
