ENTITLED AN ORDINANCE RELINQUISHING AND TRANSFERRING TO THE
LAMAR STATE COLLEGE OF TECHNOLOGY SIX(6) BUILDINGS COMPRISING
SEVENTY-TWO (72) HOUSING UNITS, SITUATED ON LANDS BELONGING TO
LAMAR STATE COLLEGE OF TECHNOLOGY AT BEAUMONT, IN JEFFERSON
COUNTY, TEXAS, AND UNDER LEASE TO THE CITY OF BEAUMONT, AND
BEING THE SAME SEVENTY-TWO (72) HOUSING UNITS WHICH WERE RE-
'LINQUISHED AND TRANSFERRED TO THE CITY OF BEAUMONT BY THE
UNITED STATES BY RELINQUISHMENT AND TRANSFER DATED THC 21st.
DAY OF NOVEMBER, 1949, A PORTION OF THE HOUSING UNITS DESI-
GNATED AS PROJECT NO. T= -v-41766 UNDER CONTRACT NO. HA (V-_41766)
mph -1 with the UNITED STATES OF AMERICA BY THE CITY OF BEAUMONT,
SUBJECT,TO CERTAIN PROVISIONS AND MAKING CERTAIN FINDINGS WITH
REFERENCE THERETO.
WHEREAS, under the Public Housing Acta of Congress of October 14,
1911.0, and amendments thereto, and under the rules and regulations promulgated
thereunder, there was allocated to public colleges and universities certain
numbers of housing units, and to municipalities certain numbers'of housing
units to be constructed by the United States, and the allocations to colleges
and universities made Lamar College eligible for only two (2) units, contain-
ing twenty (20) apartments, and there was need for more housing for students
and veterans at Lamar College than the amount to which Lamar College was
entitled, and the City of Beaumont, in order to cooperate with Lamar College
in obtaining additional housing units to be built upon the campus of Lamar
College, made application for six (6) buildings, containing seventy-two
(72) housing units for white families, and Lamar College granted to the City
of Beaumont a'lease on a portion of its campus at a nominal rental-of.one
($1.00) dollar per year upon, which to locate said housing units and provided
the -right -of -'way of ingress and egress to said housing units and participated
in the cost of improving the same, which housing units were provided for
veterans under the provisions of the federal law, and were used principally
for students attending Lamar and teachers teaching in Lamar;and,
WHEREAS, said,housing'units, so constructed and located, containing
seventy-two (72) units, were, -'among others, relinquished and transferred to
the City of Beaumont by relinquishment -and transfer dated the 21st day of
November, 19+9; and,
WHEREAS-, the lease agreement with.Lamar College to the land on which
said buildings are situated has expired, .and said -buildings are in need of
repair and rehibilitation, and it would.not be advantageous to the City of
Beaumont to demolish -said buildings and remove them from their present site,
and it would not be profitable to the City of Beaumont to pay an adequate
rental to Lamar College for the land upon which said buildings are situated;
and.,
WHEREAS, it would be in compliance with the original intent of the
City of Beaumont and Lamar College when said housing units were acquired to
transfer the same to Lamar College; now, therefore:
BE IT ORDA= BY THE CITY OF BEAUMONT:
SECTION I
That the City of Beaumont hereby relinquishes and transfers, without
monetary consideration, to the Lamar State College of Technology at Beaumont,
in Jefferson County, Texas, all contractual rights (Including the right to
revenues and other proceeds) and all property, right, title and interest bf
the City of Beaumont in and with respect to the temporary housing located on
land owned by the Lamar State College of Technology, and presently under lease
to the City of Beaumont, in Jefferson County, Texas, and designated as
six (6) buildings comprising'seventy-two (72) housing units, being a part
of Project No. TEX-v-1+1766 under Contract No. HA. (v-1+1766) mph -1 between
the United States of America and the City of Beaumont, it being provided
in the relinquishment to the City of Beaumont that such relinquishment is
"based on the representation that it will, in filling vacancies in the
housing project transferred and relinquished hereunder, continue to give
preference to veterans; and servicemen, as said terms are defined in the
contract, rights to which are being relinquished hereunder," and this re-
linquishment and transfer is in accordance with and subject:to all of the
provisions of the relinquishment and transfer to the City of Beaumont
dated the 21st day of November, 1949.
SECTION 2
This relinquishment and transfer does not include relinquishment
and transfer of the two (2) buildings comprising twenty (20) negro housing
units, situated on Pine Street in Beaumont, Texas, a part of the housing
project included in the relinquishment and transfer by the United States
to the City of Beaumont dated the 21st day of November, 1949, but such
negro housing units are hereby reserved.
SECTION 3
This relinquishment and transfer does not include relinquishment
and transfer of the United; States Government's contractural rights, title
and interest in and with respect to any government -mored personal property.
SECTION 4
- It is further provided that the net proceeds derived from the
housing units, hereby relinquished and transferred, shall always be devoted
to and used exclusively for the student seirVices fund of the Lamar State
College of Technology and for no other purpose.
SECTION 5
This ordinance shall take effect and be in-f-orce from and after the
30th day of June, 1951.
PASSED) this the 26th day of June, 1951, by the affirmative vote of
all members of the City Council of the.City of Beaumont, Texas.
