AN ORDINANCE
AN ORDINANCE AUTHORIZING THE VACATING AND CLOSING
OF FIFTH STREET.FROM 155 FEET SOUTH OF ST. JAMES
BOULEVARD TO THE SOUTH LINE OF SOUTHERLAND STREET,
AND ST. JAMES BOULEVARD FROM THE WEST LINE OF
FOURTH STREET WESTWARD.THROUGH.THE DIXIE GARDENS
THIRD_ADDITION, AND WESTMORELAND -AVENUE FROM.THE
WEST _LINE OF FOURTH STREET WESTWARD THROUGH THE
DIXIE GARDENS THIRD ADDITION TO THE CITY OF BEAU-
MONT, TEXAS.
WHEREAS, the owners of the property abutting Fifth
Street from one hundred and fifty-five (155) feet south of St.
James Boulevard to the South line of Southerland Street, and
St. James Boulevard from the west line of Fourth Street west-
ward through the Dixie Gardens Third Addition, and Westmoreland
Avenue from the west line of Fourth Street westward through
the Dixie Gardens Third Addition to The City of Beaumont, Jeffer-
son County, Texas, have requested that said portions of said
Streets be vacated and closed; and
WHEREAS, said petition has been referred to the City
Planning Commission for study, investigation and recommendation
to the City Council as to whether such proposal should be approved,
and the City Planning Commission has thoroughly studied and in-
vestigated said proposal and recommended to the City Council that
the approval of the proposal would be to the best interest and.
benefit of the public, and that said proposal should, therefore,
be approved; and
WHEREAS, . it is to the best interest of The City of Beau-
mont and benefit to the public that the above-mentioned streets
be vacated and closed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAU-
MONT, TEXAS:
THAT Fifth Street from one hundred and fifty-five (155 ) feet south
of St. James Boulevard to the south line of Southerland Street,
and St. James Boulevard from the west line of Fourth Street west-
ward through the Dixie Gardens Third Addition, and Westmoreland
Avenue from the west line of Fourth Street westward through the
Dixie Gardens Third Addition to The City of Beaumont, Texas, be,
and the same are hereby authorized to be vacated and closed,
and that the title to said vacated and closed streets shall re-
vert to and become the property of the parties entitled thereto,
as provided by law.

Subject: Closing of certain streets in Dixie'Gardens Third Addition
COMMENT:
At a meeting of the City Planning Commission on May 2, motion was
made and seconded that -Fifth Street from the south line'of Southerland
Street southward through Dixie Gardens Third Addition, St. James
Boulevard from the west line of Fourth Street westward through the
Dixie Gardens Third Addition, and Westmoreland Street from the west
line of Fourth Street westward through the Dixie Gardens Third Addition
be vacated and closed.
Kindly prepare ordinance for this coming Tuesday, May 8, 1951,
for Council approval.

HELD MAY 2, 1951
BE IT REUMBERED that the City Planning Commission of the City of Beaumont$
Texas met in special session on May 2, 1951, with the following present:

The meeting was called to order by Mr. Holland,: the Chairman. Minutes of the
meeting held April 25, 1951 were not read.-

Mr. K. C. Withers made a motion that the Planning Commission include in their
budget'f or the fiscal year of 1952 the cost of either an elevator or an
escalator for the City Hall. The motion was seconded by Mr: Stone, and
unanimously passed by the Commission.

Mr. K. C. Withers made a motion, seconded by C. E. Holland, that the City
Planning Commission recommend to the City Council, that Fifth Street from 1551
south of St. James Boulevard to the south line of Southerland Street, and St.
James Boulevard from the west line of Fourth Street westward through the Dixie
Gardens Third Addition, and Westmoreland Avenue from the west line of Fourth
Street westward through the Dixie Gardens -Third Addition be closed and vacated.
Passed by the Commission.
Mr. Phelps made a motion, seconded by Miss McCluskey, that the Planning
Commission recommend to the City Council that the alley through Block 1.1.,
Arlington Addition, Beaumont, Texas be closed and vacated. A petition was
presented to the Planning Commission showing signatures of all property owners
in Block 11 of the Arlington -Addition. Approved by the Commission.

There being no further business the meeting was adjourned by Mr. Holland.

Gentlemen:
The South Park School Board has practically closed a deal for the
purchase of blocks 2, 3, 4, 5 and the north half of blocks 8 and 9 of
Dixie Gardens Third Addition owned by the Burrus Lumber Company. This
land is bourd,, on the north by Southerland Street and on the east by
Fourth Street and on the south by an east and west line cutting blocks
8 and 9 in half by a line dropping south from a point 53.2 from the
south side intersection of Southerland Street and the Fannett Road.
This area of approximately 15 acres encloses a portion of Ste James
Street, Westmoreland Street and Fifth Street which are unimproved.
Itis requested that you cancel the dedication of that portion of
the Dixie Gardens Third Addition to the City of Beaumont which dedica-
tion and map are in Volume 8, page 69, of the Map Record in the office
of the County Clerk and also reflected by the dedication dated June 24, 1949
recorded in Volume 749, page 461, of the Deed Record of Jefferson County,
Texas, as well as the supplement to the dedication dated November 17, 1949
recorded in Volume 752, page 523, of the Deed Record of Jefferson County,
Texas,
The open streets in that portion of the addition which will be used
by the South Park Independent School District for school house purposes
would be dangerous -to the life and limb of the school children attending
school on said site. The streets which will be closed are dead-end
streets and will, in no way, be necessary or convenient to public travel
in that area.
