HomeMy WebLinkAboutORD 37-WAN ORDINANCE ENTITLED.AN ORDINANCE AUTHORIZING THE VACATING AND ABANDONMENT OF AN ALLEY RUNNING EAST AND WEST THROUGH BLOCK NINE (9), FROM SEVENTH STREET TO MINOR STREET, IN THE OAKS ADDITION TO THE CITY OF BEAUMONT, RESERVING, HOWEVER, THE RIGHT OF THE CITY OF BEAUMONT TO CONSTRUCT AND MAINTAIN IN SAID ALLEY SEWER LINES, WATER LINES, AND OTHER UTIL . ITIES, AND RESERVING THE RIGHT OF THE CITY OF BEAU- MONT TO GRANT AI FRANCHISE RIGHT TO OTHERS TO CON- STRUCT AND MAINTAIN THE UTILITIES HEREINBEFORE MENTIONED THROUGH AND ALONG SAID ALLEY, AND PRO- HIBITING.THE OBSTRUCTION OF SAME BY ANY.BUILDING OR STRUCTURE. WHEREAS, a petition signed by all of the property owners of the lots in Block Nine (9) between Seventh Street and Minor Street in the Oaks Addition to The City of Beaumont, has been presented to the City Council of The City of Beaumont, requesting that the 20 -foot alley running east and west from Seventh Street to Minor Street in this Block be vacated and abandoned; and, WHEREAS, said petition has been referred to the City Plan- ning Commission for examination and approval, and the same has been approved by said Commission; and, WHEREAS, said petition has been duly canvassed and exam- ined by the City Council and has been found to have been signed by all of the property owners in said Block, from Seventh Street to Minor Street, and it appearing to the City Council that the request of said property owners should be granted and that an ordinance should be enacted vacating and abandoning said alley, reserving, however, to The City of Beaumont the right to construct and maintain all necessary public utilities in said alley, or to grant a fran- chise for the construction and maintenance of such utilities in said alley; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF''BEAUMONT: That the alley running between Seventh Street and Minor Street in Block Nine (9) of the Oaks Addition to The City of Beaumont be, and the same is hereby, authorized to be vacated and abandoned, and that the title to such allep shall revert to and become the property of the owners of land in said Block bordering on said alley, as provided by law; provided, however, that the vacating and aban- doning of said alley shall in no way affect the right of The City of Beaumont to place and maintain therein sewer, gas, and water lines, telephone, telegraph, and electric wires, poles, and cables, or any other public utility service. Neither shall the vacating and abandoning of said alley affect the right of The City of Beaumont to grant a franchise to any person, firm, or corporation authorizing the placing and maintaining in said alley of such sew- er, gas, or water line, telephone, telegraph or electric lines, or other public utility service all of which rights are hereby ex- pressly reserved. And the vacating and abandoning of said alley shall not be construed as authorizing or permitting any person, party, corporation, or legal entity whatsoever to erect, construct, build, move onto or place any building or structure thereon, and the erection, construction, building, moving onto or placing of any building or structure therein without express permission from the City Council to do so is hereby prohibited. 1951. D. - Mayor - Beaumont, Texas, February 26th2 1951 TO THE HONORABLE OTHO PLUMMER, MAYOR, AND THE HONORABLE CITY COUNCIL OF BEAUMONT, TEXAS: We, the undersigned, being the owners of all of Block No. Nine (#9) of the Oaks Addition to Beaumont, Jefferson County, Texas, respectfully petition your Honorable Body to close the 201 alley running East and West through said Block$ from 7th Street to Minor Street.' That said alley is not used by anyone for any purpose at the present time; and that it is probable no one will.use it in the future. That said alley is unsightly and unsanitary, having grown up in weeds and being covered with trash. WHEREFORE, we pray your Honorable Body that suitable and proper order be passed by you, closing said alley and allowing the.,same to revert to the adjacent land owners. Respectfully Submitted, - r SPECIAL MEETING OF THE CITY PLANNING COIE4vvIISSION HELD MACH 21, 1951 BE IT REM-IBERED that the City Planning Commission of the City of Beaumont, Texas met in special session on March 21, 1951, with the folloyd.ng present: C. B. Holland, Chairman C. E. Holland, Vice -Chairman Russell Phelps Leonard Stone Miss Florence McCluskey, Secretary K. C. Withers kbsent; P. G. Matthews -000-- Others Present: R. Clyde Black, City Engineer Mr. K. C. Withers made a motion, seconded by Leonard Stone, that the Commission dispense with the reading of the minutes of the meeting held January 31, 1951 and proceed with the business at hando Passed by the Commission. Mr. Leonard Stone moved that it be recommended to the City Council that the alley in Block 9 of Oaks Addition to the City of Beaumont be closed and vacated. The motion was seconded by Kiss McCluskey and approved by the Commission. -000-- Mr. dithers made a motion that it be recommended to the City Council that the thirty foot alley adjacent to the Sabineand East Texas Railroad right -of way and adjacent to Track No, 10, Block No._ 24 of the Annie T. Marren Subdivision be closed and vacated. The motion vias seconded by Mr. Stone and approved by the Commission. -000- Mr. Leonard Stone made a motion that it be recommended to the City Council that the name of Pierce Street.,from-French Road to Voth Road in South Woodlawn iddition be changed to Redwood Drive. The motion was seconded by Mr. Phelps and passed by the_Commission. 'Mr. Stone presented the plat of Sunset Terrace Addition to the Commission and, moved that Sunset Terrace Addition be placed back on acreage basis. Mr. Stoners motion was seconded by Mr. C. E. Holland, and unanimously approved by the Commission. Me M. Tfire- ithers) Chairman of the Beaumont Housing Authority board$ presented plans for a two hundred unit public housing project for white families to the Commission. This housing project mill be located on property between Hale- and aleand Gill Streets., Fast of Magnolia Street. The plans were given approval by the Planning Commission.
