the City Council of the City of Beaumont has found and
determined, and hereby finds and determines that'in the public interest
it is advisable, expedient and necessary to issue serial bonds of said
City to provide funds to pay part of the cost of the project for the
elimination of grade crossings from public streets and highways of the
City of Beaumont, and work and expenses appertinent to -such separation
of grades, and of paying the cost of constructing storm sewers in con-
nection therewith, and paying the cost of opening, widening, extending
and improving the public streets and highways of the City of Beaumont
in connection therewith, since the presence of trunk line railroad
crossings at public streets of the City of Beaumont and numerous switch-
ing tracks traversing many of the streets of the City of Beaumont con-
stitute a constant hazard to the life and property of the inhabitants
of Beaumont and those travelling over such streets and highways, and
since the presence of such railroad tracks crossing and traversing the
streets and highways of the City of Beaumont effectually bottle up
traffic through the City,and between the various points in the City,
causing almost constant congestion of traffic and travel throughout the
City, and the elimination of such conditions is necessary to the public
welfare and for the protection of the lives and property of the in-
habitants of the City of Beaumont; and,
UHMMAS, the City Council of the City of Beaumont has formally ap-
proved the grade separation project as contained in the report, plans,
blueprints and estimates of cost thereof filed with the City Council by its
committee appointed to formulate such a plan; and,
WHOEAS, the City Council of the City of Beaumont further finds and
determines that the probable period of usefulness of the improvements for
which the bond funds are to be expended will be in excess of forty years;
now, therefore:
BE IT OFMAIM BY THE CITY OF BEAUMONT:
SECTION 1
That an election be held in the City of Beaumont, Texas, on Saturday,
August 12, 1950, which is not less than kifteen nor more than thirty days
from the date of the passage of this ordinance, at which election the follow-
ing proposition shall be submitted to the resident, qualified electors of said
City, who own taxable property in said City and who have duly rendered the
same for taxation, for their action thereon, and all electors shall vote in
the election precinct of their residence.
SECTION 2
The proposition to be submitted at said election shall be the following:
PROPOSITION
SEALS the City Council of the City of Beaumont, Texas, be authorized
to issue serial bonds of said City in the amount of four million dollars
($4,000,000) for the purpose of paying part of the cost of the project for
the elimination of railroad grade crossings from public streets and highways
----in the City of Beaumont,_nd work and expenses appertinent to said -separation
of grades, and of paying the cost of constructing storm sewers in connection
therewith, and paying the cost of opening, widening, extending and improving
the public streets and highways of the City of Beaumont in connection there-
with, said bonds maturing serially in such installments as may be fixed by
the City Council over a period of years, not to exceed forty years from their
date, bearing interest at a rate not to excedd four per cent (4%) per annum,
and shall there be annually levied, assessed and collected, while said bonds
or any of them are outstanding, an annual ad valorem tax on all taxable
property in the City of Beaumont sufficient to pay the interest on all of
said bonds and create a since fund sufficient to retire the same at maturity.
Said project shall be substantially as recommended in the report submitted to

the City Council by its committee and on file with the City Clerk; but the
City Council may authorize such changes as in its judgment may be necessary
for the efficient and economical accomplishment of such project. The probable
period of usefulness of the improvements for which the bond funds are to be
expended is more than forty years.
SECTION 3
The question as to whether or not the City Council of the City of
Beaumont shall be authorized to issue said serial bonds shall be submitted on
the ballot, and the ballots to be used in said election shall be printed and
furnished by the City of Beaumont, as provided by law, and each ballot shall
have printed thereon the following:

Each voter shall mark out black ink or black pencil one of the
above expressions on the ballot, thus leaving the other as indicating his
vote on such proposition, and the ballot shall be prepared in accordance with
Chapter 329, Acts of the 51st Legislature, R.S., Page 615, known as the Secret
Ballot Law, except where voting machines are used, in accordance with Acts of
1939, 46th Legislature, H.B. 1007, and all amendments thereto.
SECTION 5
Said election shall be held in each of the legal voting precincts of
the City of Beaumont, and the following places therein, respectively, are hereby
designated polling places in the following precincts of said City, and the fol-
lowing -named persons are hereby appointed officers of said election:

(1) In, voting precinct No. 1 said election shall be held at the
French High School Building, and. T. B. Hensley is hereby appointed
presiding judge to hold said election, with authority to appoint his
assistants and clerks.
(2) In voting precinct Nom.2 said election shall be held at the
Junker School Building, and Mrs. James E. Ray is hereby appointed presid-
ing judge to hold said election, with authority to appoint her assistants
and clerks.
(3) In voting precinct No. 3 said election shall be held at the
Gladys Street Fire Station, and Mrs. L. M. Coy is hereby appointed pre-
siding judge to hold said election, with authority to appoint her assist-
ants and clerks.
(4) In voting precinct No. 4 said election shall be held at the
Averill School Building, and W. F. Wilson is hereby appointed presiding
judge to hold said election, with authority to appoint his assistants
and.clerks.
(5) In voting precinct No. 5 said election shall be held at the
Beauwnt�High School Building, and Spencer Blain is hereby appointed pre-
siding judge to hold said election, with authority to appoint his assist-
ants and clerks.
() In voting precinct No. 6 said election shall be held at the
Dick Dowling Junior High School Building, and Mrs. E.. W.. Doty is hereby
appointed presiding judge to hold said election, with authority to appoint
her assistants and clerks.
(7) In voting precinct No. 7 said election shall be held at the
Central Fire Station, and Mrs. Geo. Rafferty is hereby appointed presiding
judge to hold said election, with authority to appoint her assistants and
clerks.
(8) In voting precinct No. 8 said election shall be held at the
City Hall, and D. H. Barnes is hereby appointed presiding judge to hold
said election, with authority to appoint his assistants and clerks.

(9) In voting precinct No. 9 said election shall be held at the
Fletcher School Building, and R. L. Brown, Jr., is hereby appointed
presiding judge to hold said election, with authority to appoint his
assistants and clerks.
(10) In voting precinct No. 10 said election shallbe held at the
Jefferson County Court House, and F. E. Carroll is hereby appointed pre-
siding judge to hold said election, with authority to appoint his
assistants and clerks.
MY In voting precinct No. 11 said election shall be held at the
David Crockett Junior High School Building, and F. L. Fisher is hereby
appointed presiding judge to hold said election, with authority to ap-
point his assistants and clerks.
(12) In voting precinct No. 12 said election shall be held at the
Ogden School Building, and Mrs. C. E. Drake is hereby appointed presiding
judge to hold said election, with authority to appoint her assistants and
clerks.
(13) In voting precinct No. 13 said election shall be held at the
Magnolia School Building, and E. A. Godwin is hereby appointed presiding
Judge to hold said election, with authority to appoint his assistants and
clerks.
(14) In voting precinct No. 14 said election shall be held at the
Charlton Pollard School Building, and Wilfred Como is hereby appointed
presiding judge to hold said election, with authority to appoint his
assistants and clerks.
(15) In voting precinct No. 15 said election shall be held at the
South Park Elementary School Building, and Mrs. John C. Burkhart is hereby
appointed presiding judge to hold said election, with authority to
appoint her assistants and clerks.
(16) In voting precinct No..16 said election shall, be held at
the Giles School Building, and Ray Matson is hereby appointed presiding
judge to hold said election, with authority to appoint his assistants
and clerks.
(17) In voting precinct No. 17 said election shall be held at the
Hebert School Building, and A. L. Price is hereby appointed presiding judge
to hold said election, with authority to appoint his assistants and clerks.
(18) In voting precinct No. 18 said election shall be held at the
Edwards School Building, and Mrs. C. C. Moore is hereby appointed pre-
siding judge to hold said election, with authority to appoint her assist-
ants

In voting precinct No. 42 said election shall be held at
the South Park High School Building, and G. W. Glezen is hereby appointed
presiding judge to hold said election, with authority to appoint his assist-
ants and clerks.
(47) In voting precinct No. 47 said election shall be held at
St. Anne's School Building, and Eugene L. Seale is hereby appointed presid-
ing judge to hold said election, with authority to appoint his assistants and
clerks.
(50) In voting precinct No. 50 said election shall be held at the
Azalea Gardens, and C. F. Cummins is hereby appointed presiding judge to
hold said election, with authority to appoint his assistants and clerks.
SECTION 6
Said election shall be held under the provisions of and in accord-
ance with the laws governing the issuance of municipal bonds in cities,
as provided.in the Constitution and General Laws of the State of Texas, and
the manner of holding said election and making returns thereof shall be
governed by the laws of the State of Texas governing general elections, and
in accordance with Acts of the 51st Legislature, R.S., Ch. 329, Page 615,
and Acts of 1939, 46th Legislature, H.B. 1007, and all amendments thereto;
and only qualified electors of said City who own taxable property in -said
City and who have duly rendered the same for taxation therein shall be
qualified to vote at said election, and all electors shall vote in the
election precinct of their residence.
SECTION 7
A copy of this ordinance, signed by the Mayor of the City of Beaumont
and attested by the City Clerk of the City of Beaumont, shall serve as
proper and sufficient notice of said election, and the Mayor is hereby direct-
ed to cause a substantial copy of said notice to be posted in each of the
election precincts within the City of Beaumont and at the City Hall, such
posting to be not less than fifteen full days prior to the date set for
said election, and he shall further cause said notice to be published on

the same day in each of two successive weeks in,a newspaper of general
circulation published in said City, the date of the first publication to
be not less than fourteen full days prior to the date set for said election,
and the person posting said notices shall make a return on the copy there-
of shoring the times and places of posting, and the return shall be filed
in the office of the City Clerk and shall be conclusive evidence of the
posting of said notices, and the affidavit of the publisher of the news-
paper, stating the days on which the same was published, shall be filed in
the office of the City Clerk and shall be conclusive evidence of the pub-
lication of said notice.

SECTION 8
This ordinance shall take effect from and after the date of its
PASSED this, the /:r4 day of July, 1950, by the affirmative vote
of a17members of the City Council of the City of Beaumont, Texas.
