AN ORDINANCE PROVIDING FOR DELETION OF A PORTION OF A CERTAIN
hUNICIPAL AGREEMENT COVERING THE CONSTRUCTION AIM MAINTENANCE OF THE
PORTION OF U. S. HIGIDVA.Y 90 AS RELOCATED ALONG AND NEAR BEECH STREET IN
THE' CITY OF BEAUMONT AS A FREh%AY AND AS A STREET; AND DECLARING AN
EMERGENCY AND PROVIDING THAT THIS 0—FcDINANCE SHALL BE EFFECTIVE FROM AND
AFTER ITS PASSAGEo
WHEREAS, on the 22nd day of November, A. Do, 1949, an ordinance
was passed by the City Council which authorizes the State of Texas to enter
upon and construct and maintain the portion of U. S. Highway 90 as relocated
along and near Beech Street; and authorizes the yo of the City to execute
for and on behalf of the City an agreement and contract with the State of
Texas in the form attached to the said ordinance and marked "Exhibit B"; and
WE REAS, the said agreement and contract containa a paragraph
numbered 12, which sets out a division of costs and responsibilities for the
construction and maintenance of lighting on frontage streets and the through-
way; and
WHEREAS, it is now desired that a decision in the matter of division
of cost of lighting frontage streets and the throughway be deferred until
plans for a phase of construction in which lighting work is involved are pre-
pared,
NaV THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL:
SECTION I. That paragraph No. 12 of the agreement and contract
attached as "Exhibit B" to the ordinance passed on the 22nd day of November,
A, DQ, 1949, be deleted; and a decision in the matter of the division of cost
of frontage street and throughway lighting be deferred; provided that when
plans are prepared for a phase of construction in which lighting work is
involved a separate lighting agreement will be executed,
SECTION 2, That no other clause or provision in said agreement or
contract shall be hereby waived or changed..
SECTION 3. The Mayor of the City, having requested in writing that
this ordinance take effect forthwith and there being in fact an emergency and
imperative necessity that the work provided for in the ordinance passed on
the 22nd day of November, A. D,, 1949, be begun and carried out promptly and
vrith expedition and that the aforesaid agreement or contract, as amended hereby,
shall be immediately made, executed and delivered to the end that the work
provided for may be begun and carried out promptly and with expedition. The
reading.of the ordinance on three several days is hereby dispensed with and
the same shall be in full force and effect from and after its passage&
PASSED by the City Council this 7th day of April, A. D., 1950.
