HomeMy WebLinkAboutORD 32-VAN ORDINANCE AN ORDINANCE AUTHORIZING THE VACATING AND CLOSING OF AN ALLEY APPROXIMATELY TWENTY (20).FEET IN WIDTH LO- CATED BETWEEN BLOCK TWENTY-ONE (21) OF THE OAKWOOD ADDITION.TO THE CITY.OF BEAUMONT.A ND THE NORTH RIGHT - OF -WAY -LINE OF THE KANSAS CITY SOUTHERN RAILROAD TRACK.. WHEREAS, the owners of the property abutting an.alley located between Block Twenty -One (2 1) of the Oakwood Addition to The City of Beaumont and the north right-of-way line of the Kansas City Southern Railroad track have requested that said alley be vacated and closed; and, WHEREAS, said petition has been referred to the City Planning Commission for study, investigation, and recommendation to the City Council as to whether such proposal should be approved, and the City Planning Commission has thoroughly studied and investigated said proposal, and recommended to the City Council that the approval of the proposal ,would be to the best interest and benefit of the pub- lic, and.that.said proposal should, therefore, be approved; and, WHEREAS, it is to the best interest of The City of Beaumont and benefit to the public that the above-mentioned alley be vacated and closed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: That the approximately 20 -foot -alley between Block Twenty -One (21) of the Oakwood -Addition to The City of Beaumont and the north right- of-way line of the Kansas City Southern -Railroad track be, and the same is. hereby, authorized to be vacated and closed, and that the title to said vacated and closed alley shall revert to -and become the property of the parties entitled thereto;: as provided by law. Clyde Black, City Engineer Subject: Closing Alley in Block 21 Oakwood Addition COMMENT: At the meeting of the City Planning Commission on March 24th, the closing of the alley in Block 21 of the Oakwood Addition was recommended to be closed subject to my approval. I recommend the closing of this alley and attached is the paper to be given the City Attorney to prepare a resolution for the Council. Yours very truly R. Black, City Engineer, Beaumont, Texas. Dear Mr. Black: Yesterday I inquired at your office regarding a petetion for closing of an alley between the South portion of Block 21 of the. Oakwood Addition and the K. C. S; railroad. I found that Mr. Duke was holding these papers for presentation before the PlAnning Commission. However, I am of the opinion that this request should clear through your office before going to the Planning Commission for consideration. Attached are the following: Petetion (two Copies) signed by property owners Letter from the R. C. S. Railroad dated February 21, 1950 signed by G. P. Williams, Assti to the President, signifying their compliance with this request. It is desired to close this street for the prospective purchaser plans to build a warehouse adjacent to the railroad. We shall greatly appreciate your consideration of this re- quest and would like to know when it is to be presented to the Commission as there is another matter we wish to take up with the planning Commission at its next meeting. Gentlemen: February 219 1950 C? � `L ,3,�, V It has come to our attention that owners of the property between Hemlock and Poplar Streets south ofFulton Street will petition the Cityto vacate a strip of land running 20 to 25 feet wide between Hemlock and Poplar Streets adjoining our Chaison Branch line xight of way -.on the north, which strip of land we understand was dedicated as a street but has never been improved nor used -as a street. Our company has mly a right of way easement for our tracks along this area, so that we are really not interested in this little strip of land, and have no objections to its being vacated.
