AN ORDINANCE AUTHORIZING THE VACATING AND CLOSING OF
A STREET OR ALLEY LOCATED.ADJACENT TO THE NORTH
RIGHT-OF-WAY LINE OF THE KANSAS CITY SOUTHERN RAIL-
ROAD TRACK BETWEEN POPLAR.AND HEMLOCK STREETS IN THE
CITY OF BEAUMONT, TEXAS.
WHEREAS, the owners of the property abutting a street or
alley adjacent to the north right-of-way line of the Kansas City
Southern Railroad track h.etween Poplar and Hemlock Streets in The
City of Beaumont, Texas, shown on the amended plat of the Oakwood
Addition to Beaumont, Texas, dated March 22,.,1920,_ and recorded in.
Volume 4, page 67.of the Map Records of Jefferson County, Texas,
have requested that said street or alley be vacated and closed; and,,
WHEREAS,, said petition has.been referred to the City Plana
ping Commission for study, investigation, and recommendation to the
City Council as to whether such proposal should be approved, and
the City Planning Commission has thoroughly studied and investigated
said proposal, and recommended to the City Council that the approval
of the proposal "'would be to the best interest and benefit of the
public, and that said proposal should,._therefore,, be approved; and,
WHEREAS.,: it is to the best interest of The. City of Beaumont
and benefit to the public that the. above-mentioned street or alley
be vacated and closed;
NOW, THEREFORE, BE IT -ORDAINED BY ,THE CITY OF BEAUMONT:
THAT the street or alley located adjacent to the north right-of-way
line of the Kansas City Southern Railroad track between Poplar and
Hemlock Streets in The City of Beaumont, Texas, be, and the same is
hereby, authorized to be vacated and elosed,.and.that the title to
said vacated and closed,street or alley shall revert to and become
the property of the parties entitled thereto, as provided by law.

Inclosed herewith are three copies of an ordinance Agreement and
four copies of an indemnification agreement between the State, the -
City and the Texas and New Orleans Railroad Company for the installation
of flashing light signals on College Street,
Please have the City Council pass the ordinance at their next meet—
ing and secure the signature of the Mayor on the indemnification agree—
ment,
After execution of these instruments please return two copies of
the ordinance and the original and two copies of the indemnification
agreement to this office for further handling. You may keep for your
files the copy of the ordinance marked "City Original" and the copy of
the indemnification agreement marked "City Reference Copy",
Following the execution of the indemnification agreement by the
State and Railroad Company, one fully executed copy will be returned
to you for your filese

On March 31, 1950 we forwarded to you three copies of a
City Ordinance and four copies of an indemnification agreement
to be executed in connection with the grade crossing protection
project proposed at the T. & N. 0. crossing on College Streeto
We are forwarding herewith three copies of "Exhibit B",
complete plans for the project, which is to be attached to.the
indemnification agreement. Please have Mayor Plummer sign
"Exhibit B" and return two copies to this office for further
handling, keeping one copy for your files.
