AN ORDINANCE
AN ORDINANCE AUTHORIZING THE VACATING AND CLOS-
ING OF THE UNNAMED AND UNOPENED PORTION OF A
STREET LYING EAST OF HILLEBRANDT BAYOU AND SOUTH
OF COLLEGE STREET, IN COLLEGE ACRES ADDITION TO
THE CITY OF BEAUMON`I'.
WHEREAS, the property owners abutting on an unnamed and
unopened.portion of a street lying east of Hillebrandt Bayou
and south of College Street in College Acres Addition to The
City of Beaumont have signed a petition asking that street be
vacated and closed, said unnamed and unopened portion to be
closed being described. as follows, to wit:
and,
Lying and being situated in Jefferson County,
Texas, beginning at an iron pipe at a point marked
the northwest corner of Lot 24., College Acres
Addition to the City of Beaumont, Jefferson County,
Texas; thence in an easterly direction 4.0 feet
to a point on the east right-of-way line of the
East bank of Hillebrandt Bayou drainage ditch;
thence along the said right of way 350.0 feet to
a point on said right of way, said point being on
the southernmost border -of said College Acres Ad-
dition; thence in an easterly direction 4.0 feet
to an iron pipe which is the southwest corner of
said Lot 24.; thence in a Northerly direction with
said West boundary line of Lot No. 24 to the said
Northwest corner of said Lot 24.. It is the in-
tention of petitioner to request the closing of
-3aid unopened street from the northwest corner of
Lot 24 across said street 4.0 feet to the right of
way of Hillebrandt Bayou drainage ditch; thence
in a southerly direction to the South border of
College Acres Addition; thence from that point to
the southwest corner of Lot No. 24 and North to
the northwest corner of Lot 24., according to the
plat of College Acres Addition recorded in the
Map or Plat Records of Jefferson County, Texas,
in Vol. 5, page 71, and .also Vol. 5, page 34., a
diagram of which is attached hereto and marked
"Exhibit A";
WHEREAS, -'said petition has been referred to the City Plan-
ning Commission for study, investigation and recommendation to
the City_Council as to whether such proposal should be approved,
and the City Planning Commission has thoroughly studied and

investigated said proposal and recommended to the City Council
that,the approval of the proposal would be to the best interest
and benefit of the public, and.that said proposal should, there-
fore,.be approved; and,
WHEREAS, it is to the best interest of The City of Beau-
mont and benefit to the public that the above described portion
of said street be vacated and closed;
NOW, THEREFORE, BE IT ORDAINED BY THE,CITY OF BEAUMONT:
That the unnamed and unopened portion of the street above de-
scribed be, and the same is hereby, authorized to be vacated and
closed, and that the title to said vacated and closed street
shall revert to and become the property -of the parties entitled
thereto, as provided by law.

TO THE PLANNING AND ZONING COMIgSSICN OF THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS:
Now comes Catherine O'Dell Iiorkan, petitioner herein, and
the present owner of Lot No. Twenty-four (24), College Acres
Addition to the City of Beaumont, Jefferson County, Texas, and res-
pectfully petitions said planning and zoning commission of the City
of Beaumont to close the unopened portion of a certain street herein-
after described, for the following reasons:
1. The portion of said street requested to be closed,
although dedicated to public use at the platting of College Acres
Addition to the City of Beaumont, Jefferson County, Texas, has never
been opened or used. Said dedication was made July 29, 1927, and some
twenty years have passed with no use being made of the hereinafter
described portion of said street.
2. The portion of said street requested to be closed lies
adjacent to the Voest boundary line of said Lot 24, of College Acres
Addition to the City of Beaumont, Texas, and adjacent to the East right
of way of H illebrandts Bayou drainage ditch. No other property is
affected by this unopened portion of the street other than that shown
on plat attached hereto.
3. The unopened portion of the street which petitioner prays
to be closed runs from College Street Extension to the City of
Beaumont, Texas, to the South boundary line of College Acres Addition.
No other addition adjoins College Acres Addition at this pont and
no street adjoins this unopened portion of the dedicated street
requested to be closed. The land adjoining the southern most end of
this dedicated street is unsubdivided acreage with no streets of any
sort runAing through same, and a letter from the adjoining land owner
agreeing to such closing is attached hereto.

4• The only person interested in the unopened portion of
this street are your petitioner whose land is affected thereby, the
Drainage District No. 6, and Hassell H. Horkan, whose waiver is -attached.
Said unopened portion of the street that petitioner prays to
be closed is described as follows:
Lying and being situated in Jefferson County, Texas,
beginning at an iron pipe at a point marked the northwest
corner of Lot No. 24,'College Acres Addition to the City of
Beaumont, Jefferson County, Texas; thence in an easterly
direction 40 feet to a point on the east right of Way
line of the East bank of Hillebrandts Bayou drainage ditch;
thence along the said right of way 350.0 feet to a point
on said right of way, said point being on the southern
most border of said College Acres Addition; thence in an easterly
direction.40 feet to an iron pipe which is the southwest corner
of said Lot 24; thence in a Northerly direction with said West
boundary line of Lot No. 24 to the said Northwest corner of
said Lot 24. It is the intention of petitioner to request
the closing of said unopened street from the northwest corner
of Lot 24 across said street 40 feet to the right of Way
of Iiillebrandts Bayou drainage ditch; thence in a southerly
direction to the South border of College Acres Addition; thence
from that point to the southwest corner of Lot No. 24 and
North to the northwest corner of Lot 24, according to the
plat of College Acres Addition recorded in the Map or Plat
Records of Jefferson County, Texas, in'Vol 5,. page 71, and
also Vol. 5, page 34, a diagrar, of which is attached hereto
and marked "Exhibit A ll .
WHEREFORE, YOUR PETITIONER PRAYS that the said Commission
approve the closing of this unopened portion of said street and do make
such recommendations as may be necessary to effect such closing to the
City Council of the City of Beaumont, Jefferson County, Texas.

TO THE PLANNING AND ZONE COMMISSION OF
THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS:
I, Hassell H. Horkan, being owner in fee simple of that portion
of land adjoining the rear of Lot Twenty-four (24), College
Acres Addition to the City of Beaumont, Jefferson County, Texas,
do hereby agree that the forty foot road right of way which is
unopened and unused joining Lot 24 of College Acres Addition
to the City of Beaumont may be closed in the event the said
commission approves the application ofAatherine O'Dell Horkan
to close same. Said land was purchase- from C. J. Cartwright et al, and is
.419 acres out of Block 23 of Co m /s Cartwright Subdivision No. 1 of
Beaumont, Jefferson County, Te as. !-7

The City Planning and Zoning Commission has recommended
the closing of the street east of Hillebrandt Bayou, south
of College Street Extension and adjacent to Lot 24 of College
Acres Addition. Will you please prepare the necessary
resolution for approval by the City Commission
I am attaching three copies of the excerpts from the Planning
and Zoning Commission meeting of April 12th and one copy of
the sketch.

HELD APRIL 12, 1948
"A motion was made by Mr. Stone that the Planning and Zoning.Commission
recommend to the City.Commidsion that the street east of Hil.lebrandt
Bayou, south of College Street Extension and adjacent to Spot 24 of Col-
lege Acres Addition be officially closed, This motion was seconded by
Ire Phelps and passed unanimously."
