AN ORDINANCE
ENTITLED AN ORDINANCE ORDERING AN ELECTION TO BE HELD
IN THE CITY OF BEAUMONT, TEXAS, ON THE 13th DAY OF SEPTEMBER,
1955, TO DETERMINE WHETHER OR NOT THE CITY COUNCIL OF THE CITY
OF BEAUMONT SHALL BE AUTHORIZED TO ISSUE.SERIAL BONDS OF SAID
CITY FOR THE PURPOSES AND IN THE AMOUNTS AS FOLLOWS: FIRE
STATION IMPROVEMENT BONDS IN THE AMOUNT OF $375, 000 FOR THE
PURPOSE OF BUILDING, IMPROVING, REPAIRING, :AND EQUIPPING FIRE
STATIONS, AND THE- PURCHASE OF NECESSARY -APPURTENANCES AND
APPLIANCES, AND ACQUIRING NECESSARY SITES THEREFOR, AND THE
LEVYING OF A TAX IN PAYMENT THEREOF; POLICE STATION IMPROVE-
MENT BONDS IN THE AMOUNT OF $200, 000 FOR THE PURPOSE OF CON-
STRUCTING, IMPROVING, ,REPAIRING.,.AND EQUIPPING POLICE STATIONS
AND APPURTENANCES, AND ACQUIRING NECESSARY SITES THEREFOR,
AND THE LEVYING OF A TAX IN PAYMENT THEREOF; STREET IMPROVE-
MENT BONDS IN THE AMOUNT OF $6,300, 000 FOR THE PURPOSE OF
OPENING, WIDENING, IMPROVING, EXTENDING, .AND REPAIRING THE
PUBLIC STREETS AND HIGHWAYS OF THE CITY OF BEAUMONT., AND THE
NECESSARY DRAINAGE THEREOF, AND THE LEVYING OF A TAX IN PAY-
MENT THEREOF; PARK IMPROVEMENT BONDS IN THE AMOUNT OF
$600, 000 FOR THE PURPOSE OF CONSTRUCTING IMPROVEMENTS UPON
AND PURCHASING EQUIPMENT FOR, ;PUBLIC PARKS FOR THE CITY OF
BEAUMONT, AND THE PURCHASE OF NECESSARY SITES THEREFOR, AND
THE LEVYING OF A TAX IN PAYMENT THEREOF; WATER SYSTEM REVENUE
BONDS IN THE F,A.MOUNT OF $5, 200., 000 FOR THE PURPOSE OF IMPROVING,
REPAIRING AND EXTENDING THE WATER SYSTEM OF THE CITY OF
BEAUMONT, AND PLEDGING THE REVENUES OF THE CITY'S WATER SYSTEM
TO THE PAYMENT THEREOF; FREEWAY IMPROVEMENT BONDS IN THE
AMOUNT OF $1, 500, 000 FOR THE PURPOSE OF ACQUIRING RIGHTS OF WAY,
OPENING, -IMPROVING AND EXTENDING APPROACHES AND ACCESS WAYS
TO THE FREEWAY, .PROVIDING LIGHTING THEREFOR, AND APPURTENANCES,
AND THE NECESSARY DRAINAGE THEREOF, AND LEVYING A TAX IN PAYMENT
THEREOF; SANITARY SEWER IMPROVEMENT BONDS IN THE AMOUNT OF
$750, 000 FOR THE PURPOSE OF IMPROVING, EXTENDING AND REPAIRING
THE SANITARY SEWER SYSTEM OF THE CITY OF BEAUMONT$ AND THE LEVY-
ING OF A TAX IN PAYMENT THEREOF; MUNICIPAL HOSPITAL IMPROVEMENT
BONDS IN THE AMOUNT OF $75, 000 FOR THE PURPOSE OF CONSTRUCTING
A CHILDREN'S WARD TO, AND IMPROVING AND REPAIRING THE MUNICIPAL
HOSPITAL, AND THE PURCHASE OF ADDITIONAL EQUIPMENT THEREFOR,
AND THE LEVYING OF A TAX IN PAYMENT THEREOF; MAKING CERTAIN
FINDINGS AS TO THE ADVISABILITY AND NECESSITY OF ISSUING SAID BONDS
AND MAKING THE IMPROVEMENTS CONTEMPLATED; NAMING THE TIME
AND PLACE OF HOLDING SAID ELECTION AND APPOINTING OFFICERS THERE-
OF; PROVIDING THE MANNER OF HOLDING SAID ELECTION AND GIVING
NOTICE THEREOF
WHEREAS, the City Council of the City of Beaumont, Texas, has found
and determined, and hereby finds and determines, that in the public interest it
is necessary,, expedient, and advisable to issue serial bonds of said City to
provide funds necessary for the public improvements herein mentioned; that
on account of the rapid increase in population of the City of Beaumont, the
opening of new subdivisions, and the building of additional houses and business
buildings and centers, it is necessary for .the protection of the property of the
inhabitants of the City from the hazards of fire that the fire department facilities
and stations be expanded to meet the pressing need; that the police station be
provided with additional improvements., that the police department have addi-
tional equipment to protect the public safety and welfare; and that the improve-
ment and extension and opening of streets and highways of the -City on account
of the increased hazard of traffic is necessary to protect the property, the
public safety,, and to promote the public welfare of the -City of Beaumont and
its inhabitants; that it is necessary to provide additional public parks and to
improve the public parks for the use of the people, and the children in particular;
that it is necessary to improve and extend the water system to meet the neces-
sities, not only of the properties of the people of the .City of Beaumont, but to
protect the health and welfare of its inhabitants; that it is necessary to acquire
rights of way and to build approaches and access ways to the freeway, and to
provide drainage and lighting therefor; that to protect the health of the inhabit-
ants it is necessary to extend and repair the sanitary sewer system to provide
sanitary sewers for tho-se not now serviced -with such, and to eliminate surface
toilets to prevent disease and epidemics; that it is necessary and advisable to
add a .children's ward to the municipal hospital, to make certain improvements
to the same and provide additional equipment therefor; and,
WHEREAS., the City Council finds that the City of Beaumont has power,
generally, to issue the serial bonds herein provided for, in accordance with
Article 1175, and amendments thereto, of Vernon's Civil Statutes, and under
Section 1, Article 10, of its Charter providing, "The City of Beaumont shall
have the right and power to borrow money on the credit of the City for permanent
public improvements and for any other public purposes consistent with the
constitution and laws of Texas"; and,
WHEREAS, the City Council has determined that revenue bonds should
be issued for the purpose of improving and extending said water system, said
bonds to be payable from and secured by a lien on the net revenues of said
system; and,
WHEREAS, it is recognized that there are outstanding waterwgr.ks-:-
revenue bonds payable from the net revenues of said system, said bonds being
dated September 1, 1947, and that additional bonds cannot be issued unless
either consent of the holders of the outstanding bonds is obtained thereto, or
refunding bonds are issued to refund such outstanding bonds; and,,
WHEREAS, either such consent will be obtained or such refunding bonds
will be issued, and the City Council finds that it is necessary in the public
interest to proceed with ordering the election for the issuance of said additional
water system revenue bonds, so that improvements and extensions can be
made to said system, said additional bonds to be issued so that they will be
in all respects on a parity with the then outstanding bonds payable from the
net revenues of the water system as such obligations now exist, or as same
may be refunded; and,
WHEREAS, the City Council of the City of Beaumont finds and determines
that it is expedient, beneficial, and necessary to keep pace with the rapidly
expanding growth of the City to construct the improvements mentioned in this
ordinance; now, therefore:
BE IT ORDAINED BY THE CITY OF BEAUMONT
SECTION 1
That an election be held in the City of Beaumont, Texas, on the 13th day
of September, 1955, which is not less than 15 days nor more than 30 days from
the date of the passage of this ordinance, at which election the following pro-
positions shall be submitted separately on the -ballot to the qualified electors
of said City who own taxable property in said City and who have duly rendered
the same for taxation, for their action thereupon.
SECTION 2
The first proposition to be submitted at said election shall be the following:
PROPOSITION NO. 1
SHALL the City Council of the City of Beaumont, Texas, be authorized to
issue serial bonds of said City in the amount of $375, 000 to provide funds for
the purpose of building, improving, repairing and equipping fire stations, and
the purchase of necessary appurtenances and appliances, and acquiring
necessary sites therefor, said bonds maturing serially in such installments
as may be fixed by the City Council, over a period of years not to exceed 25
years .from their date, bearing interest at a rate not to exceed 5% per annum;
and shall there be annually levied, assessed, and collected, while said bonds
or any of them are outstanding, an annual ad valorem tax on all taxable property
in the City of Beaumont, Texas, sufficient to pay the interest on all of said bonds
as it accrues and to create a sinking fund sufficient to retire the same at maturity?
The probable period of usefulness of the improvements for which this
bond fund shall be expended is more than 25 years.
The question as to whether or not -the .City Council of the City of Beaumont
shall be authorized to issue said serial bonds shall be -submitted separately
on the ballot, and the ballots to be used in said election shall be printed and
furnished by the City of Beaumont, as provided by law, and each ballot shall
have printed thereon the following:
FOR THE ISSUANCE OF THE FIRE STATION IMPROVEMENT BONDS
AND THE LEVYING OF A TAX IN PAYMENT THEREOF
AGAINST THE ISSUANCE OF THE FIRE STATION IMPROVEMENT
BONDS AND THE LEVYING OF A TAX IN PAYMENT THEREOF
SECTION 3
The second proposition to be submitted at said election shall be the
following:
PROPOSITION NO. 2
SHALL the City.Council of the .City of Beaumont, Texas, be authorized
to issue serial bonds of said City in the amount of $200, 000 to provide funds
for the purpose of constructing, improving, repairing and equipping police
stations and appurtenances., and acquiring necessary sites therefor, said bonds
maturing serially in such installments as may be fixed by the City Council,
over a period of years not to exceed 25 years from their date, bearing interest
at a rate not to exceed 5% per annum; and shall there be annually levied,
assessed and collected, while said bonds or any of them are outstanding, an
annual ad valorem tax on all taxable property in the City of Beaumont, Texas.,

sufficient to pay the interest on all of said bonds as it accrues and to create
a sinking fund sufficient to retire the same at maturity?
The probable period of usefulness of the improvements for which this
bond fund shall be expended is more than 25 years.
The question as to whether or not the City -Council of the City of Beaumont
shall be authorized to issue said serial bonds shall be submitted separately on
the ballot, and the ballots to be used at said election shall be printed and
furnished by the City of Beaumont, as provided by law, and each ballot shall
have printed thereon the following -
FOR THE ISSUANCE OF THE POLICE STATION IMPROVEMENT BONDS
AND THE LEVYING OF A TAX IN PAYMENT THEREOF
AGAINST THE ISSUANCE OF THE POLICE STATIQV IMPROVEMENT
BONDS AND THE LEVYING OF A TAX IN PAYMENT THEREOF
SECTION 4
The third proposition to be submitted at said election shall be the following:
PROPOSITION NO. 3
SHALL the City Council of the City of Beaumont, Texas, be authorized to
issue serial bonds of said City in the amount of $6, 300, 000 to provide funds for
the purpose of opening, widening, improving, extending, and repairing the public
streets and highways of the City of Beaumont, and the necessary drainage thereof,
said bonds maturing serially in such installments as may be fixed by the City
Council, over a period of years not to exceed 25' -years from their date, bearing
interest at a rate not to exceed 516 per annum; and shall there be annually levied,
assessed and collected, while said bonds or any of them are outstanding, an
annual ad valorem tax on all taxable property in the City of Beaumont sufficient
to pay the interest on all of said bonds as it accrues and to create a sinking fund
sufficient to retire the same at maturity?
The probable period of usefulness of the improvements for which this bond
fund shall be expended is more than 25 years.
The 'question as to whether or not the City Council of the City of Beaumont
shall be authorized to issue said serial bonds shall be submitted separately on
the ballot, and the ballots to be used in said election shall be printed and furnished
by the City of Beaumont, as provided by law, and each ballot shall have printed
thereon the following:
FOR THE ISSUANCE OF THE STREET IMPROVEMENT BONDS
AND THE LEVYING OF A TAX IN PAYMENT THEREOF
AGAINST THE ISSUANCE OF THE STREET IMPROVEMENT BONDS
AND THE LEVYING OF A TAX IN PAYMENT THEREOF
SECTION 5
The fourth proposition to be submitted at said election shall be the following:
PROPOSITION NO. 4
SHALL the City Council of the City of Beaumont, Texas, be authorized to
issue serial bonds of said City in the amount of $600., 000 to provide funds for
the purpose of constructing improvements upon, and purchasing equipment for,
public parks of the :City of Beaumont, and the purchase of necessary sites therefor,
said bonds maturing serially in such installments as may be fixed by the City -
Council, over a period of years not to exceed 25 years from their date, bearing
interest at a rate not to exceed 510 per annum; and shall there be annually levied.,
assessed and collected, while said bonds or any of them are outstanding,, an
annual ad valorem tax on all taxable property in the .City of Beaumont sufficient
to pay the interest on all of said bonds as it accrues and to create a sinking fund
sufficient to retire the same at maturity?
The probable period of usefulness of the improvements for which this bond
fund shall be expended is more than 25 years.
The question as to whether or not the City Council of the City of Beaumont
shall be authorized to issue said serial bonds shall be submitted separately on
the ballot, and the ballots to be used in said election shall be printed and furnished
by the .City of Beaumont, as provided by law, and each ballot shall have printed
thereon the following:
FOR THE ISSUANCE OF THE PARK IMPROVEMENT BONDS
AND THE LEVYING OF A TAX IN PAYMENT THEREOF
AGAINST THE ISSUANCE OF THE PARK IMPROVEMENT BONDS
AND THE LEVYING OF A TAX IN PAYMENT THEREOF
SECTION 6
The fifth proposition to be submitted at said election shall be the following:
PROPOSITION NO. 5
SHALL the -City Council of the City of Beaumont, Texas, be authorized to
issue serial bonds of said City in the amount of $5, 200, 000 to provide funds
for the purpose of improving, repairing, and extending the water system of the
City of Be aumont, said bonds .maturing serially in such installments as may
be fixed by the City Council, over a period of years not to exceed 25 years from
their date,, bearing interest at a rate not to exceed 5% per annum, said bonds
to be issued in accordance with and secured in the manner provided in Articles
1111 to 1118,, both inclusive, Vernon's Texas Civil Statutes, as amended; and
to secure the payment of the interest on said bonds as it accrues and the
principal of said bonds as it matures by pledging the net revenues from the
operation of the city's existing water system, each bond to be .conditioned that
the holder thereof shall never have the right to demand payment of said obliga-
tion out of any funds raised or to be raised by taxation?
The probable period of usefulness of the improvements for which this
bond fnnd shall be expended is more than 25 years.
The question as to whether or not the City Council of the .City of Beaumont
shall be authorized to issue said water system revenue bonds shall be submitted
separately on the ballot., and the ballots to be used in said election shall be
printed and furnished by the City of Beaumont, as provided by law, and each
ballot shall have printed thereon the following:
FOR THE ISSUANCE OF WATER SYSTEM REVENUE BONDS
AND THE PLEDGING OF THE REVENUES OF THE CITY'S
WATER SYSTEM TO THE PAYMENT THEREOF
AGAINST THE ISSUANCE OF WATER SYSTEM REVENUE BONDS
AND THE PLEDGING OF THE REVENUES OF THE CITY'.S
WATER SYSTEM TO THE PAYMENT THEREOF
SECTION 7
The sixth proposition to be submitted at said election shall be the following:
PROPOSITION NO. 6
SHALL the -City Council of the City of Beaumont, Texas,, be authorized to
issue serial bonds of said City in the amount of $1, 500, 000 to provide funds
for the purpose of acquiring rights of way, opening, improving and extending
approaches and access ways to the freeway., providing lighting therefor, and
appurtenances, and the necessary drainage thereof, said bonds maturing serially
in such installments as ;may be fixed by the City_ Council, over a period of years
not to exceed 25 years from their date,, bearing interest at a rate not to exceed
516 per annum; and shall there be annually levied, assessed, and collected,
while said bonds or any of them are outstanding, an annual ad valorem tax on
all taxable property in the City of Beaumont, Texas, sufficient to pay the interest
on all of said bonds as it accrues and to create a sinking fund sufficient to retire
the same at maturity?
The probable period of usefulness of the improvements for which this
bond fund shall be expended is more than 25 years.,
The question as to whether or not the City Council of the City of Beaumont
shall be authorized to issue said serial bonds shall be submitted separately on
the ballot, and the ballots to be used in said election shall be printed and
furnished by the City of Beaumont, as provided by law, and each ballot shall
have printed thereon the following:
FOR THE ISSUANCE OF THE FREEWAY IMPROVEMENT BONDS
AND THE LEVYING OF A TAX IN PAYMENT THEREOF
AGAINST THE ISSUANCE :OF THE FREEWAY IMPROVEMENT
BONDS AND THE LEVYING OF A TAX IN PAYMENT THEREOF
SECTION 8
The seventh proposition to be submitted at said election shall be the following:
PROPOSITION NO. 7
SHALL the City Council of the City of Beaumont, Texas., be authorized to
issue serial bonds of said City in the amount of $750, 000 to provide funds for
the purpose of improving, extending,, and repairing the sanitary sewer system
of the City of Beaumont, said bonds maturing serially in such installments as
may be fixed by the City .Council, over a period of years not to exceed 25 years
from their date, bearing interest at a rate not to exceed 5% per annum; and
shall there be annually levied, assessed and collected,, while said bonds or any
of them are outstanding, an annual ad valorem tax on all taxable properly in
the City of Beaumont, Texas, sufficient to pay the interest on all of said bonds
as it accrues and to create a sinking fund sufficient to retire the same at maturity?
The probable period of usefulness of the improvements for which this
bond fund shall be expended is more than 25 years.
The question as to whether or not the City Council of the -City of Beaumont
shall be authorized to issue said serial bonds shall be submitted separately on
the ballot, and the ballots to be used in said election shall be printed and
furnished by the City of Beaumont, as provided by law, and each ballot shall
have printed thereon the following:
FOR THE ISSUANCE OF THE SANITARY SEWER IMPROVEMENT
BONDS AND THE LEVYING OF A TAX IN PAYMENT THEREOF
AGAINST THE ISSUANCE OF THE SANITARY SEWER IMPROVEMENT
BONDS AND THE LEVYING OF A TAX IN PAYMENT THEREOF
SECTION 9
The eighth proposition to be submitted at said election shall be the following:
PROPOSITION NO. 8
SHALL the .City Council of the City of Beaumont, Texas, be authorized to
issue serial bonds of said City in the amount of $75, 000 to provide funds for
the purpose of constructing a children's ward to, and improving and repairing,
the municipal hospital, and the purchase of additional equipment therefor, said
bonds maturing serially in such.=installments as may be fixed by the City Council,
over a period of years not to exceed 25 years from their date, bearing interest
at a rate not to exceed 516 per annum; and shall there be annually levied, assessed
and collected, while said bonds or any of them are outstanding, an annual ad valorem
tax on all taxable property in the City of Beaumont,, Texas, sufficient to pay the
interest on all of said bonds as it accrues and to create a sinking fund sufficient
to retire the same at maturity?
The probable period of usefulness of the improvements for which this bond
fund shall be expended is .more than 25 years.
The question as to whether or not the City Council of the City of Beaumont
shall be authorized to issue said serial bonds shall be submitted separately on
the ballot, and the ballots to be used in said election shall be printed and furnished
by the City of Beaumont, as provided by law, and each ballot shall have printed
thereon the following:
FOR THE ISSUANCE OF THE MUNICIPAL HOSPITAL IMPROVEMENT
BONDS AND THE LEVYING OF A TAX IN PAYMENT THEREOF
AGAINST THE ISSUANCE OF THE MUNICIPAL HOSPITAL
IMPROVEMENT BONDS AND THE LEVYING OF A TAX IN PAYMENT
THEREOF
SECTION 10
Except where voting machines are used, concerning each proposition,
each voter shall mark out with black ink or black pencil one of the above express-
ions on the ballot, thus leaving the other as indicating his vote on such proposi-
tion.
SECTION 11
Said election shall be held in the following voting precincts in the -City of
Beaumont,, and the following -named persons are hereby appointed judges of said
election, with authority to select their clerks and assistants:
Precinct No. 1 At the Edwards School Building; and said election shall
be conducted at said voting box by Mrs. C. C. Moore, Judge.
Precinct No, 2 At the French High School Building, and said election
shall be conducted at said voting box by Jack Folmar, Judge.
Precinct No. 3 At the .French Elementary ,School Building, and said
election shall be conducted at said voting box by T. B. Hensley, Judge.
Precinct No. 4 At the Longfellow School Building, and said election shall
be conducted at said voting box by Albert Henry, Judge.
Precinct No. 5 At St, Anne's School Building, and said election shall be
conducted at said voting box by Mrs. W. T. McNeill, Judge.
Precinct No. 6 At the Beaumont High School Building,, and said election
shall be conducted at said voting box by Spencer Blain, Judge.
Precinct No. 7 At the Averill School Building, and said election shall be
conducted at said voting box by C. L. Rutt,, Judge.
Precinct No. 8 At the Junker School Building, and said election shall be
conducted at said voting box by Mrs. James E. Ray., Judge.
Precinct No. 9 At the Millard School Building, and said election shall
be conducted at said voting box by Miss Effie Piland, Judge.
Precinct No. 10 At the Dick Dowling Junior High School Building, and
said election shall be .conducted at said voting box by D. H. Barnes, Judge.
Precinct No. 11 At the Jefferson .County Courthouse, and said election
shall be conducted at said voting box by Tobe Hahn, Judge.
Precinct No. 12 At the George Washington Carver School Building, and
said election shall be .conducted at said voting box by W. W. Como, Judge.
Precinct No. 13 At the Magnolia School Building-, and said election shall
be conducted at said voting box by E. A. Godwin, Judge.
Precinct No. 14 At the .Ogden School Building, and said election shall be
conducted at said voting box by O. A. Ernest, Judge.
Precinct No. 15 At the David Crockett Junior High School Building, and
said election shall be conducted at said voting box by H. A. McDonald., Judge.
Precinct No. 16 At the Fletcher School Building, and said election shall
be conducted at said voting box by Charles H. McDonough, Judge.
Precinct No. 17 At Farm Machinery Co., Inc. , Store, 4530 College
Street, and said election shall be conducted at said voting box by Mrs. D. B.
Eberhard, Judge.
Precinct No. 18 At the Hebert School Building, and said election shall
be conducted at said voting box by. A. L. Price, Judge.
Precinct No. 19 At the Giles School Building, and said election shall be
conducted at said voting box by Ray V. Watson,, Judge.
Precinct.No. 20 At the L. R. Pietzsch School Building, and said election
shall be conducted at said voting box by Mrs. J. C. Burkhart, Judge.
Precinct No. 21 At the South Park High School Building, and said election
shall be conducted at said voting box by G. W. Glezen, Judge.
Any voter, otherwise a qualified elector, having paid his poll tax in any
of the above-described voting precincts and living in territory outside the limits
of the City of Beaumont, shall not be entitled to vote in said election.
None but resident, qualified electors who own taxable property in the City
of Beaumont, Texas, and who have duly rendered the same for taxation therein

shall be allowed to vote at this election.
A voting machine shall be provided for the casting of absentee ballots at
this election., and the place designated for the casting of absentee ballots shall
be at the ,City Hall in the City of Beaumont, Texas, and all those residing
within the City of Beaumont, Texas, qualified to vote at this election shall
be entitled to cast absentee ballots at said place, and said absentee voting
shall be conducted at said voting place by James T. Garrard., judge, with
authority to appoint his assistants and clerks.
SECTION 12
Said election shall be held under the provisions of and in accordance with
the laws governing the issuance of municipal bonds in cities, as provided in
the constitution and general laws of the State of Texas, and the manner of holding
said election and making returns thereof shall be governed by the laws of the
State of Texas governing general elections, and voting machines shall be used
in said election., in accordance with Article 7. 14 et seq, of the Election Code
of 1951, Acts of 1951, 52nd Legislature, Page 1097,, Chapter 492; and only

qualified electors of said City, who own taxable property in said City and who
have duly rendered the same for taxation shall be qualified to vote at said
election, and all electors shall vote in the election precinct of their residence.
SECTION 13
The City Clerk of the City of Beaumont is hereby directed to procure and
furnish the necessary ballots for said election and the necessary election supplies,
and immediately after said election has been held, the officers holding the same
shall make return of the results thereof to the City Council of the City of
Beaumont, Texas, as provided by law.
SECTION 14
A copy of this ordinance, signed by the Mayor of the .City of Beaumont and
attested by the City Clerk of the .City of Beaumont, shall serve as proper and
sufficient notice of said election, and the Mayor is hereby directed to cause one
each of said notices to be posted in each of the election precincts within the
City of Beaumont, and at the City Hall, such posting to be not less than fifteen
(15) full days prior to the date 'set for said election, and he shall further cause
said notice to be published on the same day in each of two (2) successive weeks
in a newspaper of general circulation published within said City, the .date of
the first publication to be not less than fourteen (14) full days prior to the date
set for said election. And the person posting said notices shall make a return
on the copy thereof showing the times and places of posting, and the return
shall be filed in the office of the City .Clerk and shall be .conclusive evidence
of the posting of said notice, and the affidavit of the publisher of the newspaper,
stating the days on which the same was published, shall be filed in the office
of the City Clerk and shall be conclusive evidence. of the publication of said
notice.
SECTION 15
This ordinance shall take effect from and after the date of its passage.
