ENTITLED AN ORDINANCE AMENDING SECTION 6 OF THAT CERTAIN
ORDINANCE: "ENTITLED AN ORDINANCE DEFINING CERTAIN TERMS,
DECLARING RAILRQAD CROSSINGS AT CERTAIN STREET INTERSECTIONS
AS DANGEROUS TO PEDESTRIANS AND VEHICULAR TRAFFIC; PRO-
HIBITING THE OPERATION OF ANY RAILROAD TRAIN ACROSS SAID
DANGEROUS CROSSINGS WITHOUT TRAIN -APPROACH SIGNALS AS DEFINED
HEREIN BEING MAINTAINED AND OPERATED; PROVIDING FOR THE FLAG-
GING BY TRAIN PERSONNEL OR RAILROAD EMPLOYEES OF OTHER CROSS-
INGS; PRESCRIBING A -PENALTY OF NOT LESS THAN $5 NOR MORE
THAN $200 FOR VIOLATIONS; PROVIDING.A SAVINGS CLAUSE; AND
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT,
OR CONTRARY THERETO," WHICH WAS PASSED.BY THE CITY COUNCIL
ON DECEMBER 22, 1953.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
That Section 6 .of an ordinance entitled:
"AN ORDINANCE DEFINING CERTAIN TERMS, DECLARING RAILROAD
CROSSINGS AT CERTAIN STREET INTERSECTIONS AS DANGEROUS TO
PEDESTRIANS AND VEHICULAR TRAFFIC; PROHIBITING THE OPERATION
OF ANY RAILROAD TRAIN ACROSS SAID DANGEROUS CROSSINGS WITH-
OUT TRAIN -APPROACH SIGNALS AS DEFINED HEREIN BEING MAINTAINED
AND .OPERATED; PROVIDING FOR THE FLAGGING BY TRAIN PERSONNEL
OR RAILROAD EMPLOYEES OF OTHER CROSSINGS; PRESCRIBING A PEN-
ALTY -OF NOT LESS THAN $5 NOR MORE THAN $200 FOR VIOLATIONS;
PROVIDING A SAVINGS'CLAUSE; AND REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES INCONSISTENT OR CONTRARY THERETO."
passed by the City Council on December 22, 1953, be, and the same is
hereby amended so that said Section 6 of -said ordinance shall read
hereafter as follows:
"If train -approach signals, as provided for in this ordinance,
are not in existence at any of the aforementioned dangerous
crossings at the effective date of.this ordinance, the railway
company operating railroad trains over said crossings shall
have until August 13.,. 1955, within which to install -said train -
approach signals'at said crossings, provided, however, it shall
be unlawful; at such dangerous railroad.crossings where said
train -approach signals do not exist at the effective date of
this ordinance, for any person to operate,. or permit to be oper-
ated, any railroad train at said crossings, without providing
for a flagman at said crossing to give notice of the.approach
of any railroad train; said flagman shall be stationed in the
center of said street or thoroughfare'at its intersection with -
the railroad track prior to the time the railroad train enters
the intersection of said street or thoroughfare. In the day-
light hours, said'flagman'shall havea red flag or signal de-
vice with the word."STOP" and at night said flagman shall carry
a lighted signal so as, to warn pedestrians and vehicles approach-
ing said crossing.

10, Section 4 of the Charter of the City
Of Beaumont, the ordinance shall take
effect and be 14 force from and after
