Article- I.
WORDS AND PHRASES DEFINED. "
Section 1. Definition', of Words and. Phrases.
(a) The following words and `phrases when' used -in" this ordi-
nanc.e `shall for the 'purpose of .this ordinance have the aeani3t.gs , re-
spectively ascribed to•them i:r this Article.
(b) Whenever any words and phrases. used` herein. reJrt'ot d? -
fined herein but are •def ined ' in-. the ' State laws, -;'regulating the op �k-
ation 'of vehicles, any -such 'definition therein shall b deemed to
.Y, apply to such words and phrases used herein,
Section- 2.', Vehcile-s' Traffic, -Etc., Defined. '
(a )- VEHICLE, .Every device - in;. upon- or by. which aAy person
or property' is or -may• be. transported or drawn upon. a high ray, ex-
cept .deuices moved by .human power or used exclusively upon station
ary rails',or, tracks. . .
(b:) MOTOR' VEHICLE: -Every vehicle which ,'is self-propelled
and every•vehicle'which:is propelled by electric' -power -obtained•
from overhead t-rolley wires;. but. not. operated upon rails.
(c) CONIMERCIAL.VEHICLE:-.,Every vehicle designed,'maintained,
or used primarily for.: the transportation • of property.
(d) AUTHORIZED M ERGENCY, VEHICLE. Vehicles of the Fire,De-
pairtment,-police vehicles, and such. -ambulances and emergency vehicles
of municipal departments or public se:rvic.e -corporations as are''de'-,
signated or �au:thorized, by the Chief of Police of this City-.
Section 3.
,(a) BICYCLE. Every device propelled by.human power upon
which any person.may ride,havin4 two - tandem wheels, either of which
is over twenty-(20),.inches.. in diameter, and including any -device
generally recognized 'as `a bicycle, though equipped with .two front or
two rear. wheels.
(b)' MOTORCYCLE. Every motor vehicle having a- saddle for--,the
use of the. -rider, and'de'signed'to travel on-not.more than.three
wheels, in contact with the, .ground, but excluding a .tractor.* The term
"motorcycle" shall include all forms of motorbikes.
Section'- 4.
(a) RAILROADS. A carrier - of -persons or property upon cars,
other'than_s.tree't.cars, operated'upon stationary rails.
(b) RAILROAD TRAINS. A --.steam enginei . 'electric or other
motor, with or.without:cars coupled thereto, operated upon rails-,
except street cars-. ;
Section 5. TRAFFIC. Pedestrians; ridden,or herded animals. ,."ve-
hicles, reetcars., and other, conveyances, -either singly or together,.
while ` using any street: for purposes of 'travel;

(b) TRAFFIC DIVISION. - A traffic :division of the police de-
partment -of this .city`:
Section 11. STREETS, .'ETC ., DEFINED. .
(a) STREET OR HIGHWAY.- The entire width between the- bound-
:ary, lines :of every.way publicly. 'maintained, when any part thereof.: is
open to the 'use- of the public for .purposes of vehicular travel .
(b) PRIVATE ROAD OR DRIVEWAY. ..Every way ,or place in private
ownership and_,used for'vehicular-',travel'„by,the owner and those having
express:or implied:permission from�the owner' but not by other persons.

= (c): ROADWAY. That portion of a. street or highway improved,
designed, or' o'rdinar"ily used :for ;vehicular . travel,, lexc•lusive of the
shoulder. In the event a.highway.includes two.'or'more separate

roadway separately but not to_.<all such ioadways-.collectively.

(c) ..CONTROLLED ACCESS:HIGHWAY.'-Every"highway, street or

determined by the public authority, having j.uri.sdiotion- over -such
highway, street or roadway.
Section 13. INTERSECTION.
(a) -,The area' embraced' within the' lateral -.-boundary lines
of the roadway" of two highways .which join, one another at or -approxi-

upon different, highways j:oiriing- ,at any other'angle, may come in con-
flict.

Section. 17.
(a) 'BUSINESS DISTRICT. The :territory contiguous to and

are building's in use for business and industrial purposes, includ-
ing but not limited to hotels-,, banks or office buildings, railroad -
stations, and public buildings which occupy at least 300' of front-

Article IT.
TRAFFIC ADMINISTRATION
Section 19. POLICE ADMINISTRATION. There is hereby established
in e' olice_Department of: this City."�:Traffi-c D-ivi_sion to be
under the control of an officer police appointed by and directly
responsible -to the. Chief .of Police: ;
Section '20. ' DUTY OF. TRAFFIC bIVISION; It shall. be . the: -duty of the

of the 1p6lice Depar-Lmont',-Lo :enforce the' street traffic ' regula•tions
of this_ City -and 'all -.of the State"ve'hi.cle laws applicable to street

investigate accidents, and co operate with'the City Traffic En-
gineer..and other officers of the- City.'in the administration of the
traffic laws ..and in developing ways- and means' 'to improve traffic,.
conditions, and to, carry. .out ..those duties specially imposed upon
said Division by this ordinance and the traffic ordinances of this"
,City. .
Section 21: TRAFFIC,"'DIV`ISIOl� :TO INVESTIGATE ACCIDENTS: It, shall
eerie duty of the. Traffic : Division, assisted. by.•other .police, of-
ficers of -the, department,. to investigate traffic accidents, 'to ar-
rest -,and to ,assist iri `the. prosecution °of thoso' .persons charged'
with violations of 'law causing or contributing'to such accidents.

Section 22. TRAFFIC, ACCIDENT STUDIES. Whenever the accidents at
any particular :location ,become .numerous, ,the ' Traffic Division shall
co-operate with•the City Traffic Engineer.in conducting studies.'.of,
such'accidents 'and determining remedial measures_.
Section -23 TRAFFIC ACCIDENT REPORTS. -'The- traffic division shall
maintain a suitable:..S.ystem_.of filin ' t.raf fic`. accident reports...Ac
cident• reports .or cards referring to them sha11 'be. . filed. alphabet-.
ically. by. location... Such .rep.o.rts . shall be available for the use
and nforniatibn of the City Traffic' Engineer:
Secti"on 24 . DRIVERS FILES ' TO-' BE MAINTAIivED
(a)' The Police Department -or'the Traffic Division thereof
shall maintain -a suitable record .of - all. traffic accidents, warnings,
arrests, ,convictions, and .complaints reported.`fo:r each driver,
'which shall be filed alphabetically, under' the „name .of thedriver. con-
cerned.
(b) _ ;Said division shall study the cases -'".6f all the drivers .
charged, with.frequent.or .serious violations, of._ the traffic laws or
involved in' frequent traffic accidents or any: serious accident, .and
shall attempt to discover the reasons therefor, . ,and shall take. what-. -
ever steps. are -lawful :and -reasonable ' to prevent the same _ or -to have
the licenses of such persons suspended,or revoked.
(c)•• .Succi" records shall -,accumulate during at least a five-
year period and from that time...'on, such "records shall be maintained

Section -25.. TRAFFIC •DIVISION TO' -,SUBMIT., ANNUAL TRAFFIC SAFETY RE-
PORT., he raffc.Division" shall:. arinvahly=submit a -traffic report
which "Shall .-.be filed tirith the City Tanager. :Such report. shall •con-
ta,in -'information on t'r`affic matters ;;-iri this- City•, as follows : (1)
The number of,'traffic -accidents, the= number of.."persons. killed,; the.
number of persons, injured. and other ,pertinent" traffic accident
data; (2)'The number ;of traffic acc-idents 'investigated and other
pertinent data on the safety :activities of the `police; (3) The .
plans and recommendations of "the division for:.future traffic safe-
ty activities..
Section 26. TRAFFIC, .DIVISION TO "DESIGNATE METHOD OF IDENTIFYING
FUNERAL PROCESSIONS-. _The_ -Traffic ,D.ivision shall .designate . a type
of"pennant or other identifying insignia -to be displayed upon, or
other,method to be " employed to identify,. the vehicles. in funeral -
processions, and', ,designate.routes.to be taken within the City
byfuneral processions...
Section 27: DEPARTMENT OF PLANNING AND TRAFFIC'ENGINEERING.
(a) The Department of Planning "and..Traffic .Engineering. is
hereby. established. '.The Director; -of this department shall also be
known' as the City Traf,fi=cEngineer.. ` ,H6 --shall be .a qualified e'ngi-, "
neer and shall, be appointed by the -City and he shall exer-
cise ". the- powers" and -:duties, as.:provided in :thi"s-: ordinance 'and in . the..
traffic, ordinances of'this Ci`ty.."
(b) I "•It - shall be : the" general" duty 'of the "City".Traffic ` En-
gineer to determine the'.instal""laton arid..proper.timing.and, mainfe-
nance of. -_traffic "control . devices, to., conduct . engineering analyses
of traffic accidents and to .'devise ,.remedial measures, to conduct
engineering . investigati'ons. of -trafficconditions "to plan the" open-
ation of traffic, on the' streets and highways of this City, and to
co-operate with other city officials in -the development of ways .and
means to improve traffic conditions, -'and' to carry out .the addition-
al powers and duties•'imposed' •.by'.ordinances of ".this' City:
(c) Whenever ,:and wherever -the' congestion of traffic, the :
dimensions ' -_0 . streets and :sidewalks, 'and -the use of .property
abutting' the' :streets 'a're such:`that :he' finds, "it":to- be necessary "for

(8) To designate spaces on the streets of the city
for exclusive -use as bus zones and to mark the same with appropriate
signs or marks.
(9) To designate areas on the streets of the City of
Beaumont which shall not be used as spaces for the parking of ve-
hicles and to mark such areas with the appropriate signs or markings.
(10) To designate intersections of streets at which
drivers operating vehicles approaching the intersection on one or
more of the intersecting streets must bring such vehicle to a com-
plete stop before proceeding into such intersection, and to install
and maintain appropriate signs and markings directing such drivers
to stop at such intersections.
(11) To designate intersections of streets at which
drivers operating vehicles approaching the intersection on one or
more of the intersecting streets must -reduce the speed of such ve-
hicle to not to exceed ten (10) miles per hour upon reaching such
intersection and continue at not more than such speed for a dis-
tance of one hundred (100) feet, and to install appropriate signs
and markings directing such drivers to reduce the speed of their
vehicles.
(12) To designate streets and portions of streets on
which drivers of -vehicles are prohibited from driving except in one
direction and to designate the direction in which driving is pro-
hibited and that in which driving is permitted, and to install ap-
propriate signs and markings designating such one-way streets.
(13) To designate the routes which must be followed
by commercial vehicles in using the streets of the City -of Beau-
mont; provided that no such vehicles shall be prohibited from using
any street for the purpose of going directly to or from any resi-
dential, commercial, or industrial establishment abutting on such
street.
(14) To determine and allocate parking time limits
on streets and portions of streets and place appropriate signs or
markings giving notice thereof.
(15) To designate intersections, the crossing of which
shall be controlled by red, green, and amber lights and arrows
as elsewhere herein provided, and to determine the type of such
lights or traffic control devices to be installed at each inter-
section and to cause the same to be installed,' and it shall be un-
lawful for any person to fail or -refuse to obey the instructions
transmitted by means of such lights or traffic control devices.
(16) To make such changes as changing conditions may
require in any designations determination, or regulation he is
herein authorized to make.
Section 28. Whenever he finds it is necessary to the public health,
comforts and safety, the City Traffic Engineer is hereby authorized
to designate areas of the streets of the City of Beaumont to be
known as "Quiet Zones" in the vicinity of any hospital, church,
school, or public institution and to mark such area with appropriate
signs directing the drivers of vehicles not to sound the horn or
other warning device while traveling in the area thus designated.

Section 29. Every regulation, designation, delineation, or deter-
minaTion promulgated by the City Traffic Engineer pursuant to the
authority granted in this ordinance shall, unless otherwise provided
herein, be described in writing, and after approval by the City
Manager, filed 'with the City Clerk of the City of Beaumont. Such
writing shall constitute.a public record and all persons shall be
charged with notice of the contents of same.
Section 30.The installation under the direction of the'City Traf-
fic ngineer of any traffic control device, sign, signal, or marking
provided for in.this ordinance shall cause to be effective the in-
struction.to pedestrians or drivers of vehicles transmitted by means
of such device, sign, signal, or marking.
Section 31_It being unlawful for any person other than the City
Traffic Engineer to install or_Cause to be installed any sign pur-
porting to direct the use of the streets or the activity on the
streets of pedestrians or vehicles, proof in any prosecution for vio-
lation -.of -this ordinance that any traffic control device, sign, sig-
nal, or marking was actually in place on any street iri the City of
Beaumont shall constitute prima facie evidence that the same was in-
stalled by the City Traffic Engineer pursuant to the authority here-
in granted.
Section 32. It shall be unlawful for any person krrow.ngly to fail
to observe or..obey-any instruction of any traffic control device,
signal light, sign, or marking installed as provided for in the pre-
ceding sections of this Article.
Section 33: EMERGENCY AND EXPERIMENTAL REGULATIONS.
(a) The Chief of Police by and_with the approval of the City
Traffic Engineer is hereby empowered to make regulations necessary
to make effective the provisions of the.traffic ordinance of this
City and to make and enforce temporary or experimental regulation's to
cover emergencies or special conditions. No such temporary or exper-
imental regulations shall remain in effect for more than ninety (90)
days. r
(b) The City Traffic Engineer may test traffic.control de-
vices under actual conditions of traffic.
Section 34. TRAFFIC COMMISSION, ITS POWERS ARID DUTIES.
(a) There is hereby established a Traffic Commission to
serve without.compensation, consisting of the Mayor, the City Manager,
the City Attorney, the Chief of Police,or in his discretion as his
representative, the Chief of thea Traffic Division, and the City Traf-
fic Engineer. The Mayor shall act as Chairman.
(b) It shall be the duty of the Traffic Commission to co-
ordinate.traffic activities, to carry on educational activities in'
traffic matters, to supervise the preparation and publication of
traffic reports and to recommend to the City Council and to the City
Traffic Engineer and the Chief of Police ways and means of improving
traffic conditions and the administration and enforcement of traffic
regulations.

Article III.
ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS
Section 35. AUTHORITY OF POLICE AND FIRE DEPARTMENT OFFICIALS.
(a) It shall be -the duty of the officers of the Police De-
partment, or such officers as are assigned by the Chief of Police
to enforce all.street traffic laws of this City and all of the State
vehicle laws applicable to street traffic in this'City.
(b) Officers of the Police Department, or such -'officers as
are assigned by the Chief of Police,.are hereby authorized to direct
all traffic by voice, hand, or signal in conformance with traffic
laws,'provided that in the event of a fire or other emergency or to
expedite traffic or to safeguard pedestrians, officers of the Police
Department may direct traffic as conditions may require notwithstand-
ing the provisions of the traffic laws.
(c) Officers of the Fire Department, when at the scene of a
fire, may direct or assist the Police in directing traffic thereat
or in the immediate vicinity.
Section 36. REQUIRED OBEDIENCE TO TRAFFIC ORDINANCE. It is a mis-
ec� meanor fofor any person. to . do any act forbidden or fail . to perform
any act required in this ordinance.
Section 37. OBEDIENCE TO POLICE AND FIRE DEPARTMENT OFFICIALS. No
person shall willfully fail or refuse -to comply.with any.lawful or-
der or direction of a Police Officer or of a Fire Department official.
Section 38. PERSONS PROPELLING PUSHCARTS OR RIDING ANIMALS TO OBEY
TWFFIC RMLATIONS. . Every.. person _propelling any pushcart . or- riding
an_animal upon.a roadway, and every person driving any animal -drawn
vehicle, shall be subject to the provisions of this ordinance appli-
cable to the driver of any vehicle, except those provisions of this
ordinance which by their very nature can have no application.
Section 39. USE OF COASTERS, ROLLER SKATES, AND SIMILAR DEVICES RE-
STRICT= 7N

S R C o person upon roller-skates,.or riding.in_or by means of
any.coaster, toy vehicle, or similar device, shall go upon any.road-
way except while crossing a street on a crosswalk and when so cross-
ing such person shall be granted all of the rights and shall be sub-
ject to all of the duties applicable to pedestrians. This section
will not' apply on any street while set aside as a play street as
authorized by ordinance of this City.

vviionso this ordinance shall apply to - the driver of any vehicle
owned by or.used in the service of the United States Government,
this State, County, or City, and it, shall be unlawful for any said
driver to violate any of the provisions of this ordinance, except as
otherwise permitted in this ordinance or by State Statute.
Section 41. AUTHORIZED EMERGENCY VEHICLES.
(a) The driver of*an authorized emergency vehicle, when re-
sponding to an emergency call or when in the pursuit of an actual or
suspected violator of the law or when responding to, but not upon re-
turning from, a fire alarm, may exercise the privileges set forth in
this section, but -subject to the conditions herein stated.

(b) The driver of an authorized emergency vehicle may:
(1) Park or stand, irrespective of the provisions of
this ordinance;.
(2) Proceed past a red or stop signal or stop sign,
but only after slowing down as may be necessary for safe operation;
(3) Exceed the prima facie speed limits so long as he
does not endanger life or property;
(4) Disregard regulations.governing'direction of move-
ment for turning in -specified directions.''
(c) The exemptions herein granted to an authorized emergen-
cy vehicle shall apply only when the driver of any said vehicle
while in motion sounds audible signal by bell, siren, or exhaust
whistle as may be reasonably necessary, and when the vehicle is
equipped with at least one.lighted lamp displaying a red light visi-
ble under normal atmospheric conditions from a distance of five hun-
dred (500) feet to the front of such vehicle, except that an author-
ized emergency vehicle operated as a police vehicle need not be
equipped with or display a red light visible from in front of the ve-
hicle.
(d) The foregoing provisions shall not relieve the driver
of an authorized emergency vehicle from the duty to drive with due
regard for the safety of all persons, nor shall such provisions pro-
tect the driver from the consequences of his reckless disregard of
the safety of others.
Section 42. OPERATION OF VEHICLES ON APPROACH OF AUTHORIZED EMER-
GENCY
ES..
(a) Upon the immediate approach of an authorized emergency
vehicle equipped with at least one lighted lamp exhibiting red light
visible under normal atmospheric conditions from a distance of five
hundred (500) feet to the front of such vehicle other than a police
vehicle when.operated,as an authorized emergency vehicle, and when
the driver is giving audible signal by siren, exhaust whistle or bell.
(b) The driver.of every other vehicle shall yield the right
of way and -shall immediately drive toa position parallel to, and as
close as possible to, the right-hand edge of curb on two-way streets
or nearestcurbon one-way streets or the roadway clear of any inter-
section and shall stgp and remain in such position until the author-
ized emergency vehicle has passed, except when otherwise directed by
a police officer.
Section 43. IMMEDIATE NOTICE OF ACCIDENT.. The driver of a vehicle
involved in an accident resulting.in.injury to or death of any per-
son or property damage to an apparent extent of twenty-five ($25.00)
dollars or more, shall immediately by the quickest means of communi-
cation give notice of such accident to the Police Department if such
accident occurs within this City.
Section 43.I.. WRITTEN REPORTS OF ACCIDENTS. The driver of a vehicle
which is iinany_manner involved in an -accident -resulting in injury
to or death of any person or total property damage to an apparent ex-
tent of twenty five ($25.00) Dollars or more, shall, within five (5)
days after such accident; forward a written report of such accident--
to
ccidentto the Police Department, or a copy of any report he is required to
forward_ to the ,State. The 'provisions of this section shall not be
applicable when .the accident has been.investigated at the scene by a
police officer while such driver was present thereat.

Section 43.2. WRITTEN ACCIDENT.'REPORTS CONFIDENTIAL, All written ac

dice to the individual so`reporting and shall be for,.th' confidential
use of the Police Department or other.governmental'agencies having iise.
for the records for accident prevention purposes,,.except that the Police
Department may disclose the identity of. a person .involved `in :-an accident
when such identity is not otherwise known or when'such person denies
his presence at such accident. No such report shall be used•as evidence
in any trial, civil:.or criminal, arising out of an°accident ,except that
the department shall furnish upon demand of.'any person who.has, or
claims to have, made such &- report or upon the demand" of- any court,., a,
certificate showing that a specified accident report has or has not been
made to the Police Department 'solely to prove a compliance or failure,
to comply with the requirements .that osuch a report ',.be made- to the -De-
partment..
Article IV.
TRAFFICCONTROL'.DEVICES.
Section 44. AUTHORITY'TO INSTALL TRAFFIC COI\TTROL' DEVICES..,,'The City
ra lc. ngineer,shall, with_the�dpproval of the_C ty.Manager,._pla'e
and maintain traffic control signs, 'signals" and devices when and as
required under the traffic ordinances of this City.:'t.o, make'.;effective
the provisions of said ordinances,,and mdy..place.and maintain such ad-,
ditional traffic control devices'as he may deem necessary to regulate
traffic under the traffic. ordinances of this .City :or under,State- law,
or to guide or warn traffic.
Section 4.5. MANUAL AND SPECIFICATIONS FOR TRAFFIC ;CONTROL DEVICES.
All traffic control signs,, signals, and devices shall' conform to the
manual and specifications-approved by the State Highway Commission of
the State of Texas. .All signs arid'signals required hereunder for a
particular purpose shall so far as practicable'be uniform 's to type.-
and location throughout the City.,, All traffic control devices so
erected and. not inconsistent with the provisions..of State..l'aw.or this
ordinance shall be official ' traffi'c control . devices..:
Section 46. OBEDIENCE TO , OFFICIAL 'TRAFFIC CONTROL DEVICES... The
river o any vehicle shall.obey.the instructions-of anyofficial traf-
fic control device -a' licable thereto, placed in accordance with the,
traffic-ordinances of this. City, unless otherwise directed.by a police
officer, - subj e.ct-to the exception's' granted the driver of an authorized
emergency vehicle.in this ordinance.
Section 47. WHEN IRAFFIC DEVICES REQUIRED FOR.ENFORCEMENT-PURPOSES.

Section 48. .TRAFFIC, CONTROL SIGNAL'LEGEND'. Whenever traffic is con-
rol .ecy. traffic. control: signals. exhibiting the words "Go",. "Caution",
or "Stop", or exhibiting different colored lights successively, one at
a time, or with arrows, the following-colors only shall be used and.
said terms and lights shall indicate and apply to drivers of',vehicles
and pedestrians as.,follows;
(a) Green'alone:or.„Go".
(1) Vehicular traffic facing the signal 'may proceed"
straight through or turn right or;left unless.a sign at such place
prohibits.-either such turn. But;'vehicular;traffic,.including vehicles.
.turning right or left, 'shalily''eld 'the, right of way to ,other vehicles

and to pedestrians lawfully within the intersection or an adjacent
crosswalk at the time such signal is exhibited.
(2) Pedestrians facing the signal may proceed across
the roadway within any marked or,.unmarked crosswalk.
(b) Yellow alone or "Caution" when shown following the
green or."Go" signal.
(1) Vehicular traffic facing the signal is thereby
warned that the red or "Stop" signal will be exhibited immediately
thereafter and such vehicular traffic shall not enter or be cross-
ing the intersection when the red or "Stop" signal is exhibited.
(2) No pedestrian facing -such signalfshall enter the
roadway until the green.or "Go" is shown alone unless authorized
so to do.by a pedestrian "Walk" signal.
(c) -Red alone , or "Stop".
(1) Vehicular traffic facing the signal shall stop
before entering the crosswalk on the near side of the intersection,
or, if none, then before entering the intersection and shall remain
standing until green or "Go" is shown alone.
(2) No pedestrian facing such signal shall enter the
roadway„until the green or."Go" is shown alone unless authorized so
to do'by a pedestrian "Walk” signal.
(d) Red with green arrow.
(1) Vehicular traffic facing such signal may cautious-
ly enter the intersection only to make the movement indicated by
such arrow but shallyield the right of way to pedestrians lawfully
within.a crosswalk and to.other traffic lawfully using the inter-
section.
(2) No pedestrian facing such signal shall enter the
roadway until the green or "Go" is shown alone,unless authorized
so to do by a,pedestrian "Walk" signal.
(e) In the event an official traffic control signal is
erected and maintained at a place other than an intersection, the
provisions of this section shall'be applicable except as to those
provisions which by their nature can have no application. Any stop
required shall be made at a sign or marking on the pavement indi-
cating where the. stop shall be made but in the absence of any such
sign or marking the stop shall be made at the signal.
Section 49. PEDESTRIAN -CONTROL SIGNALS. Whenever special pedestrian
control signals.exhibiting the -words "Walk" or "Wait" are in place,
such signals shall indicate as follows:
(a) Walk. Pedestrians facing such signal may proceed across
the roadway in the direction of the signal and shall be given the
right of way'by the drivers of all vehicles.
(b) Wait. No pedestrian shall start to cross the roadway in
the direction of such signals but any pedestrian who has partially
completed his crossing on the walk signal shail proceed to a side-
walk or safety zone while the wait signal is showing.
Section 50. FLASHING SIGNALS.
(a) Whenever an illuminated flashing red or yellow signal
is used in.a traffic sign or signal, it shall require obedience by
vehicular traffic as follows:
(1) Flashing red'(stop,signal): When a red lens is
illuminated with rapid intermittent flashing, drivers of vehicles
shall stop before entering the.nearest crosswalk at an.intersection
or at a limit line when marked, or, if none, then before entering
the intersection, and the right to proceed shall be subject to the
rules applicable after making a stop at a stop sign:
(2). Flashing yellow (caution signal). When a yellow
lens is illuminated with rapid intermittent flashing,. drivers of
vehicles may proceed through the intersection or past such signal
only with caution.
(b) This section shall not apply at railroad grade cross-
ings. Conduct of drivers of vehicles approaching railroad grade
crossings shall be governed by.the rules as set.forth in Section
Ido. 70 of this ordinance.
Section 51. DISPLAY OF UNAUTHORIZED SIGNS, SIGNALS, OR MARKINGS.
(a) No person shall place, maintain, or display upon or in
view of any highway, any unauthorized sign, signal, marking, or de-
vice which purports to be or is an imitation of or resembles an of-
ficial control device or railroad sign or signal, or which attempts
to direct the movement of traffic, or which hides from view or in-
terferes with the effectiveness -of any official traffic control de-
vice or any railroad sign or signal.
(b) No person shall place or maintain nor shall any public
authority permit upon any highway any traffic -sign or signal bearing
thereon any commercial advertising.
. (c) This section shall not -be deemed to prohibit the erec-
tion upon private property adja cent.to.highways.or signs giving use-
ful directional information and of a type that cannot be mistaken
for official signs.
(d) Every such prohibited sign, signal, or marking is here-
by declared to be a public nuisance and the authority having juris-
diction over the highways is hereby empowered to remove the same or
cause it to be removed without notice.
Section 52. INTERFERENCE WITH OFFICIAL TRAFFIC CONTROL DEVICES OR
RAILRD=GNS OR SIGNALS._.No person.shall-without.lawful authority
attempt -to. or .in fact alter, deface, injure, knock dorm, or remove
any official traffic control device or any railroad sign or signal
or any inscription, shield, or insignia thereon, or any other part
thereof.
Article V.
SPEED REGULATIONS.
Section 53. STATE SPEED LAWS APPLICABLE. The State traffic laws
regulating thespeed_of.vehicles_shall-be applicable upon all streets
within this city, except as this ordinance, as authorized by State

law, hereby declares and determines upon -the basis of engi-
neering and traffic investigation that certain speed regu-
lations shall be applicable upon specified streets or in
certain areas, in which event it shall be prima facie unlaw-
ful for any person to drive a vehicle at a speed in excess
of any speed so declared in this ordinance when signs are in
place giving notice thereof.
Section 54. INCREASING STATE SPEED LIMIT IN CERTAIN ZONES.
It as ere y determined upon the basis of an engineering and
traffic investigation that the speed permitted by State law .
upon the following streets is less than is necessary for safe
operation .of vehicles thereon by reason of the designation
and sign;., posting of said streets as through highways and/or
by reason of widely spaced intersections., and it is hereby,
declared that the -prima facie speed limits shall be as here-
inafter set forth on those streets or parts of streets herein
designated when signs are erected giving notice thereof:
Port Arthur Highway From the intersection of East
Virginia to tha south city -limits' in a north and south direc-
tion the prima facie speed limit shall be forty-five (45)'
miles per hour. ,.
Fannett Road. From the intersection of St. James Boule-
vard to:. ewes ci y limits in an east and west direction
the prima facie speed limit shall be forty-five (45) miles per
hour. - -
College Street. From the intersection of llth Street
to the west� city limits in an east and west direction the prima
facie speed limit shall be forty-five (45) miles per hour.
Calder Avenue. From the intersection of Lucas Drive
to the wes cx y imi.ts.in an east and west direction the
prima facie speed limit shall be forty-five (45) miles per
hour.
Eleventh Street. From the intersection of Ashley.
Street to7he north ci y limits in a north and south direction
the prima facie speed limit shall be forty-five (45) miles per
hour. From the intersection of College Street to the inter-
section of'Fannett Road in a north and south direction the
prima facie.speed limit shall be forty (40) miles per hour.
Section 55. MINIMUM SPEED REGULATIONS. It shall be unlawful
or any person . to so operate or _ drive -,any, -,motor or. other ve-
hicle upon the public highways, roads, or streets of this city
so as to willfully obstruct or impede the normal, reasonable,
and safe movement of traffic. Police officers are hereby
authorized to enforce the foregoing provision by directions to
drivers, and a willful disobedience to this provision shall be
violation of law punishable as provided in this ordinance.
Section 56. REGULATION OF SPEED -.BY TRAFFIC SIGNALS. The City
Traffic Engineer is- authorized to -.regulate the timing of traf-
fic signals so as to permit.the movement of traffic in an or-
derly; -and safe manner at speed slightly in variance from the
speeds otherwise applicable within the district or at intersec-
tions.
Section 57. SPEED OF TRAINS. It shall be unlawful.for any
engineer or other.person in,charge.of any electric, diesel,

gasoline motor or steam,locomotive or train to tun the same within
the corporate limits of this City at a greater rate of speed than
twenty .(20) miles per hour. .
Article VI.
TURNING MOVEMENTS.
Section 58. REQUIRED POSITION AND METHOD'OF TURNING AT INTERSECTIONS.

so as follows;
(a) RIGHT TURNS. Both the approach for a right turn and a
right turn shall be made .as close as'practical to the right-hand curb
or edge of the roadway.
(b) LEFT TURN ON TWO-WAY ROADWAYS. At an intersection where
traffic is permitted to move,in._both.directions on each roadway enter-
ing the intersection, anapproach for a left turn shall be made in
that portion of,the right half of the roadway nearest the centerline
thereof and by passing to the right of such centerline where it enters
the intersection.and after entering the intersection the left turn
shall be made so as to leave the intersection'to the right of the cen-
terline of the roadway being entered'. Whenever practicable the left_
turn shall be made in that portion of the intersection to the left of
the center of the intersection.
(c) LEFT TURNS ON OTHER'THAN TWO-WAY ROADWAYS. At any in
tersection where traffic is restricted to one direction on one or
more of the roadways, the driver of the vehicle intending to turn left
at any intersection shall approach the intersection in the extreme
left-hand lane lawfully available to traffic moving in the direction
of travel of such vehicle and after entering the intersection the left
turn shall be made so as.to leave the intersection, as nearly as prac-
ticable, in the left-hand lane lawfully available to traffic noving
in such direction upon the roadway being entered.
Section 59. AUTHORITY TO PLACE AND OBEDIENCE TO TURNING MARKERS.
(a) The City Traffic Engineer is authorized to place mark-
ers, buttons, or signs within or adjacent'to intersections indicating
the course to be traveled by vehicles turning at such intersections,
and such course'to be traveled as so indicated may conform to or be
other than as prescribed by law or ordinance.
(b) When authorized markers,,buttons, or'other indications
are placed within.an intersection indicating the course to be traveled
by vehicles turning thereat, no.driver of a vehicle shall disobey
the directions of such indications.
Section 60. AUTHORITY TO PLACE RESTRICTED TURN SIGNS. The City'Traf-
-ic ngineer is hereby authorized to determine those intersections at
which drivers of vehicles shall not make a right, left, or U-turn,
and shall place proper signs at such intersections. The making of
such turns may be prohibited between certain hours of any day and be
permitted at other hours, in which event the same shall be plainly
indicated on the signs or they may be removed when such turns are per-
mitted.
Section 61. OBEDIENCE TO NO -TURN SIGNS. Whenever authorized signs
are erected indicating that no right or left or U-turn is permitted,
no driver of a.vehicle shall disobey the direction of any such sign.

Section.62. LIMITATION ON TURNING AROUND. The driver of any such

direction upon any street in a business district and shall not upon
any other street,so turn a vehicle -unless such vehicle can be made
in safety and without interfering with other traffic.
Article VII.
SPECIAL STOPS_ REQUIRED.
Section 63. AUTHORITY T& DESIGNATE THROUGH STREETS. The City Traf-
fic Engineer is.hereby authorized.to.designate any. -.street as a through
street for the purpose of this section.
Section 64. AUTHORITY TO ERECT STOP SIGNS. It shall be the duty of
the City'-Traff3.c. Engineer to place _ and. maintain a stop sign on each
and everystreet intersecting a through street unless traffic at any
such intersection -'is controlled at all times by traffic controlled
signals, provided, however, that at the intersection of two such
through streets or at the intersection of a through street and a
heavy traffic street not so designated, stop signs shall be erected
at the approaches of either of said streets as may be determined by
the City Traffic Engineer upon the basis of an engineering and traf-
fic study.
Section 65, INTERSECTIONS WHERE STOP REQUIRED. The City Traffic
Engineer is hereby authorized to determine.and designate intersections
where particular hazard exists on other than through streets and to
determine whether vehicles shall stop at one or more entrances to any
such stop intersection, and shall erect a stop sign at every such
place where a stop is required.
Section 66.' SIGNS,TO BEAR.THE WORD "STOP". Every sign erected pur-
suant to is ,article shall. bear the-.word.:"Stop" in letters not less
than eight (8") inches in height and such sign shall.at nighttime be
rendered lumiiious by steady or flashing internal illumination, or by
a fixed floodlight projected on the face of the sign, or by efficient
reflecting elements upon the face of the sign. "Every stop sign shall
be located as near as practicable at the nearest line of the cross-
walk on the near side of the. intersection or,.if none, at the nearest
line of the roadway.
Section 67. VEHICLES TO STOP AT STOP SIGNS. When stop signs, are
erec ed as erein_authorized-.at.or.near.the entrance to any inter-
section, every driver of a vehicle approaching a stop sign shall stop
before entering the crosswalk on the near side of the intersection or
in the event there is no crosswalk, shall stop at a clearly marked
stop line, but if none, then at the point nearest the intersecting
roadway where the driver has a view ofapproaching traffic on the in-
tersecting roadway before entering the intersection except when dig
rected to proceed by a police officer or traffic control signal.
Section 68. EMERGING FROM ALLEY, -DRIVEWAY, OR BUILDING. The driver
of a vehicle within a business.or residence district.emerging from'an
alley, driveway, or building, shall stop such vehicle immediately
prior to driving onto a sidewalk or onto the sidewalk area extending
across any alleyway, yielding the right of way to any pedestrian as
may be necessary to avoid collision, and upon entering the roadway
shall yield the right of way to all vehicles approaching on said road-
way.

Section .77. V.EHICLES..SHALL : NOT BE DRIVEN. ON A` SIDEWALK. The 'driver

Said meters shall be.. capable of being.operated,- either automatically
or mechanically, upon.the deposit therein of an appropriate coin of
United States currency...`. The., City Traffic. Engineer shall time the
meters upon the, basis of,' an -engineering and traffic investigation' to .
best aid in the regulation, control,'and inspection.of_the parkin .,of-.-
vehicles. The. timing- anal type of operati'.on shall. `be one of the. fol-
lowing
(1) Penny meter, twelve -minute time ' limit.. Parking
-shall be: lawful for twelve minutes . upon "deposit of 'a one -cent coin.
(2) Penny-nickelprogressive meter, one hour.time
limit. Parking .shall be`lawful .for twelveminutes upon deposit, of a' .
one-cent.coinfor twenty-four minutes upon deposit of two one -cent
