AN ORDINANCE
ENTITLED AN ORDINANCE'TO REGULATE THE INSTALLATION,
REPAIR AND MAINTENANCE.OF OUTDOOR TELEVISION -ANTEN-
NAE WITHIN THE CITY OF BEAUMONT, TEXAS; PROVIDING
FOR THE CONDITIONS AND STANDARDS OF SAME, FOR -IN-
SPECTION -PERMITS AND INSPECTIONS.; AND PROVIDING
PENALTIES,MR.VIOLATION OF THE TERMS -THEREOF.
NHEREAS, it is necessary to provide for the better pro-
tection of life and property and in the interest of public safety,
the following rules and regulations be, and the same axe -hereby,
adopted for the installation, repair and maintenance of outdoor
television antennae within the City -of Beaumont,'Texas.
BE IT ORDAINEDBY THE CITY OF BEAUMONT, TEXAS:
SECTION I. Definitions. The following"definitions shall
apply.in the interpretation and enforcement of this ordinance:
(1). "ANTENNA INSPECTOR" shall mean the Antenna In-
spector of the City of Beaumont or any of his authorized assist-
ants, hereafter called Inspector.
(2) "ANTENNA" as'used in.this ordinance. -shall mean
the outdoor portion of the receiving equipment used for receiving
television from space.
(3) "MAST" shall mean that portion.of.the outside
antenna system to which the antenna is attached; and the support
or extension required to eleva-te.the antenna to a height deemed
necessary for adequate:operation.
(4) "HEIGHT" shall mean the overall vertical length
of the antenna system above the ground, or, if such system be lo-
cated'on a building, then above that part of the level of such
building upon which the system rests.
(5) "PERSON" shall mean and include any person, firm,
partnership, association,'corporation, company or organization of -
any kind.

SECTION :'II. PEP14IT REQUIRED. It shall be unlawful for
any person to install, repair or maintain, either as..owner or as
agent, servant or employee of the owner or as an independent con-
tractor for the owner, or otherwise, any outside television an-
tenna, any addition to, or substitution for, said antenna, unless
and until an inspection permit shall have first been obtained
from the Antenna Inspector.
SECTION III. FEES. An inspection fee.,of Two (�,�2.00)
Dollars shall be paid for each permit issued. A reinspection fee
of Two ($2.00) Dollars shall be paid for each trip when extra in-
spections are necessary due to any of the following reasons:
(1) Wrong Address.
(2) Condemned work resulting from faulty construc-
tion. -
(3) Repairs or corrections not made.
(4) Work not ready for inspection when called.
(5) Special installations where Inspector is called
prior to installation.
SECTION IV. APPLICATION DATA.. Application for permit
shall be -made upon blanks provided by the Antenna Inspector, and
shall contain or have attached thereto the following information:
(1) Name, address and telephone number of the owner
for whom to be made.
(2) 'Whether it is a new installation, repair or main-
tenance work.
(3) 'vJhether a television receiving antenna.
(4) Name of the persons making the installation.
(5) Such other information as the Antenna Inspector
shall require to show full compliance with this and all other laws
and ordinances of the City.
SECTION V. ANTENNA INSPECTOR - Duties, Rights and Powers.
(a) It shall be the duty of the Antenna Inspector
and his authorized assistants to inspect all television antenae to
ascertain if the work has been done in a workmanlike manner and to
investigate all complaints from the general public pertaining to
said antennae installations.
(b) The Antenna Inspector and his assistants are
hereby empowered to inspect or reinspect any wiring, equipment or
apparatus conducting or using,electric current for television

receiving service in the City, and if conductors, equipment or
apparatus are found to be unsafe to life or property the Antenna
Inspector shall notify the person owning or operating the hazard-
ous wiring or equipment to correct the condition within a forty-
eight -hour period or within the time the Antenna Inspector speci-
fies. Failure to correct violations within the specified time
shall constitute a violation of this ordinance.
SECTION VI. UNLAUFUL TO INTERFERE WITH ANTENNA INSPECTORS.
It shall be unlawful for any person to hinder or interfere with
the Inspector or his authorized representatives in the discharge of
their duties under the provisions of this ordinance.
SECTION VII. NOTICE FOR INSPECTION. The person to whom
a permit has been granted for the installation of a television an-
tenna shall immediately notify the Antenna Inspector when the work
covered by the permit has been completed and is ready for final in-
spection. Upon such notice, the Inspector or his authorized repre-
sentatives shall inspect and approve the installation if the work
complies in all respects with the provisions of.this ordinance and
the permit, and shall disapprove said installation if it.fails to
comply, stating in writing the reasons for disapproval and specify
a time within which said defects must be corrected. A reinspection
shall be made after notice to the Inspector that the defects have
been corrected.
SECTION VIII. TECHNICAL REQUIREMENTS. All television re-
ceiving antennae installations from and after the effective date
of this ordinance shall be made in accordance with the following
rules and regulations:
(a) Yeasts and antennae shall be of non-combustible-
and
on-combustible
and corrosive resistant material.
(b) Every mast and antenna installed on a roof shall
be mounted on its own platform or plate covering two or more

rafters of the roof and shall be securely anchored with guy wires.
(c) Masts and antennae shall not be fastened direct-
ly to the roof or supported by combustible members or materials.
(d) Outdoor antennae shall be of an approved type
and shall not exceed the maximum height of thirty (30) feet above
a roof support or seventy (70) feet above a ground support. In
areas where reception is affected by obstructions, special permis-
sion may be granted by the City Engineer to exceed the above
specified height limitations.
(e) Every antenna must be adequately grounded for
protection against a directional stroke of lightnirig,, with an
adequate ground rod.
(f) In no case shall the antenna be installed nearer
to the street, sidewalk, or power lines than the height of the
antenna plus ten (10) feet, unless approved by the City. No wires
shall pass over any public utility line or right of way.
(g) Wherever it is necessary to install an antenna
near power lines, or where damage would be caused by its falling,
separate safety wires must be attached as close as possible to the
antenna section. Intermediate wires shall be installed from an-,
tennae with height above fifty (50) feet and secured in a direction
away f rom the hazard.
(h) Anchor points for antennae, masts and guy wires
must be lead anchor screws or lead expansion shields drilled into
solid block, concrete or other noncombustible construction.
(i) Interior transmission lines must be kept at
least six (6) inches clear of telephone or light wires. Exterior
runs shall be at least twenty-four (24) inches from telephone or
electrical lines and no transmission shall cross over any public
line.
(j) Standoff support insulators must be used at least
every ten (10) feet in running the transmission line.

W Where television receiving antennae are installed
on a private residence, the antenna may be installed on the roof
of a frame structure provided the support and anchor screws are
securely fastened to the rafters or beams or other substantial
members, and provided, further, that no antenna installed on a
roof of a frame construction or in any way supported by material
of combustible construction shall exceed a height of thirty (30)
feet above the roof of the building, to be guyed at each ten (10)
feet or fraction thereof, using three (3) guys at each elevation
on mast. in case of three (3) point guys, the angle between guys
shall be 120 degrees plus or minus 10 degrees. Guy wire shall be
no less than 500# tensile strength -wire, 1/4" screw eyes or screw
hooks for anchors. (No rachet tighteners.) Two (2) guys on one
anchor. #8 copper or #f8 aluminum wire to ground mast to a six
(6) foot copper or copper aluminum ground rod, using proper ground
clamp. No other ground will be allowed. Turnbuckles to be locked
by returning end of make up back through turnbuckle and serve back
on guy wire.
y^'here guy wires are run over service drops (less than 480
volts) a minimum of forty-eight (48) inches shall be maintained
between the guy wires and service wires. In this case the section
of guy wire crossing the service wire shall be isolated by a
strain insulation on each side of the crossing.
Poles used for electric power and communication lines
shall not be used for supporting or for guying any antenna system.
Deadmen for guys shall be a minimum of 1-1/2 inch galvan-
ized pipe for antennae 30 to 49 feet high, two (2) inches for an-
tennae 50 to 59 feet high, and 2-1/2 inches for antennae 60 to 70
feet high. Deadmen to be set in three (3) feet of concrete with
a diameter of eight (8) inches. A ground clearance of six and a
half (6-1/2) feet shall be maintained.

(1) Lightning arresters shall be approved as safe by
the Underwriter's Laboratories, Inc., and both sides of the line
must be adequately protected with proper arrester or neon lamps
to remove static charges accumulated on the line, also, on rotor
lead for saf ety.
(m) When leadin conductors of polyehylene ribbon type
are used, lightning arresters must be installed in each conductor.
(n) When co -axle cable or shielded twin lead is used for
leadin, suitable protection may be provided without lightning ar-
resters by; grounding the exterior metal sheath.
(o) Antennae shall be designed and installed to withstand
a wind pressure of thirty (30) pounds per square foot and in no
case shall guy wires be less than 500# tensile strength cable,
galvanized.
(p) Ground wires shall be of the type approved by the
1951 issue of the National Electrical Code for grounding masts and
lightning arresters, and shall be -installed in a mechanical manner
with as few bends as possible.
(q) Ground clamps for grounding masts and attaching ar-
resters to ground rod shall be approved ground fitting - no other
ground allowed.
(r) The miscellaneous hardware,,such as brackets, turn-
buckles, thimbles, clips and similar type equipment subject to rust
or corrosion, shall be protected witha zinc or cadmium coating by
either galvanizing or sherardizing process after forming. These
finishes are selected to guard against corrosion due to stack gases
and other deposits and to protect the elements against electrolytic
action due to the use of adjoining dissimilar metals.
(s) Turnbuckles shall be protected against turning by
threading the guy wires through the turnbuckle.
(t) Temporary antenna installations: The Antenna Inspect-
or is authorized to issue permits for temporary installations,

having due regard for all safety factors involved. A temporary
permit shall not be issued for more than ninety (90) days.
(u) Mon -guyed antennae masts or towers; Permits
for the erection of non -guyed antennae, towers or masts, are auth-
orized when above -ground height does not exceed fifty (50) feet.
(v) Permits for towers in excess of fifty (50) feet
may be issued upon approval of City Engineer.
SECTION IX. MATERIALS TO BE APPROVED TYPE. No electrical
materials, devised or equipment designed for attachment to or in-
stallation -of any electrical circuit or system for television an-
tennae shall be installed, used, sold, or offered for sale for use
in the City of Beaumont, unless they are in conformity with the
approved methods of construction for safety to life and property,
and unless the electrical mate_rials,devices or equipment conform
with the standards of the Underwriters' Laboratories, Inc. current
as of the time of installation. All masting material shall be a
minimum of 16-guage and -the top section shall have a minimum out-
side diameter of 1-1/8 inches:
SECTION X. IUIKER' S NAME, ETC . , REQUIRED Oil EQUIP -HENT .
The maker's name, trademark, or other identification symbol shall
be placed on all electrical devices or equipment that use 115 volts
or more which are sold, offered for sale or use, or used in the
City of Beaumont. These markings and others, such as voltage,
amperage, wattage, and power factor, or appropriate ratings de-
scribed in the 1951 edition of the National Electrical Code, shall
be required, and are necessary to determine the character of the
material, device or equipment, and the use for which it is intended.
SECTION
XI.
P+'MINOR REPAIRS WITHOUT PERMIT.
Notwithstanding
anything herein
to
the contrary, minor repairs to
antennae may be
made without the necessity of a permit, provided, however,.that a
prompt report thereof is made to the Antenna inspector showing the
extent thereof. Should an investigation of said minor repairs by

the Inspector disclose defects, the same shall be pointed out
and corrected as required.
SECTION XII. CODES SUPPLETMENTAL TO THIS ORDINANCE. The
1953 issue of the National Electrical Code, as the same may be
amended, before the adoption of this ordinance, is hereby adopted
and approved as a part of this ordinance as a minimum standard.
The provisions of this ordinance shall also be deemed as supple-
mental to the Electrical and Building Codes of the City of Beau-
mont and any other pertinent law or ordinances of the City, and
all work shall conform to these requirements.
SECTION XIII. PROHIBITING CERTAIN INSTALLATIONS IN AUTO-
111OBILES. It shall be unlawful for any person to install a tele-
vision set forward of, or which is visible from, the front seats
of any motor -operated vehicle. Otherwise, the provisions of this
ordinance shall apply to'automobiles.
SECTION XIV. AUTHORIZING ADDITIONAL RULES. In order to
take advantage of progress and change in the industry, the Ant.enna
Inspector may consult with members of the industry and other qual-
ified persons and may put into effect reasonable rules and regula-
tions not in conflict with the provisions of this ordinance.
SECTION XV. PENALTIES. Any person violating any of the
provisions of this ordinance shall be deemed guilty of a misde-
meanor and upon conviction thereof shall be fined not less than
Five ($5.00) Dollars nor more than One Hundred ($100.00) Dollars,
Each day such violation is committed or permitted to continue
shall constitute a separate offense and shall be punishable as
such hereunder.
SECTION XVI. SEPARABILITY. If any section, subsection,
sentence, clause, phrase or portion of this ordinance is for any
reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision, and such holding shall not affect the

validity of the remaining portions thereof.
