Levying and assessing as a'tax -upon the -lots; parts of lots,"
blocks., or tracts of land where not -divided into, lots' or� blocks
fronting on Fannin Street from Bark Street to Victoria Street- -.2-L /3
of the cost of paving and gutter and" --incidental drainage- and 0-1(
of the
he cost",of curbing said Pannin-Serest_ from Park- Street to
Victoria S-treet apportionable to the hereinafter referred to
'property; and declaring said tax a lien upon said property -and.a
personal debt upon the owner or owners thereof,. and providing- a time
when said tax shall become due and 'payable, providing for 'the, --
collection of same and all costs incurred'it such collection if not
paid at the -time it becomes due and payable; and providing the.'rate
of interest said tax shall .bear from the time it becomes -due until
paid; and declaring -an emergency:
WHEREAS-,, pursuant to the requirements of 'Sub -division h of
Section 68 of the Charter of the City of Beaumont, the City Commission
of the City of Beau'moint caused to, be published, for the time - and in,
the manner required therefor by the City Charter., a notice of, -a
Resoluti6il of.saidcommissionpassed'-heretofore on the .29th day of
May D. 1-923 'ordering a:hearing to be given to the.persons; firms#
corporations or estates, their agents -or -attorneys owning --the following
property abutting on Fannin Street frbm or,-attorneys
Street .to Victoria Street,
to -wit : lots 1- 2 and 3, 'of block 3,, of'the N.A , McMillian Additioh
to the City'of'Bdaumontj same fronting 160 feet ;n the no"rthwest side-:'
of said street; and lots 7, 8, and 9, -in Block g3, of. the Van Wormer
Addition to the -City of Beaumont, same fronting 150 -feet on the southeast
side of said Fannin Street; and lots 7, 81 9; 10 mid ll,,in block -56

interested in said matter, to. appear and show -cause in conformity vdth
the provisions of the Charter above referred -to, why the, assessments
in said notice should not be made against said property and- said owners -
thereof, which hearing was to be held -1n. the Council Chamber of the
City Hall of Beaumont, Texas,, at 100.00 O'clock A.M. on JVne 16th'

AND, WHEREAS, 6, full and fair hearing -in conformity with. the
Charter and the'law in -such cases haiwing been had in conformity with
said notice, and the Commission having inquired into and determined
all facts necessary to the adj-adication.of all special benefits
accruing to such owners. by means of such improvements.;
And it appearing that the assessments as proposed -'in such
Resolution passed on the 29th day of May,, -A, --D. 1923, are in all
respects fair and equitable, and that there will be & full and
adequate and special benefit to- the abutting property and the ovin"ers
thereof- from -and --by reason of the proposed pavement and improvement
in excess of ' -the amo-unt'assessed-against the abuttii*,,px�opeity

That there is hereby assessed against the aforesaid several owners of
poppoxty and against their said respective property abutting upon
Fannin street from Park Street.toVictoria Street in the City of
Beaumon-t,an a tax agailist, each such property owner his respective'

gutter and all incidental -drainage and all costs of cU.rbing .
on said Fannin Street from Park Street to Victoria Street, -
The lot, lots, parts of lots, blocks or tracts of land
on which said tax is levied and assessed is here%nafter describedl,'
together with the number of feet front on such lot, -parts-of lots;
blocks or tracts _of land; the name or names of the owner or owners
thereof and t e o donate amount o f the cost of said paving
and gutter, anos o said curbing to be born and paid for
by such owner or owners -as shown by the statement prepared by the
City Engineer of the City of Dearmont, which said amount is -hereby
levied and assessed as a tag upon such lots, parts of lot; blocks
or tracts of land as shown, to wit:

SECTION 2:
That said tax so levied and assessed shall become due and
payable upon the completion. of the paving upon the portions' of
said streets, upon which said lot, lots, parts of lots, -blocks
or tracts -of land front and abut, and the amount of the tax here—
by levied and assessed'together with the cost of collecting, same --
and seven.per cent per annum from the date same is collectible
m.1til paid hereby declared a lien against the -said lot, lots;
parts of lots, blocks or tracts of land, superior to all other -
liens, claims or title except city, county and state taxes, and
shall- constitute a personal eharg:e or claim against the owner or
owners of the said lots, parts of lots, -blocks or tracts of land:
-SECTION 30
The fact that the foregoing portions of streets are in bad
condition and badly in need of paving in order to facilitate the
heavy traffic over same creates -an emergency and an -imp erative --
public necessity necessitating- the suspension of the rule requiring
ordinances to be read on three separate meetings; said.rule is
therefore hereby suspended and this ordinance shall take effect
and be in full force and effect fromn�and.after its passage and
