AN ORDINANCE.
ENTITLED an ordinance prohibiting the building,
construction, repairing, alteration or remodeling
of any bridge, viaduct, wharf, dock, pier or/and
any other structure of any character whatsoever in
or across the Neches River .within the limits of the
Harbor of the City of Beaumont, without first ob-
taining a permit so to do from -the City Commission
of thenCity of Beaumont.; providing for the applica-
tion for and the granting of permits for the purpose;
providing for pains and penalties for the violation
of the provisions thereof; declaring an emergency
and providing that said ordinance shall take effect
from the date of its passage.
BE- IT ORDAINED BY THE CITY COLUESSION
OF THE CITY OF BEAMffiNTt
SECTION 1.
That it shall be unlawful from and after the
passage of this ordinance for any person, firm, association
of persons or corporation to build, construct, repair, alter,
or remodel any bridge, viaduct, wharf, dock, pier, or/and
any other structure of any character whatsoever in or across
the Neches River within the limits of the Harbor of the City
of Beaumont as such limits are defined in that certain or-
dinance enacted by the City Commission of the City.of
Beaumont on the day of A.D., 1921with-
out first obtaining a permit so to do from the City Commission
of the City of Beaumont.
SECTION 2.
That .any. person,, firm, -,.association of -persons,
or corporation desiring or proposing to build, construct,
repair, alter or remodel any such structure within said
limits shall make written application for a permit so to
do addressed to and filed with the'City Commission of the
City of Beaumont, which application shall be apeompanied
with drawings, plans, specifications and full particulars
of the work or improvements proposed, whereupon the City
Commission shall within a period of not more than sixty
days from the date of the filing of said application and
said drawings, plans, specifications and particulars,
make thorough investigation of and give due consideration
to said application, with due regard for the rights of
the applicant and the interests and safety and convenience
of navigation upon said river within said Harbor limits
and if after said investiagtion and consideration it is
the judgment of the City Commission that the proposedr
work or improvement will not obstruct, impede or in any
otherwise interfere with navigation within the said
Harbor limits upon said stream, the pe3?&it applied for
shall be granted, otherwise the same shall be refused.
SECTION 3.
That any person, firm, association of persons
or corporations who shall violate any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be fined not less than
$25.00 nor more than §200.00 for each and every offense
against said ordinance and the commencement of any of
such work, and a-kery day any such work goes forward after
its commencement without a permit and every day any such
work or improvement done or made without permit as herein
provided,?for, remains standing shall constitute a separate
and distinct offense; and the foregoing penalty shall be
in addition to and cumulative of all other penalties and
remedies within the power of the City to impose and en-
force.

SECTION 4.
That the fact that no ordinance exists in
the City of Beaumont to protect navigation from the
building, construction, repairing, alteration and
remodeling of the structure named in this ordinance
in or across the Neches River within the Harbor
limits of the City of Beaumont to safeguard against
the obstruction, impeding and interference with
navigation within said Harbor and the fact of the
rapid development of said Harbor and the increase
of navigation therein requird:ng every safeguard for
its protection, creates an imperative public emergency

necessitating the 'suspension of the rule requiring
that ordinances be read upon three separate days before
their passage.
This ordinance shall take effect from and
after the date of its passage and the signature of the
Mayor.
Passed on the day of July, A.D., 1922, by
the affirmative vote of all the members of the Commission.
