Entitled an ordinance prohibiting mendicants,
beggars and persons of infirm or maimed body or suffering
from diseases of any kind from soliciting of alms, help or
assistance, and all itinerant or transient vendors of
clothing or- wearing- a.ppare-1 -or---articles of bedding --or- mer-
chandise of any description whatever from begging or soliciting
alms, help or assistance and from selling or offering for
sale of any clothing or wearing apparel or articles of bedding
or merchandise of any description whatever, in, upon or along
the streets or the sidewalks of the City of Beaumont, and the
carrying on or maintenance of dances, vaudeville performances,
circus, carnival or theatre under conditions, at places..and
within certain times therein stipulated, within the City of
Beaumont, without a permit as therein provided; Prescribing
pains and penalties for the violation thereof; declaring that
invalidity of a part shall not invalidate all of said ordinance;
providing that said ordinance shall take effect on the date of
its passage;
BE IT ORDAINED BY THE CITY CGHMISSIOT.;
OF THE CITY OF B.GAMONT.
rection 1.
That from -and after- the cl ate: of the passage of
this ordinance, it shall.be unlawful for any mendicant, beggar
or person of infirm or maimed body orsuffering from diseases
of any kind to solicit alms, help or assistance in, upon or
along the streets or sidewalks anywhere in the City of
Beaumont, Jand for any itinerant or transient vendors of
clothing or wearing apparel or articles of bedding or mer-
chandise of any description whatever to sell or offer for
sale any clothing or Wearing apparel or articles of bedding
or merchandise of any description whatever, in, upon or
along the streets or sidewalks of the City of heaumont, `and
for any person or persons, men and women, either'or both,
to carry on and maintain under or in any tent, awning or
either movable and temporary structure or in the open air,
within the limits of the City of Beaumont, any dance, vaudeville,
performance, circus, carnival or theatre for a period of time
more than twenty-four (24) hours within each twelve (12) months,
without permit duly issued upon application duly made as herein-
after provided.
Section 2.
That any person or persons, above mentioned or
described desiring a permit for the purpose oirpurposes
mentioned in'the foregoing section hereof shall make
application in writing therefor to the City Manager of the
__City of _Beaumont; setting- forth insaid application in detail
the exact purpose for which it is desired and the exact
location of the street, sidewalk or other place to which it
is desired said application shall apply, and the period
of time it is desired said.permit shall cover; provided, how-
ever that no permit shall ever be granted for any or either
of such purposes except upon proper and satisfactory showing
made to the Cityl;Ianager that the applicant therefor is a fit and
proper person to exercise the rights granted therein and that
it would not be against or endanger the public morals, public
health, public convenience and general public safety and
welfare to grant such permit; provided further, however, that
the City Commission may review and approve or,reverse the
action of the manager in any case, either on its own or the
applicants motion.
Section 3.
That any person or persons who shall violate the
provisions hereof shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be fined in any sum of
money from ;61.00 to X100.00, and each act forbidden by
the provisions hereof to be done without a permit duly
granted as provided shall be and constitute a separate and -
distinct offense.

That if any part of this ordinance should be or be
held to be for any reason invalid, that fact shall not in-
validate the whole, but the balance shall be held ;to be
valid.
