Entitled an Ordinance regulating the production and sale of
Milk and Milk Products, and Ice-cream, in and for the City of
Beaumont, and authorizing the director of Sanitation of the
City of is aumont to make regulations relative thereto; providing
a penalty for the violation thereof; and providing that the
invalidity of a part shall not invalidate the whole of said
o rd inan c e . ,
BE IT ORDAINED BY THE CITY COMISSION OF
SHE CITY OF BEAMvZONT:
MILK AND MILK PRODUCTS- PRODUCTION, CARE AND SALE.
SECTION 1.
Definition of Terms.- The following words and
terms for the purpose of this ordinance shall be construed to
mean as follows:
"Distributing Station"- Any place, plant,.pre`mises
or establishment other than a dairy or dairy farm, where milk is
collected, handled, processed, bottled, pastuerized or otherwise
prepared for distribution.
"Dairy" - Any place, plant, premise where two or more
cows are kept or milked, the milk from which is sold to others
than the original owners thereof.
"Person" - Includes individuals, corporation,
partnership and other associations both singular and plural.
"Produce" - Includes thQ handling and milking of milk
up to the time the milk is to be bottled or otherwise prepared for
transportation or distribution.

"Domestic Use" - Means domestic or potable use and
includes use in any restaurant, cafe, hotel, boarding house,
bakery, confectionery or ice-cream factory.
"Safe" - Free from danger from the standpoint of
public health. .
"Milk" - Includes whole milk, skim milk, pasteurized

milk and modified milk in anyoii. Excludes buttermilk, as
hereinafter defined.

"Adulterated" --Milk shall be adulterated:.
1. If it contains.less than 11.75'per cent -total
solids, lessthan, 8.50 per cent solids not fat, less than
3.25 per cent milk fat or more than 500,000 bacteria per centimeter.
2. If any substance or substances have been mixed
with it so as,to'lower.or depreciate or injuriously affect its
strength, quality;or purity.
3. If,any substance -or substances have been substituted -
wholly or in part for, such milk.
4. If part of the' -butter fat has been removed.
5. If itis mixed or colored in a manner whereby
damage or inferiority is concealed; or if by any means it is made
to appear to be better or of greater. value .than. it really is

6.. If it; contains -any added substance which is
poisonous or injurious to health:
7. If it. eonbitts wholly or in part. of diseased,
filthy, decomposed, infected, tainted or rotten animal'or
vegetable substances, .or 'if it is the product of a diseased
animal.
8. If it is' in fact unclean, impure, adulterated or
unwholesome.
"Unwholesome" - Milk shall be deemed unwholesome if it
is taken from any animal suffering from tuberculosis, lumpjaw
or any other disease or ailment; or if taken from animals 15 days
before or seven days after parturition; or if taken from any,
animal that h,ts been fed upon any rotten or unwholesome-' feed;
or if itcontains any pathogenic bacilli or bacteria or disease
germs; or if it has been pasteurized more than once.
SECTION 2.
STANDARDS ESTABLISHED FOR 14ILK AND ITS PRODUCTS:
Milk is the whole; fresh, clean, lacteal secretalon
obtained by the .complete.,milking. of one or more healthy -cows,
properly fed and kept, excluding that obtained .within 15 days before

and seven days',afte,r calving. '
Grade "A" Milk may be either raw or, natural, •`or it
may be pasteurized.; Provided, however, that no person, firm or
corporation shall be• permitted to label and sell. milk as Grade "A"
if any or all of the milk handled or distributed -bgi such person,
firm or corporation is produced at a dairy or dairies operated
contrary to the provisions.as hereinafter specified to govern such
cases.
All Grade "A" Milk.must contain not less than 3.75 per.
cent butter fat, twelve and one-quarter(12.25) per cent total
solids, not ' less . than eight 'arid one-half -(6.50) per cent total
solids not fat. If. raw,,'Grade."A".,milk must contain less than
75,000 bacteria per c. c. at time of delivery to consumers.
Pasteurized Grade "A" milk must contain less than -20,000 bacteria
per c.., ce at time of delivery to_ consumers.
GRADE "B" milk. All milk . not conforming to the
special.standard as specified for Grade "A" milk shall be consid-
ered Grade "B" milk.;. , Grade "B", milk must, however, contain not
less than eleven and seventy-five (11.75)'per cent total solids, not
less than.eight and one-half (8.50) per cent solids not fat, and
not less.'than three and one quarter (3.25) per cent butter fat.
Grade "B" milk maybe either .raw or natural or it , may be pasteur-
ized. If raw or natural, it must contain less than 500,000
bacteria per c'. c. at time of delivery to cD nsumers ; and if
pasteurized, less than 75,000.bacteria per c. c., at time of
delivery to .consumers.
All milk must be, plainly and_ truly labeled .Grade "A►►
Natural, Grade "A" Pasteurized, or Grade "B" Natural, or Grade
"B" Pasteurized, as -the case may, be.
BLENDED•MILN is milk modified in its composition so
as to have a definite and stated percentage of one or more of its
constituents.

.SKIM MILK IS' milk from which a part or all of
the cream has'be-en removed and contains not less than nine and
one quarter ( 9.25) per cent of milk solids-.
PASTEURIZED MILK. Pasteurization of milk shall be
performed by a process.whereby every portion of the milk is
raised to a temperature of 145 Degrees`F., and retained at this
temperature for a period of thirty minutes by the. "Holding ProeessIc
and immediately thereafter cooled to a temperature below.50

Each pasteurization, apparatus shall be equipped with-
an
ith-
an automatic time and temperature -recording apparatus approved
by the Director of. Sanitation, which shall accurately', record the
temperature -and length of time the milk has been heated-. The
records made'by this recording apparatus shall be accurately
dated and . kept on 'file,. subject at all times to the inspection
of the Director of Sanitation, or his duly authorized agents or
inspectors.
STERILIZED MILK is milk that has been heated at the
temperature of boiling water, or higher for a length of,time
sufficient to kill all organisms present.
CONDENSED MILK, EVAPORATED MILK, is milk from which
a considerable portion of water -has been evaporated and contains
not less than twe:n;b seven and five tenths (X7.5) per cent of
milk fat.
SWEETE14ED CONDENSED MILK is milk from which a consid-
erable portion of , water has been evaporated and to which sugar
( sucrose) has been added, and contains not less than'twenty-eight
(28) per cent of milk solids of which not less' ihan seven and
five tenths (7:5) per" cent is milk fat.
CONDENSED SKIM MILK is milk from whi oh a considerable
portion of water has been evaporated.
BUTTERMILK is the product that remains when the
butter'is'removed from milk or cream in the process of churning.
GOAT'S MILK, EWE'S MILK, etc.- are the fresh, clean
lacteal secretions free -from colostrum, obtained by the complete
milking of healthy animals other than -.cows, properly fed and
kePt, and conform- in name to the species of animals from which -
they -are obtained.
CREAM is that -portion of milk, rich in milk fat
which rises to the surface of milk on standing or is separated
.from it by centrifugal force and is fresh, clean and wholesome.
Oad'a "A" Cream.. Grade "A"' cream must be obtained
from Grade'"A" milk and shall contain not.less than 20.per cent
butter fat. If raw, Grade "A" cream shall contain not more
than 200,000, and if_pasteurized Grade "A" cream shall contain not
more than 50,000 bacteria per centimeter at. time of delivery to
consumers.
Grade "B" Cream. Grade "B" cream may. be made from
Grade "B" milk, must be fresh,. sweet and wholesome- and contain
not less than eighteen (18) per cent butter fat.- If raw, or

natural, Grade "B". cream. 'shall .contain not more than 750,000 A"
bacteria per c. c. at time of delivery to consumers.
All cream must be plainly and truly labeled Grade "A"
natural, Grade "A" Pasteurized, Grade "B" Natural, or Grade "B"

The method,employed in urizing cream shall be the same
as that prescribed for izing milk. Ids cream, no matter for
what purpose intended; a pasteurized'a second time.

MILK FAT OR BUTTER FAT.
-MILK FAT, BUTTER FAT, is the fat of milk and.has
. 1V4
a Reichert,P3bissl number of not less than twenty-four (24) and a
specific gravity, not less than 0.905.
SECTION Z.
MILK PRODUCT_IO , DARE AND SALE.
(1) Every person keeping cows for the production
of milk for. sale, shall cause the udder's of .each cow to -be, thor-
oughly washed and cleaned and wiped dry with a clean cloth before

each milking. The hands and udders must be kept dry during the,
process of milking. ;
(2) Every person using any premise for keeping
cows shall cause the yard in connection therewith to be provided
with a proper receptacle for drinking water for such cows, and
none but fresh, clean, pure water shall be stored in such recepta-
cles.'
(3) Any enclosure in which the cows are kept.shall be
graded and drained so as to keep the surface reasonably dry and to
prevent the accumulation. of water therein, and no garbage, urine,
fecal matter or similar substances shall be placed and allowed to
remain in the enclosure.
(4) Every' dairy must be provided with a milk room
which shall be thoroughly screened with not coarser than 16 wire
mesh thoroughly protected against flies, kept scrupulously clean,
and free from dust, , shall not be used as a living or sleeping
room and shall be at least thirty (30) feet from the barn or
stable in which the cows are kept. It, shall be supplied with
pure water and suitable.facilities for straining, cooling and
storing milk.
(5) Every dairy must also' be provided with a room
supplied with pure water and equipped with apparatus and appli-
ances suitable for washing and sterilizing all utensils and
apparatus in which milk is.received, stored and delivered. This.
room may adjoin the milk room, but must be separated from it by a
tight wall and close -fitting doors. The room must have a well -
drained floor, impervious to moisture, and shall at all times be
kept clean and free from dust and flies.
(6) Every person keeping cows for dairy purposes shall
provide and use a sufficient number of pails, cans or other recep-
tacles, made of glass. stoneware, glazed metal, or No. 1 tin, :for
the reception of, storage and delivery of milk, and shall cause
all milk as .soon as drawn from the cows to be' removed from the
room .in which the cows are kept, to the -milk room, strained through
filter cloth ^abso.rbent .cotton,, bottled,, or put 'in the cans used
for delivering, and eooled wi,thiri an hour to (50).de'grees or less;
( 7 ) . No pails - shall be used during the process of
milking, which have,a top opening more than eight (8) .inches in
diameter. The inner surface of all pails shall be smooth and
heavily tinned, and must -be of a. type approved by the Director of
Sanitation.
(8) All pails, cans, bottles. and other receptacles
of any sort used in :the sale or handling -Of milk shall be thor-
oughly cleaned, sterilized (scalded in boiling water or live
steam) daily for fifteen -minutes.
(9 ),, Milk shall _ only ,be bottled and put into containers
which have been cleaned and sterilized since they were last used.
Milk shall be bottled only in the milk house at the dairy, or at
milk depots and creameries approved by the Director of Sanitation,
and which have permits for conducting such establishments.
(10) All wagons or conveyances used for the purpose
of distributing or�delivering milk or cream within the City of
Beaumont shall .be covered or enclosed in. such a way as to .protect
the bottles and containers from flies and dust:. They 'shall be
washed and scrubbed daily' and must be free from offensive odors,
and shall bear .plainly marked .upon the side thereof, in legible
characters not less than three (3) inches high and one and one-
half (12) inches wide, the permit number under which such milk
or cream is being sold or delivered, and the name 'and address of
the dairyman or. dealer.
(11) It shall be unlawful to sell milk and cream
at retail from.a bulk supply. Restaurants, milk depots and
persons retailing milk and cream shall sell milk and cream only
in the original bottles• or containers and shall be' responsible
for the quality of the milk and cream sold.
(12) All milk, skim milk, cream and ice-cream .offered
for sale or held in possession 'with intent to sell;. whether in
bottles or other containers, within the City of Beaumont, shall be

Plainly marked an.d�labeled, showing the kind,. quality and grade
of the milk, cream and ice-cream,. together with the name. of the
producer or the trade name of -the' firm bottling., handling .or
manufacturing such milk,. cream or ice-cream.
(13) Pasteurized milk offered Ifor sale or .held in
possession with intent to sell shall be plainly labeled
"Pasteurized", and milk not ' pasteurized shall not- ,be so labeled or
marked.
(14) It shall be the duty of every person engaged in the
production, .storage, .transportation,, sale, delivery or distribution -
of milk or milk -products in the City of Beaumont, to obtain from
the City Health Officer, _within thirty days after the passage of
this ordinance, a certificate showing that such person is free
from infectious and contagious disease. The. -City Health Officer
shall, assess a fee of. two ( $2.00) dollars � for. each . examination
made by him, and if satisfied with the condition of the appli-
cant, shall issue a certificate. All .other examinations- made shall
be sub jest. to the approval of the City Health, Offi cera Re-examina::
tions shall be made. every six months or. oftener at. the discretion

of the City Health Officer.^. The certificate shall be in -the
Possession -of the individual at all times and must be produced for
Inspection on the request of the Director of Sanitation or City
Health Officer ; provided that all persons affected hereby may
have ' such examinations made by any reputable physician in the City
of Beaumont, of their own cho°sing, but .in such cases the re sult
of such examination shall be presented to' the .city health officer,
upon forms which shall be furnished free , by the city, and if the

to'work or labor in any capacity at duties connected with the pro-
duction, handling, distribution or sale of milk, cream or milk products
unless such person is in the possession of a valid health certificate
issued by the City -Health Officer.

on the occurrence of any infectious disease either by himself
or in his family or among his employees or their immediate
associates,�or within the building or premises where milk is
stored, sold or distributed shall notify the local health
officer.
(- 'No person recently having been in contact with
a person having an infectious disease,shall milk or handle cows,
measures or other vessels used for milk or cream intended for
sale, until the local health officer has. decided that all -danger
of communicating such -disease.-to other''people shall have., passed.
-(3*) No bottle, can or receptacle used for -reception
or storage of milk shall be removed from a private house, apart-
ment or tenement wherdin a-, person. has an infectious disease,without
the approval of the focal health of fi cer.
(3-&) All owners of dairy herds supplying milk pro-
ducts must within thirty days from the passage of this -ordinance
have each and every- animal over' six months of age in such herd
carefully examined with the 'tuberculin test, either subcutaneous
or e--tradermal, under the supervision of the Director of Sanitation,
for tuberculosis, and all animals suffering with this disease
shall be branded "T" on the left jaw, in letters not less than two
inches in height, and shall be quarantined and disposed of,
according to the rules and regulations of the Live Stock Sanitary.
Commission of Texas. No fee .shall be charged dairymen who are
entitled to a permit, if.the test is applied by a veterinarian of
the Bureau of Sanitation.

(i All dairymen holding .permits,, who purchase cattle
for their dairies, must notify the Director of Sanitation of their
intention and said cattle must- be first tested. with tuberculin
before such cattle are received at the dairy, unless. permission is

to'prohibit private parties or families from maintaining not more

( -e&) Every veterinary surgeon or other person
having knowledge of any animal .used for -dairy purposes being
infected or suspected -of infection, with tuberculosis, shall
report the, same to the Director of Sanitation within twenty-four
hours after the first knowledge of the nature -of such a disease.

(-;A) The non -reacting animals must be examined at
least twice a year with intervals of six months, and if any
react, they must be disposed of as.provided .in Section 3, (1.8).
(2e4 No milk producer or milk vendor shall, either
through himself or through agents, servants or employees, offer
or expose for sale or deliver .for sale for use or consumption.
within the city, any milk or milk products, without first having
obtained from -the Director of Sanitation a' permit to do .so, as
hereinafter provided.
(2;5) To procure such .a permit ' the applicant .shall
present to the said . Director of Sanitation his written application,-
on
pplicationon forms supplied by the Director of Sanitation, and—`shall state
therein the name and business address. 6f the .applicant or appli-
cants, the source or sources from which said applicant or
applicants obtained or will obtain supplies of milk, the number
of cows in the possession of applicant, the average quantity of,
milk to be disposed of by said applicant, and,manner or character
of any other information which'may be required. Such 'applicant
shall further state the specific brand or business name.,:. if any,
under which said milk is to be Bold or exchanged or .distributed.
4t) If the. said Director of Sanitation, upon such
application shall determine the statements made therein are true,
and that the applicant does ,not propose selling or offering for
sale or delivering or distributing .any unwholesome milk. as- food
for human beings,; it shall be the duty, of the said Director of
Sanitation to issue,without cost to said applicant, a permit to
bring,in and sell, expose or offer for sale within the.City of
Beaumont, milk and milk products; and all such written statements
required aforesaid shall be registered;•in a 'register to be provided
by said Director .of Sanitation and kept for that purpose.
O One. such permit shall -be required for each
place of general sale or storage of milk. Such permits shall be
required only in the name of the owners, of the supply of the milk
thus ,on storage or . for sale, and shall for this purpose thereof,
be conclusive evidence. of such ownership. No such permit -shat l be
sold or assigned or transferred. All permits expire automatically
on January first of each -'year and must be renewed on- that date for
the ensuing calendar year.
OW The permit -of any person, firm or corporation
receiving milk or milk products for storage, distribution or sale
from a peroon, firm, corporation or dairy holding a permit for
distributing or selling milk for use or consumption in the City
of Beaumont shall be liable to revocation as provided in-
Section 5 (29).
(£W) Such.permits. shall be subject at all times to
revocation by said Director of Sanitation in his -discretion, upon
sufficient cause' therefor shown; provided, however, that no such.
permits shall . be, revoked until_ after a hearing by said Director of
Sanitation, in the matter of revocation of .such permit, after
five (5) days notice.in writing has been. served upon the owner of
such permit, stating the ground for complaint and time and place of
hearing. .30
(ice) At least once each year every -firm, or corporation
holding such permit shall register with said Director of Sanitation
his or their name and. permit number and -shall make out a written
statement to said Director of Sanitation,contairiing all information
required to be given applicants for permits in their written
applications for permits, as hereinbefore provided; and all

applicaXtb� for permits. £nd- such written statements required afore-
said shall be registered in a register 'to be provided by the
Director of Sanitation and kept for that purpose.

{) Permits shall" not be issued for the operation of
any dairy which does not score, at least sixty (60) points, of
which at least thirty-five .(35) points shall be for methods as
scored on the'United States Bureau of,Animal Industry .score card.'
Provided, however, that temporary permits may be issued for a
length of time considered sufficient by .the Director of Sanitation
to make improvements necessary to raise the score to sixty (60)
points as required. After the. -improvements have.been made as
directed, a regular permit shall be issued.

32(9}) At any time or times upon three days notice from
the Director of Sanitation, the holder"of any permit who operates
a dairy or distributing station, shall file with said Director,
of Sanitation.a.true and complete list of the names.and addresses
of each pereon who is employed or connected with the.pr,oduction,
handling or distribution of said milk or milk products.
SECTION 4.
SPECIAL PERMIT TO PRODUCE, SELL -AND DISTRIBUTE GRADE "A" ,MILg
AND CREAM:
All Grade "'A" -milk must be •produced handled -and
distributed under the following special conditions and-require-
ments:

(1) Dairies at which Grade "A" milk may be produced
shall 'score not less than 55 for` method's and not less than 30
for equipment, . according to the official method of scoring as
adopted by the Bureau of Sanitation.
(2) Milkers shall wear clean washable suits of light.
color.. Hands must be washed with soap and clean water and dried
on clean towels immediately before milking each individual cow.
(3) Bottles shall be sealed by machine or by persons
wearing sterilized rubber gloves.
(4) Overshield caps shall be used.on the bottles.
Typeof of cap to' be approved by the Director of Sanitatidn. Capping
shall be done by machine, or by persons wearing sterilized rubber
gloves.

(5) Bottle seals and _overshield caps shall be truly
and plainly marked Grade ."A" Natural, or Grade "A" Pasteurized,
as the case may be.,
(6) All persons, firms. or - corporations wishing to
produce, sell or distribute Grade "A" milk or cream must make
application to the.Director of Sanitation, on .forms supplied by
him, for a special permit to.produce, sell or distribute milk and
cream as Grade "A".'
After said Director of Sanitation has. satisfied
himself that the applicant can and will conform "to the rules . and
rggulations governing the production, sale and distribution of
Grade "A" milk and cream, it shall be his duty to issue the
desired permit," such permit to be re -issued on the first day of
every calendar month.
(7) 4.11 persons, firms or corp orations holding a

permit to sell or distribute Grade "A" milk and Grade "A" cream
shall furnish the Director of Sanitation samples of such milk and
cream not less than one pint, in the original bottles, at least
A -
once -every week or 'oftener, at the "discretion of the said
Director of Sanitation,. for analysis.
(8),If at any time two successive *sample s of. Grade.
"A" milk or Grade "A" cream, taken at intervals of at least 48
hours, from the supply of any person, firm or corporation holding
a permit to sell or distribute Grade "A" milk and cream, do not
comply with the standard 'as prescribed for such Grade "A" milk
and. cream, then the: permit of such person, firm 'or corporation
shall not be re -issued for the succeeding 'month, and such persons,
firms or corporation shall cease to sell or distribute milk as
Grade "A" and cream as Grade "A", until such a time when the
Director of Sanitation has satisfied himself" that, the quality of
the .milk ftd . cream is again sufficiently high to warrant the 're-
issuing of the permit.

SPECIAL PERMIT TO SELL,AND DISTRIBUTE BUTTERMILK:
(1) All -persons, f irms , or- corporations wishing to
sell or 'distribute' -buttermilk muet file an application" with the
Director of Sanitation for a permit. After the DireGt.or of
Sanitation has satisfied himself that the applicants can comply
with those sections of this ordinance relating to the production,
care, handling and. sale of buttermilk, " it' shall be the duty of'
said Directs of, Sanitation to, issue a permit.
(2)' Buttermilk shall not be. retai led from a bulk
supp ly .
(3) Buttermilk shall be retailed only in bottles,
plainly marked and labeled "Buttermilk", together with the name
of the person, firm or.c,orporation'"who. produced and bottled it.
(4)•Buttermilk shall be bottled only in a room or
establishment approved,.,by the. -Director of Sanitation for that
purpose.
(5) Buttermilk shall be cooled to a temperature of
55, degress F. or less, immediately after it is .produce'd5 and
kept below 55 degrees F." until delivered to the consumers.
(6) All buttermilk,, sold must at all time?, be of a
wholesome quality.
(7) Vehicles used in"distributing buttermilk must
at all times be in a sanitary condition.
(8) No buttermilk shall be sold without a permit to do
so.
(9) Permits are at all times -subject to revocation

after a manner, as outlined .in Section 3,
SECTION 6.
DISTRIBUTING STATIONS:
(1) Distributing stations shall be clean, well lighted
and screened, and shall be used. for no other purpose than 'the
handling of milk and milk products and the operationAincide'nt
thereto, and shall be open to inspection by the Director'of
Sanitation and local Health, Officer at all times.

(2) D:.=J-4- stations shall have smooth, impervious
floors, properly graded and drained.
(3) They shall be equipped with hot and cold water -
and steam.
(4) Provisions shall be made for steam sterilization
of all utensils, and no empty milk -containers shall be- sent out
until after such sterilization.
(5) All utensils, piping .and tanks shall be kept
clean and shall be sterilized daily. All piping shall be sanitary
milk piping in couples short enough to be. taken apart and washed.
(6) Containers and utensils shall not be washed in
the same room in which milk is handled and shall be in .good condi-
tion at all times
(7) No distributing station scoring under sixty (60)
will be licensed.
(8) Stores:, All stores in which milk and, milk products
are handled shall be provided with a suitable compartment or.room
in which the milk or milk products shall be kept. Said room -or
compartment shall -be cleane-d and so arranged that the milk or
milk products, stored
therein
shall be
protected
from 'contamination.
(9) Milk
or milk
products
shall not
be, stored,
handled or sold ina stable or in a room_which cpmmun.icates
directly with a stable .or in any room in which there is a water
closet.
(10) Milk or .cr.eam.,shall be stored in a properly
cooled refrigerating room or receptacle, which shall be kept at
a temperature not exceeding.55 degrees.
SECTION 7
ICE-CREAM- MANUFACTURE,, CARE AITD SAFE:
(1) No ice-cream shall be manufactured or stored
in any portion of a building w4ich is used for stabling horses
used
or other animals in any roomLin whole,or in part,for domestic
or sleeping.purposes, 'unless the manufacture and storage room
for .ice-cream is, separated from other parts of the building, to
the satisfaction of the.11irector of Sanitation.
(2). All.rooms in which ice-cream is manufactured
or stored shall be provided with tight walls and floors,
windows and doors iscreened, and'kept constantly,clean. The-.
floor and walls of said room shall be of such construction as
to permit rapid. and thorough cleansing:, The room or rooms afore-
said shall be equipped with appliances for washing or sterilizing
L.tensils employed. in the mixing,,- freezing,- storage, .sale or
distribution of ice-cream and all such utensils after use shall be
thoroughly washed with boiling"water, or ste"ril"ized by steam.
Vessels used in .the manufacture ,and sale of ice-cream shall not be
employed as containers of other substances than ice -dream.
(3) All establishments in which ice-cream is manufactured
shall be equipped with facilities for the proper cleansing of hands
of -operatives, and all persons immediately before engaging in the
mixing of any .ingredients entering into the composition" of ice-
cream or"its subsequent freezing and handling, shall thoroughly
wash- his or her hands and keep them clean during such manufacturing
and handling."
(4) All persons shall -,be dressed in clean garments
while engaged in the manufacture and handling of ice-cream.

(6) All vehicles used in the oongeyance of ice-cream
for sale or. distribution shall be kept in a cleanly condition,
free from flies and offensive odors.
("7) Ice-cream kept for sale in -any shop, restaurant,
or other establishment, or which is sold from any pushcart or any
other vehicle, shall be "stored in a covered box or refrigerator;
such box or refrigerator. shall be properly drained and cared for
and shall be kept tightly closed, except during such intervals
as are necessary for 'the introduction or "removal. of 'ice-cream or
ice, and they" "sh"all be kept in such location and under such
conditions as shall be approved by the 'Director of Sanitation.
17.
(8) It shall be the.. duty of every person engaged
in any way -in the manufacture, storage, transportation, delivery,
sale or serving of.ice-cream within the City of Beaumont to
obtain a certificate of health,._accor' ,irig to the provisions of
Section 3, (14).
(9) All cream, milk or skimmed milk, employed
in the manufacture of i'ce-cream shall before -use be kept at a
temperature not higher than 55 degrees F. -unless it is pasteur-.

ized 'before- being §M d. No cream, milk or skimmed milk produced'
at a place that is not licensed by the -City shall be used in
the manufacture of ice-cream.
(10) No person by himself or by his 'servants or
agents, or as the agents of any other person, firm or corporation
shall sell, exchange or, deliver in the City of - Beaumont any
ice-cream which contains more than 500.,000 bacteria per cubic
centimeter, or less than 8 per cent butter fat,. except where fruit
or nuts are used for the purpose of flavoring-, when it shall not
contain less than -6 per cent . butter fat.
(11) When fruit ,or nuts are used in the manufacture '
of ice-cream the fruit shall -be sound; clean _and mature; the'nuts
shall be sound and non -rancid..
(12) Ice-cream shall be deemed adulterated within the
meaning of this ordinance:
(a) If -it shall contain boric -acid, formaldehyde,
or any other substances. or
compound
that is deleterious
.to health.
tb) If it shall
contain
salts, copper, iron
oxide'
ochers or any coloring substance that is deleterious to health;
provided that this paragraph shall not be construed to prohibit
the use of harmless vegetable coloring matter in ice-cream when not
used for fraudulent purposes.
(c) If it :'shall contain any deleterious flavoring
matter not true to the .name.
(d) If it -be -an imitation of, or offered for sale under
the name of another:article.

Nothing
in this ordinance shall
be construed to
prohibit the use
'-of fresh
eggs and not ' exdeeding
one-half per
cent pure gelatine, gum tragacent or other vegetable gum.
(14) It shall be unlawful for..any person, by himself -
or by .his agents --or as. the servant o± agent of another per -son,

firm or corporation, to sell, offer for sale, expose for sale
or have in possession with intent to sell, any ice-cream in any
container which is falsely labeled or branded as to the �nsme of
the manufacturer thereof, or to mgrepresent in any way_,the place
of manufacture of ice-cream which has been adulterated, 'within the
meaning of this ordinance.
(lb-) No old' or melted ice-cream returned to the manu-
facturer from.whatever source -or for whatever cause shall again
be used in' the preparation of ice -cream. -
(16) It shall be unlawful for. any person to manufacture,
store, transport, deliver, sell or serve any ice -"cream within
the City of Beaumont without first having obtained .- from, the
Director of Sanitatkon-a
permit to'do
so, as required in the case
of the production and
sale of milk
and.milk
products.
SECTION B.
All chemical and bacteriological analyses required to
be made under the, provislors of this ordinance shat l be pe rformed
according to the Standard Methods of analysis as adopted- by the
United States Public Health Association.
SECTION 9.
Any dairyman; person, firm or corporation who shall
violate any of the -terms or provisions of this ordinance, or who
shall fail, refuse or neglect to obey'or conform to any of the di-
rections herein contained, or in whose,possesslon, care, custody
or control any milk 'or milk products shall be found which. shall
not comply with the terms, of this ordinance;_ shall upon conviction
thereof be punished, by a fine of not less than ten (10.00) dollars
