HomeMy WebLinkAboutORD 62-Cl AN ORDINANCE Entitled "An Ordinance Establishing a Board of Equalization for the City of Beaumont, prescribing the number to Constitute said Board, naming the Personel thereof, prescribing their Duties, fixing their Compensation, Authorizing and Empowering them to name one of its members Secretary of the Board and to name his duties and formulate rules.and regulations for his guidance, and declaring an Emergency." -Whereas,- -the- duties --now encumbent, and which will. _ continue to be eneumbent u-pon the Board of Equalization of the City of Beaumont, in equalizing the values of taxable property are, and will continue to be voluminous, arduous and important,, and Section 17 of the charter of the City of Beaumont provides that the Commission shall prescribe the number necessary to constitute said Board, the same to be not less than three, and to prescribe their compensation and duties; and it is the unanimous opinion of the Comlission, in the circumstances, that it is to the public interests that said Board be constituted of five qualified citizens. Therefore - BE IT ORDAINED - E CITY COI1111ISSIOI� OF TIE] CITY OF BEAU::iONT: BY THE Section l.- That the said Commission o'f the City of Beaumont does hereby establish a Board of Eoualization, composed of five members, who shall serve for a term of one year from and after the date of their qualification, as hereinafter provided, or until and unless otherwise provided by ordinance or resolution of the City CormA ssion. Section. 2.- It shall be the duty of said Board of Equalization to equalize the value of all property of every description, rendered and subject to be rendered for taxes in the City of Beaumont, in accordance with the ordinances of the City of Beaumont regulating and controlling the valuation and equalization of val-aes,of taxable property. Section 3.- The following named persons are hereby appointed and named to serve upon said Board for the first year, or until and unless. otherwise provided by ordinance or resolution of the City Commission, viz: Jos. A. I:iyers, John 0. Banks, J. T. Shelby, B. E. 'Quinn and H. F. Triplett. 2. 6 'Section 4.- .Each member of said Board of Equalization shall receive as compensation for his labor as such, the sum of per day for each day he actually serves on said Board.in the -actual discharge of his duties as a member thereof. Section 5.-- The said Board. of Equalization are hereby empowered to elect, by a majority vote of the entire membership of said Board, one of its members to act as Secretary thereof, and said Board are further empowered to formulate rules and regulations for the guidance of said Secretary member., provided such rules and regulations be not in conflict with this ordinance, or any provision_ in the charter of the City of Beaumont, or the laws of Texas. Section 0.- Each member of said Board shall, before he entere upon the discharge of his duties as -a' me-mber of- said Board, subscribe to the following oath: "I do solemnly swear that I will. faithfully and impartially discharge and perform all the duties encumbent upon me as a member of the Board of Equalization of the City of Beaumont, according to the best of my skill and ability, agreeably to the constitution and,laws of the United States, and of this State, and of the charter and ordinances of the City of Beaumont; and I do further solemnly swear that since the adoption of the constitution of this State, I being a citizen of this State, have not fought a duel with deadly weapons within this State, nor out of it, nor have I sent or accepted a challenge to :light a duel with deadly weapons, nor have I acted as second in carrying a challenge, or aided, advised or assisted any person thus offending;and I further solemnly swear that I have not, directly nor indirectly, paid, offered or promised to, pay, contributed nor promised to contribute any money or valueable thing, or promised any public office or employment as a reward for the giving Or with -holding a vote: to secure, my appointment, so he-lp me God." Section 7.- The fact that it is imperatively ,necessary that a Board of-qualzation be at once established and begin the performance of their duty of equalizing property values in the City of Beau- mont, so that the departments of government of said City may continue their usual daily operation, t'he property values not being now on an equal and uniform basis, it is necessary'to suspend the rules requiring ordinances to be read at three separate meet- 3. ings before passage, and therefore the said rule is hereby suspended and this ordinance shall take effect and be in force from and after its passage and signature of the mayor.
