The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551 on January 29, 2019, at the
City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the
following:

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor Carl Vickery with Calvary Tabernacle Church gave the invocation. Mayor Ames led the
Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tern Mouton, Councilmembers Getz, Sam,
Pate and Samuel. Absent: Councilmember Jordan. Also present were Kyle Hayes, City Manager;
Tyrone Cooper, City Attorney; Tina Broussard, City Clerk.

GENERAL BUSINESS
Consider a resolution approving a contract with H.B. Neild & Sons for interior repairs at the
Tyrrell Historical Library.
Due to an extended period without power during and after Hurricane Harvey, mold was able
to infiltrate the main ceiling paint of the Tyrrell Historical Library. After mold mitigation, this
contract will allow for repairs to the staircase; lath plaster; and painting of the repaired areas.
Bids were requested from twelve (12) vendors; two responded. The low qualified bid to
complete the project with a cost of $130,880.25 was received from H.B. Neild & Sons, Inc of
Beaumont.
The contractor will complete the project in seventy calendar days.
Library Trust Fund.
Approval of the resolution.
Councilmember Getz moved to APPROVE A RESOLUTION THE BID SUBMITTED BY H.B. NEILD &
SONS, INC., OF BEAUMONT, TEXAS, IN THE ESTIMATED AMOUNT OF $130,880.25 FOR INTERIOR
REPAIRS AT THE TYRRELL HISTORICAL LIBRARY BE ACCEPTED BY THE CITY OF BEAUMONT AND THAT
THE CITY MANAGER IS AUTHORIZED TO EXECUTE A CONTRACT WITH H.B. NEILD & SONS, INC., OF
BEAUMONT, TEXAS. Councilmember Pate seconded the motion.

Resolution 19-026
2. Consider a resolution authorizing the City Manager to enter into a contract with Legacy
Community Development Corporation.
The City of Beaumont receives an annual allocation of HOME Investment Partnerships
Program funds from the U.S. Department of Housing and Urban Development (HUD).
Federal regulations require that a minimum of fifteen percent (15%) of the City's total HOME
fund allocation be contracted to Community Housing Development Organizations (CHDO's)
for eligible CHDO activities.
Legacy Community Development Corporation (Legacy CDC), a certified CHDO, is seeking to
stabilize neighborhoods by providing homeownership opportunities for low to moderate
income families. Legacy proposes to utilize $129,848 for the construction of one (1) new
home or the acquisition and rehabilitation of at least two (2) units to be sold to an eligible low
to moderate income family. In addition, Legacy is requesting $25,285.20 for operating funds.
The funds will be used to cover the salaries for administrative staff. Any and all income
received by Legacy for any properties must be used toward furthering the organization's
affordable housing activities. Housing Division staff will be responsible for monitoring Legacy
for HOME Program compliance.
Funding will come from the 2018 HOME Program.
Approval of the resolution.
Councilmember Samuel moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE
IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH LEGACY COMMUNITY DEVELOPMENT
CORPORATION (LEGACY CDC) IN THE AMOUNT OF $129,848.00 FOR THE CONSTRUCTION OF ONE (1

PUBLIC HEARING
Receive comments related to the mandatory payment rate for the Local Provider
Participation Fund for FY 2019

Stated that she works for a company called Adelanto Healthcare Ventures that assists some
of the providers in Beaumont, specifically Christus St. Elizabeth Hospital and Baptist Hospital
of Southeast Texas with their supplemental payment reimbursements, stated that this
program is very important to the community, the LPPF creates a financing mechanism for the
hospitals to receive reimbursement for their uncompensated care cost that are associated
with treating Medicaid and uninsured patients, it does this by generating a source of funds
that the City can then use to draw down federal dollars to bring more resources into the
Community for health care, the providers appreciates the Council's support

4. Consider setting the mandatory payment rate related to the Local Provider Participation Fund
for FY 2019.
On June 9, 2015, the City Council authorized the City's participation in a municipal health
care provider participation program to support the payment of Medicaid supplemental
hospital payments to Safety -Net Hospitals in the City. At the same time, the City Council
authorized the execution of indigent care affiliation agreements with Baptist Hospitals of
Southeast Texas and Christus Hospital. In addition, on July 28, 2015, the City Council
approved model rules and procedures related to the City of Beaumont's facilitation of the
program. The City of, Beaumont is required to set the amount of the mandatory payments
required to be paid by the hospitals. The mandatory payment must be uniformly
proportionate with the amount of net patient revenue generated by each paying hospital in
the municipality. The mandatory rate for the fiscal year ending 2019 will be 5.69%.
Local Safety -Net Hospitals will make mandatory payments into the Beaumont Municipal
Health Care Provider Participation Fund.

Councilmember Pate moved to APPROVE A RESOLUTION SETTING THE MANDATORY PAYMENT
RATE FOR THE FISCAL YEAR 2019 FOR THE LOCAL PROVIDER PARTICIPATION FUND IN THE MUNICIPAL
HEALTH CARE PROVIDER PARTICIPATION PROGRAM. Councilmember Samuel seconded the
motion.

Resolution 19-029
WORK SESSION
Review and discuss the Summer Food Service Program
Jimmy Neale, Parks and Recreation Director reviewed and discussed the Summer
Food Service Program. Mr. Neale stated that the Summer Food Program is managed
by the State of Texas Agriculture Department, it's designed to provide free lunch for
kids during the summer months when, school is out and services kids ages 17 and
under, Monday through Friday. The process is that the City will apply for the Grant
with the State, the City does get approved for the grant every year. The City then
goes out for bids for the meals but the City would still manage the program and the
staffing. The City has been doing this for about 25 years and has served over 14,000
meals per summer, the City has leaned on Region V as well as a group called
Triangle Community Outreach. Mr. Neale stated that Pearlanna Carron is the
Director of Triangle Community Outreach, this organization serves meals all year
round and currently serves 54 sites. Mr. Neale has reached out to Pearlanna Carron
and asked if her organization could take over the Summer Food Program. The
Triangle Community Outreach organization can apply for the grant, cook and serve
the meals as well as take care of all reporting.

COMMENTS
Jimmy Neale stated that he would like Council's approval for Triangle Community
Outreach to take over the program, stated that he knows they will do an amazing job.
All of Council was in agreement to move forward with Triangle Community Outreach
applying for and operating the Summer Food Program Grant.

Spoke to Council with concerns regarding the L.L. Melton YMCA, stated that the building is
owned by the City and County, a contract was entered into about 5 years ago with a tenant,
stated that it's his understanding that the tenant is doing a wonderful job, doesn't want to
interrupt that, stated that tax paying citizens would like for Council to revisit/revise the
contract to open up the L.L. Melton to the public after hours, the citizens would like to utilize
the facility from 6:00 p.m. to 8:00, 9:00 or 10:00 p.m., again, not to interrupt the current
tenants business and would like to utilize some office space if there is any available during
the day for blood drives, book reading etc., would like Council to consider the use of the
grounds and facility when the current tenant isn't there and on weekends

Spoke to Council regarding the L.L. Melton, also spoke on Item #1 under General Business,
stated that Council just voted to award a contract with H.B. Neild and Sons, there's a
problem with that, there are several Councilmembers that have a personal relationship with
H.B. Neild and to him this should be considered a conflict of interest, stated that Council isn't
vetting these businesses,. they aren't giving equal amount of time to minority businesses as
they should be, stated that the City Manager goes over things but not in detail, Council's job
is to do what's best for the citizens and everything on the Agenda should be vetted

Spoke to Council regarding streets, stated that $10 million dollars has been divided between
all four wards, stated that it's not right, the West End doesn't need to get money for streets,
the West End doesn't need any streets fixed they have new streets, the money needs to be
used in the worst parts of the City, stated that there's a need for new Councilmembers
because Council isn't doing their job, the only time that they see Councilmembers in their
area of town is when they want a vote, asked that they don't come and visit them just for a
vote, also commented that the City can do the streets themselves, they don't need a
contractor to come in and do the work, also made mention of the YMCA's that have come
and gone in Beaumont

Commented on Martin Luther King, Jr., stated that she would like to see the street sign that
is named MLK Parkway changed to Martin Luther King, Jr., Parkway and not just MLK
Parkway; stated that she's been here for 48 years and fought for Washington Blvd., to be
named MLK Parkway but it didn't happen, the City then voted for the street they have now,
would like to get this corrected because it's very important

Spoke to Council regarding the L.L. Melton YMCA that was built in 1974 for children, youth,
after school tutoring, meeting places for different organizations, sororities, fraternities,
NAACP and any affair that affected the neighborhood, the citizens in that area were able to
meet at the L.L. Melton Family YMCA, a part of the building was named for Cleveland Nisby
and Fred Joseph, these men worked along with Dr. Melton on Trinity Street in a dilapidated
building before 1974, stated that the Center has been taken away from them and they aren't
able to use it at all, stated that it's a travesty for the citizens of Beaumont not to be able to
use the facility, the tenant that is using the facility now is doing a great job and no one wants
to interfere with that, asked that Council reconsider the contract with -the current tenant so
that it could be used for what it was original intended to be used for

Spoke on behalf of the Scout Hut at the Ida Reed Park, the Hut has been there since 1954, it
has served scouting and the City for many years, stated that he has been the custodian and
has been repairing the hut, has had it treated for termites, painted the door and the front to
show that they were getting ready to paint the entire Hut, using the approved colors by the
Oaks Historic District, stated that he went by the Hut which is secured and noticed that
someone has changed the lock, for the City to arbitrarily instruct that the Hut be vacated to
be demolished is wrong, stated that he will have to file suit if something isn't done, stated
that the Hut is important to him, the City is tearing down too many properties, asked that
Council not tear the Hut down

Spoke to Council regarding how they seemed to have forgotten about people when
designing streets, the City lacks accessibility for people not in cars but for people walking,
biking, in wheel chairs and people who choose active transportation, there are minimum
requirements for people parking cars but nothing for bikes, we have crosswalks that lead to
nowhere, sidewalks with huge gaps and practically no way to safely cross Dowlen Rd., to get
from one shopping center to the other, about 80% of retail property is devoted to parking
cars, pointed out that you can park a dozen bicycles in one parking spot, stated that cars
don't shop people do, the City can do better, commented that no Councilmember has ever
asked her to come to Council and speak, it matters if everyone gets involved and knows that
Council does listen when they speak

SOLICITED, ONLY TWO REPLIED, H.B. NEILD WAS THE LOWEST
MOST RESPONSIVE BIDDER, IN REGARDS TO THE DOWLEN RD.,
PROJECT, THAT WAS DONE THROUGH A FEDERAL EARMARK
WITH 80% OF STATE FUNDING AND HAD TO BE USED ON
DOWLEN RD. ONLY, IT WAS TO BE SPENT OR THE CITY WOULD
LOSE THOSE FUNDS, ALSO MADE MENTION THAT THERE ARE
MANY STREETS IN THE WEST END THAT DO NEED REPAIRS,
ALSO COMMENTED ON THE L.L. MELTON FAMILY LIFE
CENTER, STATED THAT AS AN ATTORNEY HE COULD ASSURE
CITIZENS THAT THE CITY CAN'T JUST UNILATERALLY
RENEGOTIATE THAT CONTRACT, TO SUGGEST THAT THE CITY
JUST RENEGOTIATE THE CONTRACT WOULD PUT THE CITY INTO
LITIGATION, MADE ADDITIONAL COMMENTS REGARDING THE
L.L. MELTON AND THE IDEA OF TRYING TO BRING ANOTHER
YMCA TO THE CITY WITH THE HELP OF THE CITY OF PORT

CITY ENDED UP WITH THE MELTON FACILITY, STATED THAT
COUNCIL CARES AND IS GLAD THAT THE CITIZENS COME TO THE
MEETING AND THAT THEY ARE LISTENING TO THEM, COUNCIL IS
TRYING TO DO THE BEST JOB THEY CAN DO, ASKED THAT THE
CITIZENS APPRECIATE THE FACT THAT COUNCIL DO WHAT THEY
DO BECAUSE THEY LOVE THE CITY OF BEAUMONT, PRAYERS
GO OUT TO THE HOUSTON POLICE OFFICERS THAT WERE SHOT
ON YESTERDAY, GAVE CONDOLENCES TO THE FAMILIES OF
FORMER COUNTY JUDGE RON WALKER AND MRS. COOPER

CONTACT THE CITY MANAGER BEFORE THE MEETING TAKES

MELTON BACK, STATED THAT SHE TOLD THEM THAT SHE
WOULD DO EVERYTHING IN HER POWER THAT WAS
REASONABLE, INFORMED THOSE IN THE AUDIENCE THAT SHE
WAS ON THE CONFERENCE CALL FOR THE MEETING ON
YESTERDAY, THINKS THAT THEY WILL COME UP WITH
SOMETHING THAT IS REASONABLE AND FAIR, THE FACILITY
ALREADY HAS A TENANT AND IN NO WAY IS THE COUNCIL
TRYING TO INTERFERE WITH WHAT SHE'S DOING AT THIS TIME,
STATED THAT THERE IS NOTHING IN THE COMMUNITY FOR THE
CHILDREN TO DO

CITY MANAGER HAYES' - THANKED PASTOR COOPER, PASTOR ADOLPH ALONG WITH
THE OTHER PASTORS THAT ATTENDED THE MEETING WITH HIM

WANT THE CITIZENS TO LEAVE THE MEETING FRUSTRATED,
STATED THAT THE COUNCIL WANTS THE MELTON FACILITY TO
BE OPEN TO THE GENERAL PUBLIC AT CERTAIN HOURS, THAT'S
WHAT THEY ARE TRYING TO ACHIEVE, COUNCIL WILL HAVE AN
EXECUTIVE SESSION ON NEXT TUESDAY TO DISCUSS THE
FACILITY, THE MAYOR AND THE MAYOR PRO TEM HAVE A PLAN
AND IT'S A GOOD PLAN, IT WILL TAKE SOME TIME, WANTED
