REQUESTED ACTION: Council consider a resolution authorizing the City Manager to apply
for and, if awarded, accept funding through the 2019 Animal
Friendly Grant.
BACKGROUND
The Texas Health and Human Services Commission, on behalf of the Department of State Health
Services, is offering grant funding to help public and private entities provide low or no -cost spay
or neutering services to the general public.
The City is applying for $40,000. If awarded funding, the City plans to work with our contracted
veterinarian (Dowlen Road Veterinary Center) to provide free spay or neutering services to the
pets of low-income Beaumont residents.
Grants awarded under this program are funded on a two-year basis (August 31, 2019 to August
30, 202 1) and on a cost reimbursement basis.
The City currently receives funding through this grant. Between October 1, 2017 and January 1,
2019, the City provided approximately 291 free spay or neuter surgeries.

ARTICLE I. EXECUTIVE SUMMARY, DEFINITIONS, AND
AUTHORITY
1.1 EXECUTIVE SUMMARY
The Health and Human Services Commission (HHSC) on behalf of the Department of
State Health Services (DSHS) Zoonosis Control Branch (Program) announces the
expected availability of Animal Friendly funding for the state fiscal year (FY) 2020.
This grant funding is for eligible organizations which participate in Spay and Neuter
Projects that sterilize dogs and cats owned by the general public. These services must be
performed at minimal or no cost. This RFA is not limited to the source of funding
referenced in 2.2.1 if other sources become available for this project.
To be considered for award, Respondents must execute Exhibit A - Affirmations and
Solicitation Acceptance, v. 1.2, of this solicitation and provide all other required
information and documentation as set forth in this solicitation.
1.2 DEFINITIONS
Refer to Exhibit B - HHSC Uniform Terms and Conditions — Grant, v. 2.15 for
additional definitions. Additionally, as used in this solicitation, unless the context clearly
indicates otherwise, the following terms and conditions have the meanings assigned below:
"Addendum" means a written clarification or revision to this Solicitation issued by the
System Agency.
"Apparent Awardee" means an organization that has been selected to receive a grant award
through response to this RFA but has not yet executed a grant agreement or contract. May
also be referred to as "Apparent Grant Recipient" or "Apparent Grantee."
"Client" means a member of the target population to be served by the Respondent's
organization. For the purposes of this grant, a client is a member of the general public who
owns a dog or cat.
"Cost Reimbursement" means a payment mechanism by which contractors are reimbursed
for allowable costs incurred up to the total award amount specified in the contract. Costs
must be incurred in carrying out approved activities, and must be based on an approved
eight -category line -item (categorical) budget. Amounts expended in support of providing
services and goods, if any, in accordance with the contract terms and conditions must be
billed on a monthly basis for reimbursement unless otherwise specified in the contract.
Reimbursement is based on actual allowable costs incurred that comply with the cost
principles applicable to the grant. '

"Health and Human Services Commission" or "HHSC" means the administrative agency
established under,Chapter 531, Texas Government Code or its designee.
"Key Personnel" means a Respondent organization's Project Contact, Fiscal Contact, and
Executive Director and/or any other key stakeholders in the Proposed Project.
"Local Non Profit Veterinary Medical Association (VMA 'means an organization set up
by and comprised of several volunteer veterinarians in their immediate region for the
purpose of presenting continuing education, planning group activities, or discussing issues
common to their professional field.
"Owner" means a person which feeds, shelters, harbors, and has possession or control of
an animal or responsibility to control an animal.
"Project" means the work and activities for which grant funding is awarded and information
is provided as part of the response to this Solicitation. During the open application period
and before selection of grant recipients are made, the Project will be known as the Proposed
Project.
"Releasing Agency" means a public or private animal pound, shelter, or humane
organization. The term does not include an individual who occasionally renders human
assistance or shelter in the individual's home to a dog or cat.
"Respondent" means the entity responding to this Solicitation. May also be referred to as
"Applicant."
"Solicitation" means this Request for Applications including any Exhibits and Addenda, if
any.
"State" means the State of Texas and its instrumentalities, including HHSC, the System
Agency and any other state agency, its officers, employees, or authorized agents.
"Successful Respondent' means an organization that receives a grant award as a result of
this RFA. May also be referred to as "Grantee, ""Awarded Applicant," "Sub recipient" or
"Grant Recipient."
"System Agency" means the Department of State Health Services, its officers, employees
or authorized agents.
"Sterilization" means the surgical removal of the reproductive organs of a dog or cat or the
use of nonsurgical methods and technologies approved by the United States Food and Drug
Administration or the United States Department of Agriculture to permanently render the
animal unable to reproduce.

1.3 AuTHoRPrY
The System Agency is requesting applications under, and governed by Texas Health and
Safety Code, § 828.014, Dog and Cat Sterilization and Title 25 Texas Administrative
Code § 169.102, Department of State Health Services Animal Friendly Account.

ARTICLE H. SPECIFICATIONS
2.1 PROGRAM BACKGROUND
Due to pet overpopulation in Texas, over half a million animals are euthanized annually at
cost of over $20 million dollars. These figures do not include animals that are abandoned
and die from starvation, disease, or trauma. Stray animals represent public health threats
through a variety of diseases such as rabies, toxoplasmosis, plague, and parasitic infections.
Failure to sterilize pets is irrefutably a major cause of pet overpopulation. The cost of the
sterilization is considered cost prohibitive to many pet owners. As a response to these
problems, the 75th Texas Legislature designated that funds derived from the sale of Animal
Friendly license plates are to be used for sterilization programs.
In an effort to reduce pet overpopulation, Animal Friendly Program funds will be made
available for community based programs for the spaying and neutering or sterilizations of
cats and dogs.
2.2 GRANT AWARD AND TERM
2.2.1 Available Funding
The total .amount of state funding available for the Zoonosis Control Program Animal
Friendly Grant is approximately $200,000.00 and it is DSHS's intention to make multiple
awards to eligible respondents. One (1) grant award per contract year will be awarded per
approved applicant for the sterilization of dogs and/or cats in a minimum of $1,000 and a
maximum of $20,000 per contract period. These minimums and maximums may increase
or decrease at the sole discretion of DSHS. The maximum amount awarded per contract
year per approved applicant for the total life of the contract is $40,000. Large requests
for state funding may not be fully funded in order to ensure that funds are available for
the broadest possible array of communities and programs.
Grants awarded as a result of this RFA will be funded on a cost reimbursement basis.
Under the cost reimbursement method of funding, grant recipients are required -to finance
operations with their own working capital with grant payments made by DSHS to
reimburse the grant recipients for actual cash disbursements to be supported by adequate
documentation.
2.2.2 Grant Term
The initial contract term will begin on or about August 31, 2019 for a 24 -month period.
Continued funding of the contract in the second year of the initial contract period is
contingent upon the availability of funds and the satisfactory performance of the contractor

during the prior contract period. This contract may be renewed up to one (1) additional
one- year period(s), with renewal initiated at the sole discretion of DSHS. Funding may
vary and is subject to change each renewal.
Contracts awarded under this RFA and any anticipated contract renewals are contingent
upon the continued availability of funding. DSHS reserves the right to alter, amend or
withdraw this RFA at any time prior to the execution of a contract if funds become
unavailable through lack of appropriations, budget cuts, transfer of funds between
programs or agencies, amendment of the appropriations act, health and human services
agency consolidations, or any other disruption of current appropriations. If a contract has
been fully executed and these circumstances arise, the provisions of the Termination
Article in the contract Uniform Terms and Conditions will apply.
2.3 ELIGIBLE APPLICANTS
Eligible applicants include a private (for-profit or non-profit), entity or public releasing
agency (animal shelter), an organization that is qualified as a charitable organization under
Internal Revenue Code Section 5O1(c), and the organization must have animal welfare or
sterilizing of dogs and cats owned by the general public at minimal or no cost as its primary
purpose; or a local non-profit veterinary medical association that has an established
program for sterilizing animals owned by the general public at minimal or no cost.
Eligible applicants must also comply with the criteria listed below:
1. If applicable, organizations submitting a request for application must agree that they
are in compliance with Texas Health and Safety Code § 828.002. "Requirements for
Adoption," and § 828.003, "Sterilization Agreement."

2. Respondent must be established as an appropriate legal entity as described in the
paragraph above, according to state statutes and must have the authority and be in good
standing to do business in Texas and to conduct the activities described in the RFA.
Respondent must have a Texas business address. A post office box may be used when
the application is submitted, but the respondent must conduct business at a physical
location in Texas prior to the date that the contract is awarded.
4. Respondent must be in good standing with the U.S. Internal Revenue Service.
5. Respondent is not eligible to apply for funds under this RFA if currently debarred,
suspended, or otherwise excluded or ineligible for participation in Federal or State
assistance programs.
6. In compliance with Comptroller of Public Accounts and Statewide Procurement
Division rules, a name search will be conducted using the websites listed in this
section prior to the development of a contract.

A respondent is not considered eligible to contract with DSHS, regardless of the funding
source, if a name match is found on any of the following lists:
a) The General Services Administration's (GSA) System for Award Management
(SAM) for parties excluded from receiving federal contracts, certain subcontracts
and from certain types of federal financial and non-financial assistance and
benefits;
b) The Office of Inspector General (OIG) List of Excluded Individuals/Entities
Search;
c) Texas Comptroller of Public Accounts (CPA) Debarment List;
d) Iran, Sudan, & Foreign Terrorist Organizational Check and Boycott Israel, prior to
award, the purchaser must check the divestment lists in accordance with the Texas
Government Code.
e) Texas Comptroller Public Accounts (CPA) Franchise Tax Check.
7. Respondents must be listed if they are Professional Corporations, Professional
Associations, Texas Corporations, and/or Texas Limited Partnership
Companies. Secretary of State (SOS) at https://direct.sos.state.tx.us/acct/acct-
loginasp.
8. Contractor must have access to or maintain a computer, e-mail, and the internet
throughout the contract period.
Respondent is not considered eligible to apply unless the respondent meets the eligibility
conditions to the stated criteria listed above at the time the application is submitted.
Respondent must continue to meet these conditions throughout the selection and funding
process. DSHS expressly reserves the right to review and analyze the documentation
submitted and to request additional documentation, and determine the respondent's
eligibility to compete for the contract award.
2.4 PROGRAM REQUIREMENTS AND SCOPE
In accordance with Appendix A, Respondent must:
1. Sterilize dogs and cats owned by Texas residents based on the Grantee's approved
funding request.
2. Have access to or maintain a computer, e-mail and the internet throughout the
contract period.
3. Submit quarterly performance measure reports utilizing Appendix C, Zoonosis
Quarterly Performance Measure Report. Submit quarterly performance measure
reports after the work has been done to the DSHS Program.

2.5 PERFORMANCE MEASURES
DSHS will monitor the performance of contracts awarded under this RFA. All services and
deliverables under the contract shall be provided at an acceptable quality level and in a
manner consistent with acceptable industry standard, custom, and practice.
2.6 PROHIBITIONS
Grant funds may not be used to support the following services, activities, and costs:
1. Inherently religious activities such as prayer, worship, religious instruction, or
proselytization;
2. Lobbying;
3. Any portion of the salary of, or any other compensation for, an elected or appointed
government official;
4. Vehicles or equipment for government agencies that are for general agency use
and/or do not have a clear nexus to terrorism prevention, interdiction, and disruption
(i.e. mobile data terminals, body cameras, in -car video systems, or radar units, etc.
for officers assigned to routine patrol);
5. Weapons, ammunition, tracked armored vehicles, weaponized vehicles or
explosives (exceptions may be granted when explosives are used for bomb squad
training);
6. Admission fees or tickets to any amusement park, recreational activity or sporting
event;
7. Promotional gifts;
8. Food, meals, beverages, or other refreshments, except for eligible per diem
associated with grant -related travel or where pre -approved for working events;
9. Membership dues for individuals;
10. Any expense or service that is readily available at no cost to the grant project;
11. Any use of grant funds to replace (supplant) funds that have been budgeted for the
same purpose through non -grant sources;
12. Fundraising;
13. Statewide projects;
14. Any other prohibition imposed by federal, state, or local law; and
15. The acquisition or construction of facilities.
2.7 STANDARDS
Grantees must comply with the requirements applicable to this funding source cited in the
Uniform Administrative Requirements, Cost Principles, and Audit Requirements for
Federal Awards (2 CFR 200); the Uniform Grant Management Standards (UGMS), and all
statutes, requirements, and guidelines applicable to this funding.
Grantees are required to conduct Project activities in accordance with federal and state laws
prohibiting discrimination. Guidance for adhering to non-discrimination requirements can

Upon request, a Grantee must provide the HHSC Civil Rights Office with copies of all the
Grantee's civil rights policies and procedures. Grantees must notify HHSC's Civil Rights
Office of any civil rights complaints received relating to performance under the contract

A Grantee must ensure that its policies do not have the effect of excluding or limiting the
participation of persons in the Grantee's programs, benefits or activities on the basis of
national origin, and must take reasonable steps to provide services and information, both
orally and in writing, in appropriate languages other than English, in order to ensure that
persons with limited English proficiency are effectively informed and can have
meaningful access to programs, benefits, and activities.
Grantees must comply with Executive Order 13279, and its implementing regulations at
45 CFR Part 87 or 7 CFR Part 16, which provide that any organization that participates in
programs funded by direct financial assistance from the U.S. Dept. of Agriculture or U.S.
Dept. of Health and Human Services must not, in providing services, discriminate against
a program beneficiary or prospective program beneficiary on the basis of religion or
religious belief.
2.8 NO GUARANTEE OF VOLUME, USAGE OR COMPENSATION
The System Agency makes no guarantee of volume, usage, or total compensation to be
paid to any Respondent under any awarded Grant, if any, resulting from this Solicitation,
any awarded Grant is subject to appropriations and the continuing availability of funds.
The System Agency reserves the right to cancel, make partial award, or decline to award a
Grant under this Solicitation at any time at its sole discretion.
There should be no expectation of additional or continued funding on the part of the Grant
Recipient. Any additional funding or future funding may require submission of an
application through a subsequent RFA.

3.2 CHANGES, AMENDMENT OR MODIFICATION TO SOLICITATION
The System Agency reserves the right to change, amend or modify any provision of this
Solicitation, or to withdraw this Solicitation, at any time prior to award, if it is in the best
interest of the System Agency and will post such on the HHS Grants website and the
eGrants website. It is the responsibility of Respondent to periodically check the HHS
Grants website and the eGrants website. to ensure full compliance with the requirements
of this Solicitation.
3.3 IRREGULARITIES
Any irregularities or lack of clarity in this Solicitation should be brought to the attention of
the Point of Contact listed in Section 3.4.1 as soon as possible so corrective addenda may
be furnished to prospective Respondents.

3.4.2 Prohibited Communications
All communications between Respondents and other System Agency staff members
concerning the Solicitation may not be relied upon and responded should send all questions
or other communications to the point -of contact. This restriction does not preclude
discussions between affected parties for the purposes of conducting business unrelated to
this Solicitation. Failure to comply with these requirements may result in
disqualification of Respondent's Solicitation Response.
3.4.3 Questions
The System Agency will allow written questions and requests for clarification of this
Solicitation. Questions must be submitted in writing and sent by U.S. First class mail or
email to the Point of Contact listed in Section 3.4.1. Respondent's names will be removed
from questions in any responses released. Questions shall be submitted in the following

3.4.5 Responses
Responses to questions or other written requests for clarification will be posted on the HHS
Grants website. The System Agency reserves the right to amend answers prior to the
deadline of Solicitation Responses. Amended answers will be posted on the HHS Grants
website. It is Respondent's responsibility to check the HHS Grants website. The System
Agency also reserves the right to provide a single consolidated response of similar
questions at the System Agencies sole discretion.
3.5 SOLICITATION RESPONSE COMPOSITION
3.5.1 Generally
All Applications must be:
1. Clearly legible;
2. Sequentially page -numbered and include the respondents name at the top of each page;
3. Organized in the sequence outlined in Article IX - Submission Checklist;
4. In Arial or Times New Roman font, size 12 or larger for normal text, no less than size
10 for tables, graphs, and appendices;
5. Blank forms provided in the Attachments must be used (electronic reproduction of the
forms is acceptable; however, all forms must be identical to the original form(s)
provided); do not change the font used on forms provided;

ARTICLE IV. SOLICITATION RESPONSE EVALUATION AND AWARD PROCESS
4.1 EVALUATION CRITERIA
A three-step selection process will be used:
1. Eligibility screening;
2. Evaluation based upon specific selection criteria;
3. Final Selection based upon State priorities.
4.2 ELIGIBILITY SCREENING
Applications will be reviewed for eligibility and completeness. All complete applications
meeting the minimum qualifications will move to the Evaluation stage.
4.3 EVALUATION
Applications will be evaluated and scored in accordance with the factors required by this
RFA and other factors deemed relevant by HHSC and DSHS. See Form J — DSHS Animal
Friendly Evaluation Tool.
4.3.1 Specific Selection Criteria
Grant applications shall be evaluated based upon:
1. Respondent Background — 10%
2. Target Area — 35%
3. Strategy of Marketing — 25%
4. Coordination and Collaboration —10%
5. Target Cost Estimate — 20%
4.4 FINAL SELECTION
DSHS intends on making multiple awards. After initial screening for eligibility,
application completeness, and initial scoring of the elements listed above in Section 4.3, a
selection committee will look at all eligible applicants to determine which proposals should
be awarded in order to most effectively accomplish state priorities.
4.5 NEGOTIATION AND AWARD
The specific dollar amount awarded to each successful Applicant will depend upon the
merit and scope of the Response, the recommendation of the Selection Committee, and the
decision of the Director of Infectious Disease Prevention Section, or his/her designee. Not
all Applicants who are deemed eligible to receive funds are assured of receiving an award.

The negotiation phase will involve direct contact between the successful Applicant and
HHSC representatives via phone and/or email. During negotiations, successful Applicants
may expect:
a) An in-depth discussion of the submitted proposal and budget; and
b) Requests from HHSC for clarification or additional detail regarding submitted
Application.
The final funding amount and the provisions of the contract will be determined at the sole
discretion of HHSC staff.
HHSC may announce tentative or apparent grant recipients once the Executive
Commissioner has given approval to initiate negotiation and execute contracts.
Any exceptions to the requirements, terms, conditions, or certifications in the RFA or
attachments, addendums, or revisions to the RFA or General Provisions, sought by the
Applicant must be specifically detailed in writing by the Applicant on Exhibit E —
Exceptions in this proposal and submitted to HHSC for consideration. HHSC will accept
or reject each proposed exception. HHSC will not consider exceptions submitted
separately from the Applicant's proposal or at a later date.
HHSC may post to the HHS Grants website and may publicly announce a list of Applicants
whose Applications are selected for final award. This posting does not constitute HHSC's
agreement with all the terms of any Applicant's proposal and does not bind HHSC to enter
into a contract with any Applicant whose award is posted.
4.6 QUESTIONS OR REQUESTS FOR CLARIFICATION BY THE SYSTEM AGENCY
The System Agency reserves the right to ask questions or request clarification from any
Respondent at any time during the application process.

6.1 ADMINISTRATIVE ENTITY INFORMATION
Respondent must provide satisfactory evidence of its ability to manage and coordinate the
types of activities described in this Solicitation. Complete this requirement using Form I
— Conflicts and Litigation History.
6.2 LITIGATION AND CONTRACT HISTORY
Respondent must include in its Solicitation Response a complete disclosure of any alleged
or significant contractual failures.
In addition, Respondent must disclose any civil or criminal litigation or investigation
pending over the last five (5) years that involves Respondent or in which Respondent has
been judged guilty or liable. Failure to comply with the terms of this provision may
disqualify Respondent.
Solicitation Response may be rejected based upon Respondent's prior history with the State
of Texas or with any other parry that demonstrates, without limitation, unsatisfactory
performance, adversarial or contentious demeanor, or significant failure(s) to meet
contractual obligations.
6.3 CONFLICTS
Respondent must certify that it does not have any personal or business interests that present
a conflict of interest with respect to the RFA and any resulting contract. Additionally, if
applicable, the respondent must disclose all potential conflicts of interest. The respondent
must describe the measures it will take to ensure that there will be no actual conflict of
interest and that its fairness, independence and objectivity will be maintained. The System
Agency will determine to what extent, if any, a potential conflict of interest can be
mitigated and managed during the term of the contract. Failure to identify actual and
potential conflicts of interest may result in disqualification of a Solicitation Response or
termination of a contract.
Please include any activities of affiliated or parent organizations and individuals who may
be assigned to this Contract, if any.
Additionally, pursuant to Section 2252.908 of the Texas Government Code, a successful
respondent awarded a contract greater than $1 million dollars must submit a disclosure of

7.1 EXPENDITURE PROPOSAL
Attached Form B — Expenditure Proposal of this RFA includes the template for
submitting the Expenditure Proposal. Applicants must complete this form and place it in a
separate, sealed package, clearly marked with the Applicant's name, the RFA number, and
the RFA submission date.
Using Form B — Expenditure Proposal, Respondents must:
Demonstrate project costs outlined in the Expenditure Proposal are reasonable,
allowable, allocable, and developed in accordance with applicable state and federal
grant requirements.
2. Identify costs to be requested from DSHS.
3. Utilize the DSHS template provided as Form Band per the instructions outlined below.
Applicants must base their Expenditure Proposal on Appendix A - Program
Requirements. This section should include any business, economic, legal, programmatic,
or practical assumptions that underlie the Expenditure Proposal. HHSC reserves the right
to accept or reject any assumptions. All assumptions not expressly identified and
incorporated into the contract resulting from this RFA are deemed rejected by HHSC.
Applicants must demonstrate that project costs outlined in the Expenditure Proposal are
reasonable, allowable, allocable, and developed in accordance with applicable state and
federal grant requirements.
Applicant must utilize the HHSC template provided, and identify costs to be requested
from HHSC and costs to be matched. Costs must be broken out to a degree that is sufficient
to determine if costs are reasonable, allowable, and necessary for the successful
performance of the project.
Costs will be reviewed for compliance with UGMS and federal grant guidance found in 2
CFR Part 200, as modified by UGMS, with effective given to whichever provision imposes
the more stringent requirement in the event of a conflict.
Costs included in the Expenditure Proposal will be entered into budget tables and supported
by narrative descriptions describing the need for the requested cost and a calculation
demonstrating how the cost was arrived at.

ARTICLE VIII. GENERAL TERMS AND CONDITIONS
8.1 GENERAL CONDITIONS
8.1.1 Costs Incurred
Applicants understand that issuance of this Solicitation in no way constitutes a commitment
by any System Agency to award a contract or to pay any costs incurred by an Applicant in
the preparation of a response to this Solicitation. The System Agency is not liable for any
costs incurred by an Applicant prior to issuance of or entering into a formal agreement,
contract, or purchase order. Costs of developing Solicitation Responses, preparing for or
participating in oral presentations and site visits, or any other similar expenses incurred by
an Applicant are entirely the responsibility of the Applicant, and will not be reimbursed in
any manner by the State of Texas.
8.1.2 Contract Responsibility
The System agency will look solely to Applicant for the performance of all contractual
obligations that may result from an award based on this Solicitation. Applicant shall not be
relieved of its obligations for any nonperformance by its contractors.
8.1.3 Public Information Act
Solicitation Responses are subject to the Texas Public Information Act (PIA), Texas
Government Code Chapter 552, and may be disclosed to the public upon request. Subject
to the PIA, certain information may be protected from public release. Applicants who wish
to protect portions of the Solicitation Response from public disclosure should familiarize
themselves with this law. Information pertaining to the Solicitation will be withheld or
released only in accordance with the PIA.
8.1.4 News Releases
Prior to final award an Applicant may not issue a press release or provide any information
for public consumption regarding its participation in the procurement. Requests should be
directed to the HHSC Point of Contact Identified in 3.4.1.
8.1.5 Additional Information
By submitting a proposal, the Applicant grants HHSC the right to obtain information from
any lawful source regarding the Applicant's and its directors', officers', and employees':
(1) past business history, practices, and conduct;
(2) ability to supply the goods and services; and
(3) ability to comply with contract requirements.
By submitting a proposal, an Applicant generally releases from liability and waives all
claims against any party providing HHSC information about the Applicant. HHSC may
take such information into consideration in evaluating proposals.

The proposed RV resort project will at 66 pads. We will provide total management of property
with manager on site and staff at 24 hours for traveler's assistant. Each RV pads will have a state
of art pedestal with utility connections, water, 50 A Q electric & internet WiFi at location.
There is a 4" sewer connection for RV at designated location within the 5' grass area.
The site will be fenced on all 4 sides and provide the camera and security systems for
monitoring. The office will be facing south by,the Hwy side to monitor the site and visible
activities of traffic in and out.
Since the property is located in the flood hazard. All structures will be constructed a minimum of
18" inches above the Base Flood elevation or be flood proofed to 18" inches above the Base
Flood Elevation. In addition, all electrical hook-ups will be at least 18" inches above the Base
Flood elevation. All sewer hook-ups will be designed so they can be completely sealed in the
case of a flood.

The proposed RV Resort will be designed by license professional engineer in state of Texas which will
provide adequate drainage calculation with detention pond and outfall discharge point as per drainage
study. All the private utilities will comply with the plumbing codes requirements and 8" C-900 waterline
extension within the proposed 10' exclusively waterline easement and provide fire hydrant as per firet
code. All roadways will be 6" reinforced concrete pavement with drainage and grading design.
o The design, location and arrangement of all driveways and parking spaces provides for the safe and
convenient movement of vehicular and pedestrian traffic without adversely affecting the general
public or adjacent development;
The proposed RV Resort will be designed for all safety requirements of TxDot drainage criteria, one 40'
wide entrance and radii to meet the guidelines and provide safety ends at each side of driveway. There
will be stop sign at the exit entering to Hwy 124. All road ways are design for 20' wide fire truck
accessibility with all turning radii of 25' as shown on site plan. There will be guest 35 parking spaces.

The proposed RV Resort will be regulated by the property management team, as part of their job

Dear Members of the Zoning Board,
My name is Christopher Scott Reeves, and I am seeking approval by the Zoning Board of
Review of the Special Use Permit proposed for Struggle Street Brewing Company. The proposed
business will be a brewpub' located at 2140 Calder, Beaumont, Texas, and is in accordance with
the Comprehensive Plan presented below.
The proposed brewpub will be a business where beer and wine will be sampled and
served on site over the counter. Craft beer will also be produced using a 3bbl brewhouse and
utilizing 3 x 3 bbl fermenters producing approximately 250 bbls per calendar year. The current
hours of operation are expected to be Wednesday — Saturday from 1 pm to 10 pm, and Sunday
12 pm to 6 pm. We anticipate employing approximately two to four local members of the
community that will aid in the daily operation of the family based pub.
There will be approximately forty to fifty seats inside using both tables and bar top
seating, in addition there will be an outdoor patio area with seating and games for patrons to
enjoy.
The servers, bartenders, and management will be responsible for checking identification
as per the current TABC guidelines to ensure that no one under the legal drinking age of twenty-
one will be served.
With Beaumont being the largest city in Texas without a brewery, I feel the community
here, including all of Southeast Texas, is ready for a place to enjoy time with friends, alongside a
consistent, desirable, quality craft beer that was brewed onsite by local friends.
The current buildings surrounding our location are all commercial in nature, including
two behind ours. One is/was the Green Beanery which is currently closed and has been vacant
for several years. The other is a Veterans center, which currently has a privacy fence between
their parking lot, and the twenty -foot alleyway separating us. The brewery will not be a
nuisance, nor impede any activity or development of the surrounding properties.
In accordance with Section 30-26.E of the Zoning Ordnance, the following requirements
have, and will be met:
1.) The specific use of the location is compatible with and not injurious to the use and
enjoyment of other property, nor will the location cause any diminish of values in
property within the immediate vicinity;
2.) The establishment will not impede the development and/or improvement of any
surrounding vacant property;
3.) The facility has adequate utilities, access roads, drainage, and all other necessary
supporting facilities regarding the establishment;
4.) The location and design of driveways are safe, and parking is provided to allow
convenient vehicular and pedestrian movement without affecting the general public or
traffic flow;
5.) Nuisance prevention measures will be taken, beginning with a privacy fence to
control any noise. Ventilation will be installed as needed for dust and fume
management;
6.) No lighting will disturb adjacent properties;
7.) Screening via privacy fence will be in place to ensure harmony with any and all
adjacent property;
8.) The proposed use of 2140 Calder, Beaumont, Texas, is in accordance with the
Comprehensive Plan presented.
I am urging the Zoning Board to consider and approve the proposed special use permit, as
I strongly believe the establishment will be an exciting addition to the City of Beaumont.

BACKGROUND
Shalom Health Care Center has requested a Specific Use Permit to allow an alcohol and drug
rehabilitation facility at 950 Washington Boulevard. More than half of the property is zoned
GC -MD (General Commercial -Multiple Family Dwelling). However, the portion of the property
where the alcohol and drug rehabilitation facility will be located is zoned RM -H (Residential
Multiple Family Dwelling -Highest Density). The applicants state that the facility will begin by
only treating adult female patients, but that adult males would not be denied. Patients will remain
at the facility for 15-20 days. The facility will have 8 beds available for detoxication and 16 beds
available for residential post -detoxification treatment. In addition, the facility will offer outpatient
programs for alcohol and drug abuse.
Security will be provided by an eight foot fence around the entire facility along with 24 hour on
site security guards. Security cameras will also be used. Patients will not be allowed outside of the
building during treatment.
At a Joint Public Hearing held on January 28, 2019, the Planning Commission recommended

I, on behalf of the Board of Directors of Shalom Health Care Center and on behalf of
physicians, nursing staff, counselors, and behavioral health expert; would like to express
MY profound gratitude and utmost thanks for your leadership and commitment to the
community development and towards positive city planning services. Special thanks to
all those who provided their insight, guide us and walk through to understand this
application process.
The Shalom Health Care Center has a vision to establish comprehensive medical clinics
that served underserved areas of Jefferson, Hardin, Orange, Newton, Jasper and liberty
Counties. Our mission is to provide holistic behavioral and mental health services,
including outpatient, residential and hospital-based services. We are projecting that our
property located at 950 Washington Blvd. Beaumont, Texas will be the medical complex
that create more than17o new jobs, 24 hours residential care and 4o bedded facility (24
hours residential and 16 hospital-based patients.) This new medical complex will provide
access to unavailable behavioral and mental health services in the area.
Background
Addiction is a complex disease: It deteriorates human brain performance, thereby
impairing the ability to make sound judgments and decisions, which then leads to
character deterioration and can eventually cause total self-destruction. Addiction not only
impacts the individual; it also disrupts their surroundings, families and community at
large. As troubling as that sounds, this disease is treatable, and recovery is possible if
effective interventions are put in place to address sustainable recovery.

SHALOM HEALTH CARE CENTERS
Substance and Alcohol addiction kills 115 adults daily; which is more than 42,000
Americans each year. This number iso six times more than what American army had lost
soldiers in Iraq and Afghanistan war. Consequently, the President of the United States
has declared addiction epidemic and will use all state and national resources to control,
prevent and treat substance use addiction.
Strategies for dealing with drug addiction risks should be designed to offer a
comprehensive program that starts with preventive education and goes all the way to
cover detox, recovery, post recovery education and sober living for those who are
addicted.
Shalom Health Care will provide preventive education and public awareness about
substance use and its social and economic implications on individuals and families. A
comprehensive post rehab program will be developed to ensure that those treated
returning home are fully supported on a sustained basis by the local community before
entering a productive life without any communal stigma or isolation. Additional addiction
treatment centers are needed to provide detox and rehabilitation services in the Southeast
Texas region.
Shalom Health Care Center is requesting the Planning and Development Department to

outpatient and residential recovery center in the buildings located at 950 Washington
Blvd. Beaumont Texas. Following are the highlights:
SUP — Request Highlights
• Master Plan -of the property is attached. Currently 950 Washington Blvd, has 5
buildings. They are designated as 950/1 to 950/5 Buildings:
• Only 950/3 & 4 buildings will require Special Use Permit for the purposes to establish
medical clinic, outpatient drug rehab and recovery programs. The 950/3 building
(Former UTMB — H shaped Building) which is almost 8,000 SF will be used for
comprehensive medical clinic and outpatient drug rehab services. However, 950/4
building; covered area = 6,304 SF will be used for inpatient residential care.
• These buildings will be used to treat substance use and alcohol abuse patients in
outpatient and residential care setting. The Facilities will be licensed by the Health
and Human Services commission for the treatment of addiction related patients. The
Licensed facilities will accommodate 24 Beds for Detox and Residential treatment.

Patients will stay overnight from 3-5 days in Detox and 12-15 days in follow up
residential care. Patients will remain in the facility till they axe fully recovered. It is
expected that in the first phase only female patients will be admitted, however, adult
males will not be denied. Patient ages 18 and above will be admitted. There will be no
persons from the Department of Justice or incarceration will be admitted.
• Outpatient Treatment Program; patients in need of alcohol and substance use treatment -
will find the tools and support they need to turn their lives around. Medical clinic and
outpatient drug rehab will operate in 950/3 Building. (SUP Requested Site).
Shalom Health Care. Center Outpatient Services recognize that everyone comes to recovery
under unique circumstances and that most patients must also keep up with work,
schooling, and family responsibilities; will be facilitated by a Licensed Chemical
Dependency Counselors and professional physicians. Integrated medical, behavioral
and mental health center will be established to address needs of underserved in the
region. Medical Clinic, Drug Rehab outpatient center will be the entry point for
residential inpatient drug rehab program.
• Inpatient Residential; Shalom Health Care wilt offer inpatient 8 -bed detox in our
residential facility Building 950/4 (SUP Requested. Site). In addition to that 16 -bed
residential post detox treatment facility will provide comfortable, home -like setting,
onsite. Our medical team will provide inpatient detox services. We will provide
around-the-clock monitoring and use the latest evidence -based medications.
• SubstanceAbuseAssessment; For those who maybe developing a chemical dependency,
early assessment can highly warning signs before more serious problems develop. For
others, a professional substance use and alcohol assessment may be the first step
towards effective treatment recovery.
• The facility will provide counseling services, medical exams, group therapies,
recovery, rehabilitation and family support services. Whereas, patients will have
dining area, bathrooms, showers, laundry space and family waiting areas.
• More than 6o people will be employed for direct patient care in the residential setting,
however, more than 50 individuals indirectly will be benefitted which including
transportation, security, catering, pharmacy, delivery, washing and laundry, yard
maintenance, building maintenance, computer personnel, marketing, medical coding
and recording services.
• Security Measures; the facility will be 8 foot fenced, 24 hours security guards will be
in the campus, CCTV cameras will be in place, and security post will allow in and out
of permitted individuals. Building is completely cordoned with fences for patient's

safety. Patients will not be allowed to leave the building during treatment procedure
and services till fully recovered. Due to privacy reasons patients will not be seen by the
community or neighbors.
We are requesting the Planning and Community Development Department to grant
Shalom Health Care Center Special Use Permit for the Buildings 3 & 4 located at 950
Washington Blvd. to operate outpatient medical clinic, drug rehab and inpatient
residential drug recovery program. All other buildings are according to zoning code
requirements.

Answers for Section 30-26E by Shalom Health Care, Beaumont, Texas
1. That the specific use will be to provide inpatient residential treatment services to
the substance use and alcoholic abuse patients. This facility will not accept
inmates or persons from the Department of Justice. This building will not provide
any enjoyment or entertainment in the facility. This facility will exclusively be
used for medical purposes and specifically for inpatient residential recovery
services with authorized access. This facility will have all CC TV Camera and open
areas will be fenced. Access will be allowed through security measures.
2. Because this facility will be the part of Shalom Health Care Center's medical
complex. The inpatient residential facility will have confined public access. This
facility will increase the value of the surrounding properties.
3. Necessary road, utility, drainage and other necessary facilities already exist. No
other development is needed.
4. Since this facility was previously operated by the City of Beaumont, Health
Department and the University of Texas Medical Branch, facility is completely
built according to ADA complaint with enough parking spaces with easy access
and driveways. No further construction.or improvement is needed.
5. There will be no nuisance, offensive odor, fumes, dust, noise and.vibration. This
will be in fact; quiet, clean and supervise facility.
6. All directions signs will be installed, few parking lights already exist, however, if
needed will be installing according to city code compliance.
7. Sufficient land scape already exists, all green spaces lawns are in good shape.
8. The building is according to Shalom Investment, Beaumont Comprehensive Plan.

REHABILITAITON FACILITY IN AN RM -H (RESIDENTIAL
MULTIPLE FAMILY DWELLING -HIGHEST DENSITY)
DISTRICT AT 950 WASHINGTON BOULEVARD IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, Shalom Health Care Center has applied for a specific use permit to
allow an alcohol and drug rehabilitation facility in an RM -H (Residential Multiple Family
Dwelling -Highest Density) District at 950 Washington Boulevard, being Lots 15-21,
Cartwright Addition and Y2 of the adjacent alley, Beaumont, Jefferson County, Texas,
containing 1.32 acres, more or less, as shown on Exhibit "A," attached hereto; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the request and is recommending approval of a specific use permit to allow
an alcohol and drug rehabilitation facility in an RM -H (Residential Multiple Family
Dwelling -Highest Density) District at 950 Washington Boulevard, subject to the following
condition:

• Construction plans must meet all requirements by Water Utilities for water
and sanitary sewer services, including the requirement of the City's rep -
treatment program
WHEREAS, the City Council is of the opinion that the issuance of such specific
use permit to allow an alcohol and drug rehabilitation facility is in the best interest of the
City of Beaumont and its citizens;

NOW, THEREFORE, BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this ordinance are hereby,
in all things, approved and adopted; and,
Section 1.
That a specific use permit to allow an alcohol and drug rehabilitation facility in an
RM -H (Residential Multiple Family Dwelling -Highest Density) District at 950 Washington
Boulevard, being Lots 15-21, Cartwright Addition and Y2 of the adjacent alley,
Beaumont, Jefferson County, Texas, containing 1.32 acres, more or less, as shown on
Exhibit "A," is hereby granted to Shalom Health Care Center, its legal representatives,
successors and assigns, as shown on Exhibit "B," attached hereto and made a part
hereof for all purposes, subject to the following condition:
• Construction plans must meet all requirements by Water Utilities for water
and sanitary sewer services, including the requirement of the City's rep -
treatment program.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein
above described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 28 of the Code of Ordinances of Beaumont, Texas, as amended,
as well as comply, with any and all federal, state and local statutes, regulations or
ordinances which may apply.
The meeting at which this ordinance was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.

REQUESTED ACTION: Council consider a resolution approving the purchase of a new
pothole machine for use in the Streets and Drainage Division.
BACKGROUND
On November 27, 2018, a work session was held at the Beaumont Municipal Airport. As
discussed during the session, Streets and Drainage is requesting a new paver, to aid in pothole
repair. The paver will be purchased from Mustang Cat, of Beaumont, Texas in the amount of
$139,500.00.
Pricing was obtained through the BuyBoard purchasing cooperative, which provides cities and
political subdivisions the means to purchase specialized equipment at volume pricing. Buyboard
complies with State of Texas' procurement statutes.
A warranty of twelve (12) months is included, as well as training/commissioning on the first
actual useage of the equipment.
FUNDING SOURCE
Capital Reserve Fund.

(77) unit housing development, located at the northwest corner of Veterans Circle. Also,
Herman & Kittle has requested that the City approve a resolution supporting the project,
acknowledging that Beaumont has more than twice the state average of housing units supported
by Tax Credits and that Beaumont will participate financially in the project. This participation
can be as little as a $500 fee waiver from the City.

Dear Community Partner,
On behalf of Herman & Kittle Properties, Inc., I am pleased to introduce Laurel Vista, a proposed
residential apartment community. Herman & Kittle Properties, Inc. will submit an application for 9%
Housing Tax Credits to the Texas Department of Housing and Community Affairs (TDHCA) for
Laurel Vista, which will be located at the Northwest corner of Veterans (Plaza 10) Circle in Beaumont
in Jefferson County. This New Construction development for seniors will be composed of up to
approximately 77 units reserved for income eligible households, as defined by TDHCA. The residential
density of the Development will be approximately 11 .5 units per acre.
Laurel Vista will provide residents with high-quality, modern appliances and, finishes, as well as
planned activities and many community amenities. The project details such as the architecture, building
materials, and final amenities are in the design phase and will be finalized prior to construction.
In the spring, the Texas Department of Housing and Community Affairs will hold public hearings in
various locations around the state to gather input on ,Competitive Housing Tax Credit applications;
comments can be made on any and all applications at each hearing. The hearing schedule along with
contact information for written public comment will be posted on TDHCA's Public Comment Center
website later this year.

The Texas Department of Housing and Community Affairs (the "Department") is in receipt of a preliminary
application(s) for possible funding through the Competitive Housing Tax Credit Program to develop or acquire
affordable multifamily rental housing in your community.
This notification is made in accordance with Tex. Gov't Code §2306.1114 to ensure that you are fully informed of the
