HomeMy WebLinkAboutORD 19-001ORDINANCE NO. 19-001 ENTITLED AN ORDINANCE VACATING AND ABANDONING A 20' x 150' WIDE UTILITY EASEMENT LOCATED AT 2290 GULF STREET, CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, Garrett Carter, on behalf of Hankins Development, has applied for an abandonment of a 20' x 150' wide utility easement located at 2290 Gulf Street, as described in Exhibit "A" and shown on Exhibit "B," attached hereto; and, WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the request and is recommending approval of an abandonment of a 20' x 150' wide utility easement located at 2290 Gulf Street, City of Beaumont, Jefferson County, Texas, subject to the following condition: ; and, • Developer must set a new manhole at the end of the abandonment. The manhole must be constructed to' City standards and specifications, meeting all testing and acceptance requirements WHEREAS, the City Council has considered the purpose of said abandonment and is of the opinion that the utility easement is no longer necessary for utility purposes and the abandonment of said utility easement is in the best interest of the City and should be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT a 20'x 150' wide utility easement located at 2290 Gulf Street, as described in Exhibit "A" and shown on Exhibit "B," attached hereto; be and the same is hereby vacated and abandoned and that title to such properties shall revert to and become the properties of the persons entitled thereto by law, subject to the following condition: Developer must set a new manhole at the end of the abandonment. The manhole must be constructed to City standards and specifications, meeting all testing and acceptance requirements. In the event the condition of abandonment is not satisfied within a reasonable period of time the abandonment will become null and void and will revert back to and once again become an easement held by the City of Beaumont for utility purposes. The meeting at which this ordinance was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
