Whereas,, The Triistees' of. the South Park Independent School District have requestedpermission of the City of Beaumont.. to connect the School known,as the South Park School with the City Sewerage system, by a sewer line„ from the City Limits, to - said South. Park School, and Whereas, the City. of Beaumont is desirous. of_-gi'aing - the said Trustees permission to connect with tho-said,_sewerage ,,.-system, of t#e City of Beaumont,, Now, Therefore, . Be it Ordained, by the .City Council of the City of Beaumont,-' That said South Park Independent Sohool District curl the Trustees thereof shall lay'a sewer linp,of such site a,nd capacity as may be determined, from the intersection of Zee Street and Sabine Pass Avenue, in the City of Beaumont-,., to the South Park School buildings and property, on Highland'Aven$eo• Said sever shall be laid under plans and specifications . approved by the City Engineer of the City of Beaumont, and,, when completed sha 11 be approved by the said City Engineer before connection is made between said portion 'of said -line and that portion of same. South' of the City Limits., or before said line is . put in operation. NU SEC OND. The City Engineer and' the Board- of Public Works: of the City of Beaumont shall have full control over all of said line within the City Limits, and the City of Bea um, ont ahs ll have the right to' grant permission- to any'-.other'person or v persons to connect with said sewex within said City Limits. The sewer line herein provided for; from the point of connection at the City Limits Southward, Is for the sole use of the South Park School, and no other- person. or persons, shall have the right to oonnect therewith wit4out the.written consent of the City, of ' Beaumont Sand the South Park School Trustees, granteen herein, accept this permit on the express_ provision ; that if any -other use is made of said line than the. service to the South Park School, without .the City'a approval, and such, misuse oont inue for a period of thirty days after -written notice thereof given to the South Park Sehoo7. District by the City,, the City Engineer shall at .once disconnect said: sewer line -at the City Limits from the '.sewer line within -said City Limits, and this permit shall become null and void. FOURTH. ----Sai.d:-_sewer lineI-within., the --limits -of t -he City. of Beaumont, shall when laid at once become the property of the City of Beaumont, and in consideration therefor, the said South. Park School District is- given ,the right, to use same ..under and subject to -the. provisions of this ordinance.. Should any provid-on of this ordinance be violated by eaid South Park School District''by permitting other ..conneetions into said sewer line,`or otherwise, and such violation continue for a.period of thirty days after -written notice of same given to the Trustees of said. South Park School District, then the rights herein granted said. School District shall .terminate, and said District shall have nofW2t.her right to ma inta in a connection into or -make use of said sevier line: within the City.Limits of Beaumont, and the City of, Beaumont may at .once disconnect said line at the City Limita. FIFTM That the South Park Independent School District shall hold the City of Beaumont':free and harmless from all liability whatever' by reason of the City's, permitting the said CPO, O, 1 -0 q 17 School District to connect with the City sewer system, and that in accepting -the permit herein granted by the Cdtty of Beaumont, said grantee agrees.that no guarantee of any kind whatever as to the sewer service is given by -the City, but that asid School Distriot' shall assume all responsibility for sai&- -seAzr - li.ne', and that this ordinance is simply t o : permit said South Park Independent School District to use the sewer system of the City 'of Beaumont, including the line .herein provided for within the City Limits, under such 'tules as the City may from time to time prees,eribe-, and that the said grantee shall, upon the passage of this Ordinance'9. file a letter of acceptance -with the .City. Countil of the. City of Beaumont atsting that they accept said permit and all of the terms and conditions herein set forth This Ordinance shall become null and voi& unless said acceptance is filed with the said City Ccu.noil within thirty : dsys :from the passage of this: -.Ordinance. SIXTH. Whereas, the South Park School is badly -in need of sewer conneotiIons and has no other method.of furnishing itself with same, and the City Council of the City of Besumont . deems it to be to,the beat interest of the -City -to permit the said School District to connect with the sewer system of the City of Beaumont, these facts create an.imperstive public need, necessitatiing the suspension of the rule requiring Ordinanoes to be reed at three several meetings of the City. Council, ".and aid rule is hereby suspended and this Ordinanoe shall go' into full force and effect from easel after its passage and publication.
