AN ORDINANCE
AN ORDINANCE AUTHORIZING THE VACATING AND CLOSING
OF THE ALLEY LOCATED IN BLOCK TWO.(2),,THE ALLEY
RUNNING NORTH AND.SOUTH IN BLOCK THREE (3), THE
ALLEY.RUNNING EAST AND.WEST,IN BLOCK THREE (3),
AND McKINLEY AVENUE RUNNING BETWEEN BLOCK THREE (3)F.
AND BLOCK TWO .(2), ALL IN2THE STOCKHOLM ADDITION'TO
THE CITY- OF BEAUMONT, ' TEXAS .
WHEREAS, a petition signed by the owner 'of all of the prop-
erty abutting the alley located in Block.Two (2), the alley running
north.and south'in Block:: Three(3), the alley running east and west
in Block Three:(3), and McKinley Avenue running between Block Three
(3) and Block Two (2), all in the Stockholm Addition to The City,of
Beaumont- has been presented to.'the City Council of The City of
Beaumont, requesting that said alleys and.said street be -vacated
and abandoned, and,
WHEREAS, said petition has been referred to the City Plan-
ning'CorAmission�for study, investigation and recommendation to the
City'Council as to whether such proposal. shouldbe approved, and.
.the -City Planning Commission has thoroughly studied and,investigated
said proposal and recommended,to the City Council that the approval
of the.proposal would be to the best interest and benefit of the,
public, and_that'said proposal should, therefore -,.be approved; -and,
WHEREAS,. it is to.the best interest of The City of Beaumont
and benefit to the public that the above-mentioned alleys.and street
be vacated and closed;;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT,
TEXAS:
.That the alley.located in Block.Two (2), the alley running north
and south in .Block Three (3), the alley running east and west in
Block Three (3), and McKinley Avenue running between Block Three
(3) and Block Two (2), all.'in the Stockholm Addition to The City`of
Beaumont, Texas, be, and the same are hereby, authorized to be

The attached map is the site of the Dunbar Jr. High School
and the area which is shown in red represents a portion of the
ground on which negotiations for the purchase of the property are
complete. The portion that is shown in yellow represents land
which is being purchased at the present time.
We are very anxious to have McKinley Street and all the
alleys leading into McKinley officially closed by the City govern-
ing body in order to allow the school district to build a building
which will extend over a portion of McKinley Street.
We have set a date for taking bids on this project for
March 6th and we would like to have immediate action by the City
officials at the earliest possible date, which I understand will
be February 12th.
I am providing this same plan to the officials of the
United Gas Corporation, Gulf States Utilities Company, and the
Southwestern Bell Telephone Company in order that they might make
an immediate investigation as to whether or not they will have any
future need of the street and alleys in this particular area for
their services. They should be ready at once to answer any question
that you might have to ask them in connection with this.
Will you please rush this matter in order that we will
have a definite answer by the middle of February.

You have received copies of the letters which I have
written to Gulf States Utilities Company, Southwestern Bell
Telephone Company, and United Gas Corporation, concerning the
Dunbar Jr. High School site.

I wish to assure you further that if it is necessary
for any utility line, including water and sewerage, to be moved
in this area in order to service any of the houses that will be
left on Irving Street, we will be glad to.pay the cost of such
moving and to furnish an easement along the west side of the
school property from Cuniff Street to Shamrock Alley.
I wish'to call your attention to the fact that it has
been necessary for us to change one thing in connection with the
purchasing of the property adjacent to and on each side of
Shamrock Alley. The plan which I sent you showed that we were
going to purchase this property to within sixty (60) feet of
Irving Street, but for several reasons it has been necessary that
we change and we are going to purchase the property to within one
hundred thirty-five (135) feet of Irving Street. This will be
more in line with the other property which we are purchasing in
this area which extends approximately one hundred thirty (130)
feet, more or less, from Irving Street.
In the event the City places a street and railroad
along the east side of Irving Street, I am sure that the Board
will be glad to purchase from the City the surplus property that
the City will have between the street and railroad area and the
school site.

I have received a copy of your letter addressed.
to the City of Beaumont, attention Mr. J. D. Martin, con-
cerning the Dunbar Jr. High School site and'I wish to -ex-
press to you our sincere thanks for your quick response in
connection with this matter. .
I will assure you that all the houses, which were
included in the areas shown in both red and yellow on the
map which I sent you, will be purchased.
According to the information which I have obtained
.from united Gas officials it will not be necessary for you
to use any portion of McKinley Street or any of the alleys
within'this'area for service lines, however, if you should''
need an easement, or should it be necessary that any of the
lines in this area be changed to another location in order
to serge the buildings in the rear of the houses fronting
on Irving Street, we will be glad to pay the cost of moving
such lines and also to furnish you with all easement on the
west side of"our school property from.Cuniff Street to
Shamrock�Aliey.

This refers to your letter of February 1, 1957
addressed -to rlr. S.. D. Martin.,City-"Engineer, concerning,
the' closing of the alleys leading into I`IcKin7ey Street at
the site . of the proposed Dunbar- junior High School.
The poles in this area are. ov ed by the.Gulf States
Utilities Company. We,have ho•objection to the abandoning
of these, easeiuents. and, have, issued the, orders. necessary
for the. removal of our. -plant from. these poles when they.
are .removed. We. know of only one factor that .will .interfer
with the closing of . Shamrock .Alley. An easement' will . b.e
required on Shamrock to anchor:.a lead of our facilities extend-
ing -east from.Ir.ving Street' With this exception we will
have no need, for. -the Shamrock Alley and McKinley Street ease-
mbnts after homes have.'been removed.
We hope this meets with. your.-re.quirements but if any
further information is needed, please let us know.

Reference is made to the February 1, 1957 proposal of Beaumont
Independent School District to close McKinley Street and alleys
leading into it from Irving Street.
United Gas Corporation will not have any main distribution
facilities that can not be removed if the proposed purchases
are consumated.
In event the proposed purchases, shown in yellow on the sketch
attached to letter of February 1, 1957, are completed, United
Gas Corporation will have no objections to the closing of
McKinley Street and alleys.
