AN ORDINANCE
ENTITLED AN ORDINANCE AUTHORIZING THE VACATING,
AND.ABANDONMENT OF AN ALLEY LOCATED IN BLOCK 46
OF THE VAN WORMER ADDITION TO THE CITY OF BEAU:
MONT, TEXAS, AND WAIVING THE RIGHT OF THE CITY
OF BEAUMONT TO CONSTRUCT AND MAINTAIN IN SAID
ALLEY SEWER LINES, WATER LINES AND OTHER UTILITIES
AND WAIVING THE RIGHT OF THE CITY-OF.BEAUMONT TO
GRANT FRANCHISE RIGHTS TO OTHERS TO.CONSTRUCT AND
MAINTAIN UTILITIES THROUGH AND ALONG SAID ALLEY,
AND'REMOVING.THE PROHIBITING OF THE OBSTRUCTION OF
SAME BY ANY BUILDING OR STRUCTURE.
WHEREAS, under date.of February 21, 1956, the City Council
of The City of Beaumont by ordinance. authorized the vacating and.
abandonment of the alley located in`Block 46.of the Van Wormer Ad-
dition to The City of Beaumont, as provided by law, but provided
in said ordinance that the vacating and abandoning of same would
in no way affect the right of The City of Beaumont to place and
maintain any public utilities service therein, nor should said
action affect.the right of The City of Beaumont to grant franchises
to any persons for a public utility service in said alley; and,
WHEREAS, said ordinance further provided that same shall
not be construed as authorizing or permitting the placing of any
permanent structure in that part of the alley so abandoned without
permission of the City Council; and,
WHEREAS, the owners of all of Block.46 of the Van Wormer
Addition to The City of Beaumont have now presented a petition re-
questing the City to abandon the alley in said block without reser-
vation; and,
WHEREAS, the City Council is of the opinion that_there.is
no necessity for reserving utility rights in the abandoned alley,
and that same -should now be vacated and abandoned without reserva-
tion;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAU-
MONT, TEXAS:
That the alley running through Block 46 of the Van Wormer Addition
to The City of Beaumont be, and the same is hereby, authorized to
be vacated, abandoned and closed, and that the title to said
vacated,, abandoned and closed alley shall revert to and.become the
property of the parties entitled thereto, as provided by law.

The undersigned, being the sole owner of all of
the property abutting on the alley in Block 46 of the
Van wormer Addition to the City of Beaumont, Jefferson
County, Texas, hereby respectfully petitions that said
alley located in said Block 46 of said addition be
closed, vacated, and abandoned in the manner and as
permitted by the statutes of the State of Texas and the
Charter of the City of Beaumont, and that such alley
become, without any reservations or restrictions whatever,
the absolute property of the undersigned as owner of the
land in said Block adjacent and abutting on said alley.

COMMENT:
Attached is petition signed'by Ewell Strong for Alco
Products, Inc. for the closing of the alley in Block 46 of the
Van Wormer Addition to the City of Beaumont.
The Water Department has advised that there is no
water line in the alley.
Please investigate this request further and return to
me for presentation to the City Planning Commission.

Gentlemen:
Reference is made to certain requests of interested parties to
close the alley in Block 46 of the Van Wormer Addition within
the City of Beaumont. This block is bounded by Bonham and
Crockett Streets and Avenues A and B.
The gas lines within the said alley are used only for the pur-
pose of serving Alco Products, Inc. and will not be extended
to serve other customers.
We have no objections to the closing of this alley.

We have no facilities in the alley running
through Block 46 of the Van.Wormer Addition to
the City of Beaumont, and we do not contemplate
the placing of any at this location in the fore-
seeable future. Since this alley is not being
used by us we have no objection to its abandon-
ment, as requested by Alco Products, Incorporated.

Dear Mr. Martin:
Mir. Ewell Strong has written to me in behalf of the
Alco Products, Incorporated, concerning existing easements
in the alley of Block !+6 of the Van Wormer Addition.
After a complete investigation, we find that we do not
have any telephone facilities located in this alley, nor do
we plan to place facilities. there. We do not have any ob-
jections to this alley being ,closed.
