AN ORDINANCE
ENTITLED AN ORDINANCE AUTHORIZING THE VACATING AND
ABANDONMENT OF AN ALLEY LOCATED IN BLOCK EIGHTY-
THREE (83) OF THE CARTWRIGHT ADDITION IN THE CITY
OF BEAUMONT, TEXAS, RESERVING, HOWEVER, THE RIGHT
OF THE CITY OF BEAUMONT TO CONSTRUCT AND MAINTAIN
IN SAID ALLEY SEWER LINES, WATER LINES, AND OTHER
UTILITIES, AND RESERVING THE RIGHT OF THE CITY OF -
BEAUMONT TO GRANT FRANCHISE RIGHTS TO OTHERS TO CON-
STRUCT AND MAINTAIN THE UTILITIES HEREINBEFORE
MENTIONED THROUGH AND ALONG SAID ALLEY, AND PRO-
HIBITING THE OBSTRUCTION OF SAME BY. ANY BUILDING OR
STRUCTURE.
WHEREAS, a petition signed by all of the property owners
of Block Eighty-three (83) of the Cartwright Addition to The City
of Beaumont has been presented to the City Council of The City of
Beaumont, requesting that the;- alley in said Block be vacated and
abandoned; and,
WHEREAS, said petition has been referred to the City Plan -
ping Commission for examination and approval, and the same has
been approved by said jCommission; and,
WHEREAS, said petition has been duly canvassed and examined
by the City Council and has been found to have been signed by all of
the property owners in said Block, and it appearing to the City
Council that the request of said property owners'should be granted
and that an ordinance should be enacted vacating and abandoning
said alley, reserving, however, to-.-� the City of Beaumont the right
to construct and maintain all necessary public utilities in said
alley, or to grant franchises for the construction and maintenance
of nsuch utilities in said alley;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT,
TEXAS:
That the alley running through Block Eighty-three (83) of the Cart-
wright Addition to The City of Beaumont be, and the same is hereby,
authorized to be vacated and abandoned,. and that the title to such
alley should revert to and become the -property of the persons en-
titled thereto, as provided by law; provided, however, that the

vacating and abandoning of said alley shall in no way affect the
right of The City of Beaumont to place and maintain therein sewer,
gas, and water lines, telephone, telegraph, and electric wires,
poles, and cables, or any other public utility service. Neither
shall the vacating and abandoning of said alley affect the right
of The City of Beaumont to grant franchises to any person, firm or
corporation authorizing the placing and maintaining in said alley
of such sewer, gas, or water line, telephone, telegraph, or elec-
tric lines, or other public utility service, all of which rights
are hereby expressly reserved. And the.vacating and abandoning of
said alley shall not be construed as authorizing or permitting any
person, party, corporation o r legal entity whatsoever to erect,
construct, build, move onto, or place any building or structure
thereon, and the erection, construction, building, moving onto, or
placing of any building or -structure therein without permission of
the City Council to do so is hereby prohibited.

tion, City of Beaumont, granting the Roberts Avenue Methodist Church permission
to close the alley of said block in the said addition of the city of Beaumont.
'We would like to request the City of Beaumont to deed the north 5 feet of the
above mentioned alley of the property belonging to the Roberts Avenue Methodist
Church, so the Church might build on it.

abutting on alley in Block 83 , of the Cartwright
Addition to the City of Deaumont, hereby respectfully petition that the
alley located in Block 83 , Cartwright Addition be
closed in the manner as permitted by the statutes of the State of Teras,
and that such alley become the absolute property of the owners of the land
in said block adjacent and abutting on such alley., it being understood,
however, that the closing of this alley shall in no way affect the rights
of the City as to placing and maintaining therein of any sewer or water
lines, or telephone, telegraph, or electric lines, vires, poles, or cables
or any other service or utility of the City, or the right of the City to
grant franchises to persons or corporations to place and maintain therein -
any such sel--rer or water line, or telephone, telegraph, or electric lines,
wires, poles, or cables, or any other service or utility of the City.

Dear Sir:
We have received your letter of September 1, 1955 con-
cerning the abandoning of a 20 foot alley running east and west
through the block bounded by Roberts Avenue, Prairie Avenue,
Victoria Street and Orange Street.
At the present time, United Gas Corporation does not
have any lines within the 20 foot width of the existing alley,
and we have no objections to substituting a 10 foot utility ease-
ment for the 20 foot alley tray.

VICTORIA AND ORANGE STREETS
Your letter of September lst, to Mr. Cargill has been
referred to me for reply.
We have investigated the alley in question and find
that we do have overhead electric facilities extending a
short distance into this alley from each of Victoria and
Orange Streets.
We offer no objection to closing of the alley provi—
ded the ordinance by which it is closed provides that we
have access to our facilities in the alley. However, we
could not agree to the substitution of a ten foot utility
easement with the same centerline of the present alley in
as much as our facilities are located approximately one
foot from the south line of the alley and would therefore
be outside of this proposed easement.
I recommend that the utility easement be made twenty
feet wide to include the area now incorporated in the
alley.

A survey has been completed as requested in your letter dated
September 1, 1955, and the Southwestern Bell Telephone Company does have
a line located nine feet south of the center line of the present alley.
To close the alley and dedicate an easement, as indicated in your drawing,
our line would have to be relocated approximately five feet north, which
would entail an expenditure of $699.52 that we feel should be borne by
those desiring the move.
The existing pole line is jointly occupied by Gulf States
Utilities Company, and changes made will have to be coordinated with
them by the parties desiring the move.
This company would prefer to have the south half of the exist-
ing alley dedicated as an easement if it can be agreed upon by the parties
involved.

Dear Mr. Beard:
The City has been -approached by the owner of the property
comprising the north one-half :of the block bounded by Roberts Avenue -
Prairie Avenue -Victoria Street -Orange Street on the possibility of
abandoning the 20 foot alley running east and west through this
block and substituting therefor a 10 foot utility easement, the center-
line of said easement being the centerline of the present alley.
Enclosed herewith is a print showing in red color the alley
to be abandoned and in green -color the proposed utility easement.
I would appreciate very much a letter from your company
stating whether it has an existing utility in this alley (if so, give
its location) and also if it has any objection to this alley's being
abandoned under the terms stated above.
