ENTITLED AN ORDINANCE ORDERING A
SPECIAL RECALL ELECTION FOR THE CITY OF BEAU-
�,4.ONT; SETTING THE DATE OF SAME; PROVIDING THE
PURPOSE OF SAME; PROVIDING TEE PLACES AT WHICH
SAID ELECTION SHALL BE HELD AND DESIGXATING
THE PLACES WHERE THE VOTERS SHALL VOTE; APPOINT-
ING THE . OFFIC ERS FOR SAID E a C TI ON; PROVIDING
THE ISSUE TO BE SUBMITTED AND FORM OF BALLOT;
PROVIDING INSTRUCTIONS FOR VOTING; PROVIDING
FOR EFFECT OF VOTES CAST; PROVIDING FOR NOTICE
OF SAID ELECTION AND DECLARING AN �ERGENCY.
WHEREAS, on the 27th day of July, A: D. 1943.,, there
was presented to and filed with -the City Commission of the
City of Beaumont a petition signed by more than 'twenty-five ._
per cent (25jo) of the qualified voters voting in the last ::rem:
gular election for City officials, requesting the City Com-
mission to order an election and fix a day for holding the
same for the purpose of determining whether or not G. H. Pet-
kovsek shall be removed from the office of City Manager of the
City of Beaumont by recall; and,
WHEREAS, it is the opinion of the City Commission
of the City of Beaumont that One (1) of the Four (4) papers
comprising said petition is regular in form and complies with
the Charter provisions of the City of Beaumont and the statutes
of the State of Texas and that said request presented in said
petition should be granted and said election ordered; and,
WHEREAS, it is provided in the Charter of the City
of Beaumont that the form_ of ballot shall conform with the fol-
lowing requirements:
(a) With respect to each person whose removal is
sought the question shall be submitted; "Shall (name of per-
son) be removed from the office of (name of office) by recall?"
(b) Immediately following each such question there
shall be printed on the ballots the two propositions, in the
order set forth

For the recall of (name of person).
Against the recall of ( name -of person) ; and,
WHEREAS, it is further provided in the Charter of
the City of Beaumont that a recall election shall be held
not less than thirty (30) nor more than fifty (50) days af-
ter the petition has been presented to the City Commission
at the same time as any general election held within such'
period, but if no such general election be held within such
period the City Commission shall call a special recall elec-
tion to be held within the time aforesaid; and,
WHEREAS, the Charter of the City of Beaumont fur-
ther provides -that should a majority of the votes cast at a
recall election be against the recall -of the officer named
on the ballot, such officer shall continue in office, but if
a majority of the votes cast at such recall election shall be
for the recall, of the officer named on the ballot, he shall
be deemed removed from office.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COIt'l1j:IS S I ON OF
THE CITY OF BEAUNC ONT:•
That an election be held in the City -of Beaumont,
Texas, on the 7th day of September., A. D. 1943, at which elec-
tion there shall be submitted to the qualified voters of the
City of Beaumont the following question:
"Whether or not G. Hughes Petkovsek shall be
removed from the office of City itiianager of
the City of Beaumont by recall."

That said election shall be held in the City of Beau -
wont in the following places, to -wit:
In the First Ward at French School Building,
Juinker School Building, Averill School Build-
ing, Central Fire Station, and Gladys Street
Fire Station.
In the Second Ward at the City Hall.
In.the Third Ward at the Sabine Pass Fire
Station, David Crockett Junior high School
Building, South Park Elementary School Build-
ing, Hebert School Building, and Magnolia
School Building.

That all voters residing in County Voting Precinct loo. One in.
the City shall vote at French School Building; that all voters
residing in County Voting Precinct No. Two in the City shall
vote at Junker School Building; that all voters redding in
County Voting Precincts Bio. Four in the City and that part of
County Voting Precinct No. Forty -Seven lying within the City
limits of the City of Beaumont shall vote at Averill School
Building, that all voters residing in County Voting Precinct.
No. Three in the City shall vote at Gladys Street Fire Station;
that'all voters residing in County Voting Precincts Nos. Six
and Seven in the City shall, vote at the Central Fire Station;
that all voters residing in County Voting Precincts Nos..Five,
Eight and Nine in the City shall vote at the City Hall; that
all voters residing in County Voting Precincts Nos: Ten and
Thirteen in the City shall vote at, Sabine Pass Fire Station;
that all voters residing in County Voting Precin t No. Fourteen
in the City shall vote at Miagnolia School Building; that all
voters residing in County Voting Precincts Nos. Eleven and
Twelve in the City shall vote at David Crockett Junior High
School Building; that all voters residing in County Voting
Precincts Nos. Fifteen and Sixteen in the City shall vote at
South Park,Elementary School Building; and that -all voters re-
siding in County Voting Precinct No. Seventeen in the City
shall vote at Hebert School Building.

The following named persons are appointed presiding
judges for their respective voting boxes in said Wards with the
authority to select their owrn clerks:
At the French School Building, Mrs. Lona Pennick;
At the Junker School Building, airs. J. E. Ray;
At the Averill School Building, 1lrs. Vera K. Fox;
At the Central Fire -Station; W. S. Siler;
At the David Crockett Junior High School Building,
F. L. Fisher;
At the City Hall, Ray V. Watson;
At the Sabine Pass Fire Station, Mrs. Ben Pipkin;
At the South Park Elementary School Building, Mrs.-
J.

That at said election said issue shall be submitted
separately and there shall -be printed on the -ballots to be used
in said election the following
Shall G. Hughes Petkovsek be removed from the
office .of City Manager of the City of Beaumont
by recall? _
For the recall of G. Hughes .Petkovsek
Against the recall of G. Hughes Petkovsek
5.
All voters desiring to vote for the recall of G. -
Hughes Petkovsek from the office of City Manager of the City
of Beaumont shall run a line through and across the paragraph
on said ballot containing the words "Against the recall of G.
Hughes Petkovsekt', and all voters desiring to vote against
the recall of G. Hughes Petkovsek from the office of City Mana-
ger of the City of Beaumont shall run a line through and across
theparagraph on said ballot containing the words ''For the re-
call of G. Hughes Petkovsek."

Should at said election a majority of the qualified
voters voting at said election vote in favor of the recall of
G. Hughes Petkovsek from the office of City Manager of the City
of Beaumont, then the said, G. Hughes_ Petkovsek shall be deemed
removed from said office.
7.
That a copy of this Ordinance signed by the Mayor
of the City of Beaumont and attested by the City Clerk of the
City of Beaumont shall serve as a proper and sufficient notice
of said election -and the Mayor is hereby directed to cause a
copy of this Ordinance signed by himself and attested by the
City Clerk to be posted at each of the places herein designated
for holding said election at least thirty (30) days prior to
the date of holding said election in the manner required by-law.

The fact that an Ordinance has not yet been passed
providing for and ordering a special recall election for the
purpose of determining whether or not G. Hughes Petkovsek
shall be removed from the office of City Manager of the City
of Beaumont by recall and that such an ordinance is necessary
creates an imperative public emergency necessitating the sus-
pension of the rule requiring ordinances to be read on three
several- days before their final passage; wherefore, said rule
is hereby suspended and. this Ordinance shall take effect from
and after its passage.
PASSED by the affirmative vote of all members of the
City Commission this 6th day of August, A. D. 1943.
