Home My WebLink AboutORD 37-OAN ORDINANCE AUTHORIZING THE VACATING AND CLOSING OF AN - ALLEY WHICH FORMS TNF' SOUTHERN BOUNDARY OF BLOCK TWO (2) OF THE C OUS INS ADDITION TO THE CITY OF BEAUMONT, RESERVING, HOWEVER, THE RIGHT OF THE CITY OF BEAUMONT TO C 0 NSTRUC T AND MAINTAIN IN SAID ALLEY SEWER LINES, WATER LINES, TELEPHONE, TELEGRAPH AND ELECTRIC LINES AND OTHER UTILITIES AND RESERVING THE RIGHT OF THE CITY OF BEAUMONT TO GRANT A FRANCHISE RIGHT TO OTHERS TO CONSTRUCT AND MAINTAIN THE UTILITIES HEREINBEFORE MENTIONED THROUGH AND ALONG SAID ALLEY. WHEREAS, a petition signed by all of the property owners of the Lots in Block 2 of the Cousins Addition to the City of Beaunont and a petition signed by the owners of all of the property located adjacent to and South and West of the alley which forms the southern boundary of Block 2 of the Cousins Addition to the City of Beaumont have been presented to the City Commission of the City of Beaumont requesting that the alley which forms the southern boundary of Block 2 of the Cousins Addition to the City of Beaumont be vacated and closed; and, WHEREAS, said petitions have been referred to the City Engineer for examination and approval and the same have been approved by him; and, WHEREAS, said petitions have been duly canvassed and examined by the City Commission and have been found to have been signed by all of the property owners in said Block and all of the property owners located adjacent to and South and West of said alley, and it appearing to the City Commis- sion -that the request of said property owners should be grant- ed and that an ordinance should be enacted vacating and clos- ing said alley, reserving, however, to the City of Beaumont the right to construct and maintain all necessary public utilities in said alley or to grant a franchise for the con- struction and maintenance of such utilities in said alley: NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO-INFIMISSION OF THE CITY OF BEAUMONT: 1 ; That the alley forming the southern boundary of Block 2 of -the Cousins Addition to the City of Beaumont, Texas, be and the same is hereby authorized to be vacated and closed and that the title to such alley shall revert to and become the property of the owners of land in said Block bordering on said alley and the owners of land adjacent to and South and West of said alley as provided by law, providing, however, that the closing of said alley shall in no way affect the right of the City of Beaumont to place and maintain therein sewer, gas, or water lines, telephone, telegraph or electric lines, wires, poles and cables or any other public utility service. Neither shall the closing of said alley affect the right of the City of Beaumont to grant a franchise to any person, firm or corpora- tion authorizing the placing and maintaining in said alley of such sewer, gas or water lines, telephone, telegraph or elec- tric lines or other public utility service, all of which rights are hereby expressly reserved. There: is no eater line in this alley and I have checked the owners of all lots in Block 2 and the . acre.age, tracts south of this alley and adjacent thereto.
