AN ORDINANCE
APPORTIONING A TAX OF SEVENTY-EIGHT CENTS ($.78) ON EACH
ONE HUNDRED DOLLARS VALUATION OF ALL TAXABLE PROPERTY WITHIN THE
PRESENT LIMITS.OF THE CITY OF BEAYM ONT, TEXAS, AND A TAX OF TWENTY-
SIX CENTS ($.26) ON EACH ONE HUNDRED DOLLARS VALUATION OF ALL
TAXABLE PROPERTY WITHIN THE PRESENT LD9ITS OF THE BEAUMONT INDE-
PEIZENT SCHOOL DISTRICT, LEVIED AND ORDERED COLTS CTED BY AN
ORDINANCE PASSED BY THE CITY CO�1MISSION OF THE.CITY OF BEAUMONT
ON THE 27th DAY OF OCTOBER, A. D. 1942, FOR THE PURPOSE OF PAYING
THE INTEREST AND CREATING A SINKING FUND FOR THE BOND ACCOUNTS
THEREIN MENTIONED; EXPRESSLY REPEALING THE APPORTIONING ORDINANCE
PASSED BY THE 'CITY C0'TV1MISSION OF THE CITY OF BEATRfiONT ON AUGUST
4th, 19420 AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDIN-
ANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COTVIlViISSION OF THE CITY OF
BEAUMONT, TEXAS:
,Section 1..
That the tax of Seventy-eight Cents ($.78) on each one
hundred dollars valuation of all taxable property within the limits
of the City of Beaumont heretofore levied for interest and sinking
fund accounts, other than school bond.accounts, and ordered collect-
ed by an Ordinance passed by the City Commission of the City of
Beaumont on the 27th day of October, 1942, be and the smie is here-
by apportioned among the various interest and sinking funds as
follows:
- To the interest and sinking fund of Airport Bonds #1, dated

Section 2.
That the tax of Twentyz s ix Cents :($..26) on each one hundred
dollars valuation of all taxable -property within the present limits
of the Beaumont Independent School District heretofore.levibd for in-
terest and sinking fund accounts -and --ordered collected by an ordin-
ance passed on the 27th day of October, A. D. 1942, be and the same

is hereby apportioned among the various school bond interest and
sinking funds as follows:
To the interest and sinking fund of -School House Building
Bonds #6, dated November 1, 1916 - Two Cents and Four Mills (.0240).
To the interest and sinking fund of School Bonds 1922, dated
October 1, 1922 - Four Cents and Eight Mills ($.0480).
To the interest and sinking fund of School House Building &
Repair Bonds #7, dated May 1, 1924 - One Cent and Four Mills ($.0140).
To the interest and sinking.fund. of School House Building
Bonds #8, dated September 1, 1924 - Four -Mills ($.0040)..

Section 3.:
That the City Tax Assessor and Collector is hereby instructed
to pro -rate the said sums so assessed according to the provisions of.
this Ordinance, and to so -present his statement and report to the
Director of Finance that said officer may be able to place all col-
lections made under said tax to the credit of theproper fund, and
that the same may not be diverted or used' -for any other purpose.
Section 4.
The Ordinance passed by'the City Commission of the City of
Beaumont on August 4, 1942, apportioning the taxes levied and or-
dered collected for the -.-year 1942, is hereby expressly repealed and
allio�other' ordinances or parts or ordinances in conflict herewith, are
hereby repealed.
Section 5.
The fact that the ordinance levying taxes for the year 1942,
passed by the'City Commission of the City of Beaumont on August 4,
1942, has been repealed and a new ordinance levying taxes for said
year has been enacted by the City Commission of the City of Beaumont,
and the fact that no apportionment has been made of the assessments
levied by the new ordinance to provide for the interest and sinking
fund for the bonded indebtedness of the City of Beaumont, creates an
imperative public emergency necessitating the suspension of the rule
requiring public ordinances to be read on three separate meetings'be-
fore their.passage, wherefore, said rule is hereby suspended and it is
enacted that this Ordinance shall be in force from and after its
passage and publication.
PASSED this the 27th day of October, A. D. 1942, by the affir-
mative vote of all members of the City Commission.

ORDINANCE
PROVIDING FOR THE LEVYING; AS,SESSING'AND COLLECTING
OF AD VALOREM! AND OTHER TAXES FOR THE YEAR 1942 FOR THE PUR-
POSE OF PROVIDING A SINKING FUND TO MEET THE PAYMENT OF ALL
BONDED INDEBTEDNESS OF THE CITY OF BEAUMONT, AND THE PA7YMENT
OF ACCRUING INTEREST THEREON; PROVIDING FOR THE SUPPORT -AND
MAINTENANCE OF THE CITY OF BEAUMONT PUBLIC FREE SCHOOLS; TO
PAY THE EXPENSE OF THE DEPAR'BgENTS OF THE CITY GOVERNMENT, AS
NAMED IN SAID ORDINANCE; AND THE GENERAL EXPENSE OF THE CITY
GOVERNMENT; AND APPORTIONING THE TAXES TO BE LEVIED TO SUCH
DEPAR'BIENTS AND PURPOSES AS SET FORTH IN -SAID ORDINANCE; PRO-
VIDING FOR THE PAYMENT OF OCCUPATION TAX; EXPRESSLY REPEALING
THE TAX LEVYING ORDINANCE PASSED BY THE CITY COMMISSION OF
THE CITY OF BEAUMONT ON AUGUST 4TH, 1942 AND ALL OTHER ORDIN-
ANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLAR-
ING AN EYIERGENCY.
;BE IT ORDAINED BY THE CITY COMMISSION OF THE.CITY OF
BEAUMONT, TEXAS:
Section 1
That there - shall -be ' and is --hereby levied and -shall be
assessed -and collected for the year '-1942; for municipal,, -purposes
only, an ad valorem tax, of One and 95/100 Dollars ($1.95) on each
One Hundred Dollars worth of property located within the present
city limits of the city` of --Beaumont, made taxable by lava, which
said taxes when collected shall be, -according to Section 16 -of
the Charter of the City of Beaumont-, apportioned among the -funds
and departments of the city government of the -City of Beaumont and for.
the purposes hereinafter set forth as follows, to -wit:- .
For the -General Fund 1.05
For the support and maintenance of

For the support and maintenance of
Charity Hospital .03
For the purpose of paying the accruing
interest and to provide a sinking fund
for the payment of the entire bonded in-
debtedness of the City of Beaumont for

. That there shall be and is hereby levied and shall be
assessed and collected for the year 1942, a school maintenance
tax of Sixty-eight Cents (68X) on each One Hundred Dollars worth
of property lying and being situated within the present limits of
the Beaumont Independent School District; and there shall be and
is hereby levied and shall be assessed and collected for -the year
1942, a tax of'Twenty-six (26�) on each One Hundred Dollars worth
of said property to take care of the interest and sinking fund on
the school bonded indebtedness of the City of Beaumont within the
present limits of the Beaumont Independent School District.
Section 3
That there shall be and is hereby levied and there shall
be collected on all occupations and cal lings.on which an occupa-
tion,tax:�is levied by the State of Texas, a sum equal to one-half
of the amount so levied by the State of Texas, on each respective
occupation or calling in the City of Beaumont.
Section 4
The ordinance passed by the City Commission of the City
of Beaumont on August 4, 1942 for the purpose of levying taxes
for the year 1942, is hereby expressly repealed and all other or-
dinances or parts of ordinances conflicting with the provisions
of this ordinance, are hereby repealed.
Section 5
The fact that the courts of this State have declared parts
of the ordinance of August 4, 1942, levying the taxes for the year
1942, invalid, leaves the City of Beaumont, without a valid ordin-
ance in effect levying the taxes for the said year 1942, and the

fact that the taxes for said year will soon become due and pay-
able creates an immediate public emergency, necessitating the
suspension of the rule requiring ordinances to be read on three
separate days before passage, wherefore, said rule is hereby sus-
pended and it is enacted that this Ordinance shall be in full
force and effect from and after its passage and publication.
PASSED this the 27th dayof October, A. D. 1942, by the
affirmative vote of all members of the City Commission.
