Home My WebLink AboutORD 11-OAN ORDINANCE "/1—D ENTITLED AN ORDINANCE GRANTING TO THE BEAUMONT WHARF AND TERI,4INAL COMPANY, A CORPORATION, ITS SUCCESS- ORS AND ASSIGNS, A FRANCHISE RIGHT TO MAINTAIN AND OPER- ATE AN INDUSTRY TRACK FROM A POINT IN BLANCHETTE STREET SOUTH OF BLOCK 69, OF THE OLD TOWN OF BEAUMONT, CONNECT- ING WITH AND PARALLEL TO THE MAIN TRACK OF THE BEAUMONT WHARF AND TERMINAL COMPANY NOW CONSTRUCTED IN SAID STREET AND RUNNING DOWN SAID BLANCHETTE STREET TO A POINT JUST BEYOND LOT NO. 357 IN SAID BLOCK, AS SHOWN BY THE BLUE PRINT ATTACHED TO THIS ORDINANCE; PROVIDING ALSO THAT SAID TRACK IS AND SHALL BE USED ONLY AS At IN- DUSTRY TRACK, AND PROVIDING FURTHER THAT THE.RIGHTS AND PRIVILEGES HEREIN GRANTED SHALL BE ACCEPTED IN WRITING BY THE BEAUMONT WHARF AND TERMINAL COMPANY WITHIN THIRTY (30) DAYS AFTER THE PASSAGE AND APPROVAL, OF THIS ORDIN- ANCE; ALSO PROVIDING THAT THE BEAUMONT WHARF AND TERMIN- AL COMPANY SHALL PAY TO THE.CITY OF BEAUMONT ANNUALLY ON THE FIRST DAY OF JULY OF EACH YEAR THE SUM OF FIFTY AND N0/100 (050.00) DOLLARS AS REASONABLE COMPENSATION FOR THE PRIVILEGE AND FRANCHISE HEREBY_ GRANTED AND PROVIDING FURTHER THAT SAID FRANCHISE SHALL BE SUBJECT TO THE TERMS AND CONDITIONS OF THE CITY CHARTER OF THE CITY OF BEAUMONT AND SHALL EXIST FOR A PERIOD OF TEN (10) YEARS FROM AND AFTER JUNE 14TH, 1942. BE IT ORDAINED BY THE CITY COM1'�,ZISSION OF THE CITY OF BEAUMONT: Section 1. Beaumont Wharf and Terminal Company, its and their suc- cessors and assigns, are hereby granted the right and fran- chise to maintain and operate at their own expense a stan- dard gauge railroad track along, over and upon Blanchette Street, from a point in the main line track of the Beaumont Wharf and Terminal Company in Blanchette_St.at Track Chain- ing Station 25+56.4, to a point just beyond Lot -No. 357, in Block No. 69, a distance of approximately 343 feet, as more accurately shown by the blue print hereto attached marked "Exhibit A" and made a part of this ordinance, the line.of said railway being indicated by the red lines drawn on said blue print. Section 2. The track now on said right of way which is to be main- tained and operated under the terms and conditions of this ordinance shall be used only as an industrial track, that is, for the purpose.of affording loading, unloading, and switching facilities to commercial and industrial enter- prises now located or hereafter to be located in the vicin- ity of said track. Section 3. The foregoing rights and privileges are granted upon the expressed condition'that the said grantee shall, within thirty (30) days after the passage and approval of this C -d-, //-a ordinance, file with the City Clerk of the City of Beaumont their written acceptance of this ordinance. Section 4. This ordinance and the rights and privileges there- in granted are subject to all of the terms and provisions of the Charter of the City of Beaumont, and said privi- leges and franchise hereby granted shall continue in force for a period of ten (10) years from and after June 14th, 1942. Section 5. As reasonable compensation for the rights and privi- leges granted by this ordinance, grantee agrees and obli- gates itself and its successors and assigns, to pay to the City of Beaumont on or before the first day of July of each year after the takin effect of this ordinance, the sum of Fifty and No/100 650.00) Dollars.
